The Preamble Myth Clarified

This following E-Mail remain's one of the all time classics here at F.A.C.T.S. Since this E-Mail a lot has changed with the Preamble to the US Bill of Rights debate. Very quietly, the National Archives and the US Government have admitted to the fact, that yes, there is a Preamble to the US Bill of Rights. Beyond that admission, the archives and government will not elaborate any further. At least it is a step in the right direction.

Our first seat on the train goes to a "former American" currently living in Australia with the Web name of "Bear." Apparently our Bear is a well respected, highly degreed, and titled scholar, who is looked upon in high regard for his educated expertise on the American Constitution and Bill of Rights.

Our well educated friend (and teacher?) is under the misconstructed illusion that there is absolutely no such thing as a Preamble to the United States Bill of Rights. Here is some of his E-mail correspondence in regards to there not being a Preamble.

"Would you describe just what you mean by "preamble to the bill of rights"? What constitution is this clause to be found in? There is no such thing in the US Constitution, and there is no bill of rights in the Aussie one."

"I am sorry to have to say this to you, but in spite of your "42 years of research on the US Constitution", you are badly misled in your belief that an address made to Congress at the time of the announcement of the acceptance into the constitution of the first ten amendments was a "preamble", and if you subscribe to the nutty ideas expressed by "KittKatt" on the radical website (
no longer a working URL) you recommended as proof of this "preamble", then you are really no scholar at all. This "preamble" is nonsense.

Unlike yourself, I was born in Washington DC, into a government family. My godfather was a Supreme Court justice. My grandfather was a Jeffersonian scholar and authority on the Constitution, as well as being a distinguished statesman and trust-buster. My father was a career legal bureaucrat. I have known a lot about the Constitution all my life, and I am now 63. If you read the contents of my site, you already know this. Don't continue to delude yourself, there is nothing that has been "left out" of the Constitution. Neither by accident, oversight nor intent. I have given credit to the sources of the copies of the Constitution of the US and of Australia on my pages."

Well Bear, if you intend to stay one step ahead of the truth you have to know what the reality of the truth is in the first place, and it would also help if you knew the ground (truth) that you were standing on was firm and supportive of your position. Sorry Bear, but you're the one that's in for some bad news, and before one comments on what a "scholar" is and isn't, well you definately isn't!

Yes!!!, "Bear," there is a Preamble to the American Bill of Rights and it was read aloud to Congress on its acceptance. It was not a separate speech or a document that was tacked onto the United States Bill of Rights.

The Preamble to the Bill of Rights appears on the original document, as it was sent to and then ratified by the several States. The Bill of Rights was signed by Thomas Jefferson, also one of its primary authors. The Preamble is one of the parts that was carefully worded by Jefferson's mighty mind and pen, and it is the opening instructions of the Bill of Rights. Its instructions are very explicit to Congress and those in power within government, and in conjunction with the first clause of the First Article it tells those in Congress and others within power that they shall not and can not misconstruct, tamper with, and abuse those Constitutional basic human rights that belong to the masses of American people. This is probably why the Preamble is not readily found or mentioned in text books or other important places where the masses of people can easily find it.

How can you expect the people to know what the real truths are, when those truths are continually hidden away from common viewing and the general knowledge of the masses of the people?

"Oversight?" "Intent?" Deception? Sure appears like that! Oh shades of the mother lode of coverups! Another educated scholar smoked away by the truth!

Once again, the truth has proven that it does indeed stand by itself, and it was only the error that needed correcting. Sorry Bear, come back and play when you understand that a scholar is a scholar not because of the college titles that are bestowed on them, but because they never stop the quest for learning and knowledge.

The conventions of a number of the States having
at the time of their adopting the Constitution,
expressed a desire, in order
to prevent misconstruction or abuse of its powers,
that further declaratory and restrictive clauses
should be added: And as extending
the ground of public confidence in the Government,
will best insure the beneficent ends
of its institution.
