eplex as reseller of web hosting, internet services, Logo design, e-resume, mbox and other e-Products and e-Services from different entity agrees to provide, and Client agrees to receive, access to the Web Hosting and related Services according to the following Terms and Conditions:

The Client is the person or entity who is applying or who is receiving Web Hosting Services from eplex

The Web Hosting Service is provided on an "AS IS, AS AVAILABLE" basis. eplex gives no warranty, express or implied, for the Web Hosting Services provided. This no warranty expressly includes any reimbursement for losses of income due to disruption of services by eplex or partner entity or its providers beyond the fees paid by client to eplex for services.

Client will use the Web Hosting Services in a manner consistent with any and all applicable laws of the State of Queensland and the Australian Federal Government.

Use of any information obtained by way of eplex is at Client’s own risk, and eplex holds no liability for such use.

eplex or the partner companies are not responsible for any damages arising from Client’s use of eplex or by Client’s inability to use the Web Hosting services or any other services for any reason.

While eplex shall make every reasonable effort to protect data stored on Client’s Server(s), eplex is not responsible for Client’s Data, files, or directories residing on hosting company's equipment. Client is solely responsible for maintaining data, file, and directory structure backups.

The customer is required to provide eplex with correct and up to date contact details for billing and technical notification purposes. eplex takes no responsibility for disruption to services due to inability to contact the customer.

Personal accounts are to be used by the primary owner only. Personal account holders are not permitted resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

eplex reserves the right to refuse service and /or access to its servers to anyone and do not allow any of the following content to be stored on its servers:

Illegal Material - This includes copyrighted works, commercial audio, video, or music files and any material in violation of any Federal, State or Local regulation.

Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of eplex.

Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

Payment can be by cheque, money order or direct credit and in accordance with the terms on the eplex.com.au invoice which will be forwarded to Client by postal mail.

All accounts are set up on a prepay basis. Although eplex reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established. Customers will automatically be charged again at the end of their prepay period unless closure notification has already been given.

eplex reserves the right, in its sole discretion, to deactivate the Clients Web Hosting account(s) upon an indication of credit problems including delinquent payments.

eplex reserves the right to modify these Terms and Conditions in any way and as required. Notice of such changes will be delivered to users via postings on eplex Web Site only. Continued usage of Web Hosting Services indicates your acceptance of the Terms and Conditions in their amended form.

Client warrants that it has the right to use the applicable trademarks of Client, and grants to eplex and partners the rights to use such trademarks, if any, in connection with eplex's promotion of, referencing of, cataloging of, or indexing of eplex’s Web Hosting clients.

Client hereby agrees that any material submitted for publication on eplex and partner's website through Web Hosting Services received by the Client will not violate or infringe any copyright, trademark, patent, statutory, common law or proprietary rights of others, or contain anything libellous or harmful.

Client is responsible for and must provide all telephone, computer, hardware and software equipment and services necessary to access the Web Hosting Services with partner companies. eplex makes no representations, warranties, or assurances that Client’s equipment will be compatible with our hosting Services.

Users of Internet and electronic forums should be considerate of the expectation and sensitivities of others on the network when posting material for electronic distribution. The network resources may not be used to impersonate another person or misrepresent authorisation to act on behalf of others or eplex. All messages transmitted via eplex and partner company's service should correctly identify the sender; users may not alter the attribution of origin in electronic mail messages or postings. Users must not attempt to undermine the security or integrity of computing systems or networks and must not attempt to gain unauthorised access.

Due to the public nature of the Internet, all information should be considered publicly accessible, and important or private information should be treated carefully. eplex is not liable for protection or privacy of electronic mail or other information transferred throughout the Internet or any other network eplex or its customers may utilise.

Use of distribution lists via unsolicited electronic mail or other electronic mailings is strictly prohibited. eplex and hosting partner reserves the right to deactivate the Client’s Web Hosting account(s) upon an indication of such activity. Client hereby agrees to indemnify and hold harmless eplex and partner company from any claim resulting form the Client’s or another party’s use of electronic mail service(s) on the Clients Web Hosting account(s).

eplex reserves the right to suspend Web Hosting Services without notice for any unpaid or partially paid balances. The Client is responsible for any legal fees incurred for the collection of any unpaid amounts.

Spamming (the practice of sending unsolicited, unwelcome mass mailings to people) is strictly prohibited. Any Client found to be Spamming will have their Web Hosting Services immediately terminated and find themselves billed for any unpaid balances as well as for any damages that occur as a result of it.

Disclaimer

eplex will not be responsible for any damages your business may suffer. eplex makes no warranties of any kind, expressed or implied for services we provide. eplex disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by eplex and its employees. eplex reserves the right to revise its policies at any time.
