Malaysia is in shock. It was not foreseen that the appeal of Anwar's attorney, Zainur Zakaria would bring such powerful and revealing rulings. They were delivered with such force, none were prepared for the findings. The Judges of the Federal bench made known they have a strong distaste for the stench of the two trials. They have given, each in a separate judgment, three opinions that the historic trial of Anwar Ibrahim was, in its essence, a frame-up, conducted by the prosecutors, and abetted by the ex-Attorney General.
While not yet named, the ex-Chief Justice figures as a shadow player, directing events from behind the curtains. The conspiracy at the highest levels is clearly revealed, and it points to the truth of everything Anwar Ibrahim alleged during his two trials. The abuse of justice by the trial judge, Augustine Paul, in aid of the conspiracy, is condemned, and his conduct is excoriated to the point he can no longer serve the interests of justice. He must now resign, and it is an open question if he will escape prosecution.
The prosecutors, acting under directions given by their superior, now enjoying his reward by sitting on the Federal Court, are put on notice that their conduct is far beyond any legal or acceptable bound, and thus they may expect further attention in future. At the moment they are still officers of the court, but this cannot be expected to continue. Their service was a dis-service, and a violation of their oath to serve, as well as a slap in the face to all men who revere the traditions of the English Common Law.
The shock is such that Malaysians cannot readily adjust. The meaning of the unanimous judgment dismissing the contempt charges against Zainur Zakaria is clear, and the country blushes with anger to see the names of all those implicated. In other areas, where the culpability is not specifically spelled out, it is easily inferred.
The entire government has been placed under a cloud, from the prime minister, who in his own words "knew everything," to the senior members of his department and close confederates in the Finance Ministry. The conspiracy is a big one, and the list of members is a long one. Those who knew, and had evidence but did not come forward, are themselves accomplices before and after the fact. The full and final accounting will certainly turn the country upside down.
At the moment, Anwar is still in jail, under severe pain from injuries associated with his arrest and mistreatment. The manner of his arrest suggests an official assassination was intended, and the subsequent beating by Rahim Nor at Bukit Aman when the attempt failed lends support to this theory. The finding of extremely high levels of arsenic in Anwar's urine, which was analysed in Australia after symptoms of arsenic poisoning appeared, is evidence Anwar was to be murdered while in prison.
The government denied the poisoning, and Karpal Singh, the attorney who brought it out in court faces charges for his spontaneous outrage. The symptoms of arsenic poisoning include hair loss and a change in skin color, which along with a general lethargy, indicated the potential for arsenic poisoning. This was later confirmed by the urine analysis. The urine sample was obtained some time after the arsenic was given, and thus the findings were lower than would have been the case if the sample had been more timely. Yet still the levels were far greater than can be accounted for from dietary sources.
Such is the arrogance of the conspirators that the arsenic was not denied, only that the level was within levels which could be explained as from an innocent dietary source, such as shrimp. Large and regular portions of shrimp are not among the items offered in the prison diet, yet this ridiculous statement was introduced by the prosecutors, and seconded by the ministers of the party-in-power. Arsenic poisoning carries a medieval coloring, and fits well within the feudal trappings of the prime minister's style.
A news item of June 30 reports that the bankerAbdul Murad Khalid, now in Singapore, has confessed his complicity and regret to Azmin Ali, giving the names and details of those who forced him to read a prepared confession falsely accusing Anwar of having large deposits in overseas accounts. He gives the names of those involved in this criminal behaviour, including a meeting with the prime minister himself. This is the first time that a witness has testified that the prime minister is personally and directly involved in the conspiracy to frame Anwar.
The prime minister was named in another matter during the course of the trial, describing an obstruction of justice, when he stopped an ACA investigation into large sums of loose cash discovered in the desk of an officer in his ministry.
The situation now is that the Federal judges have given notice that the conspiracy is to be fully aired. But because the police power rests with the home affairs minister, there is not now a potential for a prosecution. But the Attorney General serves at the pleasure of the monarch, and is not beholden to the prime minister. It is the monarch then, acting through the Attorney General, who is responsible for the bringing of the necessary charges. Does he have the courage to act? The Malaysian people make few demands on their disjointed royalty, and in this case the pressure to act has been slight.
For the moment, the monarch is resting, and the Attorney General hides. Who, then, among the people of Malaysia, will move to make the matter material? It certainly will not be the parliament, although the opposition members can make a great fuss. This grows to be Malaysia's greatest test of democracy versus dictatorial will, in which democracy stands stone still, paralysed at the spectre it faces.
The aging, but still confident prime minister gloats, daring and defying any to challenge his dictatorial position. Meantime, Anwar waits, the Malaysian public waits, breathless, as more and more fathers and sons disappear into the maw of the dank cells. The arrests continue, with the cases to interminably clog the courts, all this to cover up the thefts, the conspiracy, and to keep the prime minister in his disputed place. If the facts are as revealed in the Likas judgment, he is illegaly in the office, saved by the massive country-wide electoral fraud, itself a subject of a massive conspiracy and cover-up involving the SPR.
The IGP protecting his primate, warns that none will be spared ... not women, nor old men, nor students, nor foreigners, none. Those not arrested and imprisoned without trial will suffer in other ways, from expulsion and exclusion from an education to false charges brought in the courts. All this done in an effort to cover the crime against Anwar, an honest man who simply refused to tolerate more corruption.
His secrets, his powerful position, his impending accession to the prime ministership, made him dangerous to the conspirators. They planned his removal and embarrassment, and have marshalled the entire resources of the country to conceal the deed, done to conceal past misdeeds, and the concealment requires ever new misdeeds. In the effort to cover up the sins of the past, new sins are committed every day against the innocent citizens of the country. How long can this abuse go on?
The police are frightened that a day or retribution is at hand, and thus they are more desperate than before. As the conspiracy comes apart, more and more are implicated by new revelations each day. The judiciary has had its fill, and can stomach no more. The day of justice is thus at hand. The prime minister learns to fly his new Canadian Bombadier jet, preparing for the day when he must scurry through the long damp tunnel from his palace at Putrajaya with his wife, to the waiting and fueled plane. What will he do if the engine does not start?
