An article appeared in the St. Pete Times - Judge: Does Aisenberg drug admission exist?
The Tampa Tribune ran a story this morning called "Aisenberg Statement Ordered". It was buried in the back of the Metropolitan section. I was unable to find it online so I will post the text article.
TAMPA -- Federal prosecutors in the Baby Sabrina case have been ordered to prove the existence of a taped statement in which Steve Aisenberg allegedly admits using cocaine.
If such a statement does exist it should be provided to Aisenberg's lawyers, ruled U.S. Magistrate Mark Pizzo.
Aisenberg and his wife, Marlene, were charged in September with seven counts of conspiracy and lying to investigators in the unsolved 1997 disappearance of their infant daughter, Sabrina.
Investigators say the couple's own words --secretly recorded in their Valrico home following the disappearance -- suggest Sabrina is dead.
The Aisenbergs have pleaded not guilty.
At a bail hearing following the couple's arrest in Maryland, Assistant U.S. Attorney Rachelle DesVaux Bedke told a magistrate that prosecutors had a taped statement in which Steve Aisenberg admitted harming his daughter, and blamed cocaine.
But the Aisenbergs' lawyers say they haven't found such a statement in any of the evidence provided by the government.
Pizza noted in his ruling Tuesday that Aisenberg "successfully satisfied his initial drug screening" followed his arrest and is no longer being tested for controlled substances.
Pizza said prosecutors had nether pointed to a specific recording to confirm the drug allegations nor acknowledged that no such recording exists. He gave them 10 days to do one or the other.

Mr. and Mrs. Aisenberg appear in Court. Baby Sabrina's parents proclaim their innocence. The defendants will retain Mr. Cohen simply because he has represented both of them from the beginning. Judge Pizzo has scheduled a hearing for October 15th, during which attorneys on both sides will argue over the potential conflicts which could arise if Steve and Marlene Aisenberg are represented by the same attorney. Judge Mark Pizzo also set a tentative trial date for sometime in December with Federal Judge Steven Merryday presiding.

Sabrina is still missing. There has been lots happening the past few weeks. I
have not updated this site due to the high volume of press recently in this
case. They have kept the followers of this case informed pretty good. Today on Bay
News 9, it was reported that Judge Dennis Alverez has denied a motion by the
Tampa Tribune and the St Petersburg Times to release any records or tapes
related to the Aisenberg case. The judge says releasing any of the information
could jeopardize the ongoing investigation. He added this case does not fall
under the public records act. The case continues to gain national interest.
Sabrina Aisenberg disappeared from her home nearly two years ago. Marlene and
Steve Aisenberg say someone kidnapped their child, but they now face charges of
making false statements to law enforcement officers. Investigators say they have
tapes of incriminating conversations between the Aisenbergs. Today those tapes
raised questions on CNN's burden of proof. The Aisenberg's are schedule to be
arraigned on federal charges October 6th.
