http://www.planetout.com "U.S. Supreme Court Limits Visitation". June 6, 2000.
The U. S. Supreme Court found that if it was not in the best interest of the
child then not anyone is allowed visitation rights. The case that this
decision was based on was the Troxel v. Granville. The judges ruled 6-3
that the child should be given to the parent that was 'fit'. Advocates are
happy about this ruling, but they fear that there will be be more court cases
because of appeals and also grandparents who will also try to appeal for
custody.
The judges
made three points about the family that made the advocates happy.
". . . acknowledgement that there is now a great diversity of family units in the nation."
". . . the ruling did nothing to disturb any recent advances in legal recognition of non-biological co-parents.."
". . . the ruling appears to reinforce parental rights in a manner that may serve to protect gat and lesbian parents from efforts by grandparents and others to contest custody based solely on homophobia."
