Tonight, my future landlady knocked on my door and needed to talk to me. Apparently, the first floor tenants (who are in the process of being evicted for not paying rent) called to report my apartment as an illegal basement apartment. Department of Building Inspectors have been here to inspect my apartment on 2 Saturdays when I wasn't available to answer the door. They left a notice stating that, if there was no response from the building owner, and they came a third time to inspect the apartment and did not have access, they could obtain a warrant to gain access to the apartment without someone being here.
I called my landlord and left him a message asking him WHAT was going on, and told him that, if he doesn't contact them and they get a warrant and break into my apartment while I'm not home to gain access for inspection purposes, that I am OUT of here. I was panicked, since I thought they could literally come here, find it in violation, and evict me on the spot. I got some good info and phone numbers from the local government site, and plan to make a bunch of phone calls from work. In a nutshell, all the inspectors can do when they come is enter the apartment (if no one's home after numerous attempts, with a warrant, if necessary), inspect the apartment, and if the apartment is in violation, issue a violation to my landlord. Then, he has to appear in court, pay the penalty, and correct the violations and apply for a revised Certificate of Occupancy to register the third apartment with the city legally. Depending on the violations, I might or might not have to vacate the apartment once it goes to court. So at least I don't have to worry about being tossed on the street on short notice. It's very likely that the inspectors will show up again this Saturday afternoon. The one 'up' side to this is that, if the apartment IS in violation, I LEGALLY do not have to pay him any rent until the violations have been corrected. Personally, I hope they give him the biggest penalty fines possible. As of tonight, I've more or less decided that my days in this apartment are over - this news was the last straw. I hate all this aggravation, and I need it like I need a hole in the head, but I can't say that I'll miss this place. |

When my landlord finally called me back, he suggested it would be 'better for me' (yeah, more like better for HIM) if I was out of here by the end of October. I'm hoping to find something near my sister's house, but if I found something really great in my neighborhood, I'd take that too. I also decided that I'm not paying him any rent for October - I'll need that money to put down a deposit on whatever new apartment I find, and to pay movers. I'm sick of all the crap I've gone through with him and this apartment. |
