If you are a citizen of one of the States making up the union of the united States, your earnings made domestically cannot be directly taxed. It is against the Constitution of our Republic. And, yet, you believe you must pay tax on your personal income. Why is that?
Well, gosh, if you don’t pay up, you face IRS intimidation, maybe physical trauma since they are now armed, threats of monetary penalties and federal prosecution followed by possible incarceration.
Isn’t this what you believe to be true - if you don’t fill out a 1040, the IRS will nail you to a financial cross, take your belongings, including your property, maybe heavily fine you and possibly throw you in jail?
The question is whether or not you were coerced into believing you are a “taxpayer” with
an income that can be directly taxed. You do pay taxes in many forms, such as sales taxes, property taxes, road taxes, etc and that makes you a 'tax payer'. But, are you a “taxpayer” as defined in the IRC?
It is highly unlikely a citizen of one of the States forming the union is an IRC defined taxpayer. Unless you are a citizen of the United States (meaning the home of the federal
government, the District of Columbia or its territories, Guam, Virgin Islands, Puerto Rico, etcetera) or earning through a government granted privilege, such as a corporation or have foreign earnings, then you are NOT an “taxpayer”. [See the below notes concerning the United States and The united States of America.]
So, remember - you as a 'Tax payer' is not the same as “taxpayer” as defined in the code. That is, unless you fill out a 1040 in which you voluntarily subject your earnings to direct taxation and, in essence, become a "taxpayer". That is what you do by filing - you essentially voluntarily give up part of your otherwise non-directly-taxable earnings in the form of direct taxation.
So why volunteer? Direct taxation on a citizen's earnings domestically (unprivileged> is prohibited by the Constitution.
Do you do so because you feel you should since you have liberties and think it is needed to support the federal government, because of ignorance of the law, or because of the threats made by the IRS? Any of the three is the wrong reason.
One of your liberties is to earn a livelihood by trading labor for money or goods or services. Since labor is property (according to the Supreme Court)and equal to earnings you are
willing to work for, there is no gain or profit. You have simply traded your time and abilities for an equal amount of earnings in the form of wages, salary, tips or commission.
In other words, you haven’t an income by code definition.
If you don’t believe this, go through the code and find where it states internal revenue taxable income is wages, salaries, tips, or commission. Spent the time but you won’t find it because it isn’t there. So how about the truth for a change?
Section 7701(a)(14) of the code states: “The term ‘taxpayer’ means any person subject to any internal revenue tax”. So are you a PERSON
subject to direct taxation? By supreme court rulings, all internal revenue taxes are excise taxes (due to direct taxation being prohibited), which applies only to net gain by a corporation or through government privilege (such as a alien being permitted to earn money in this country or a citizen having earnings from abroad).
Thus, by the IRC, you are not a taxpayer (unless you volunteered to be one). You do not have an IRC defined income, nor are you a IRC defined directly taxable person, and, therefore, you are not subject to internal revenue taxation.
Now, to the point. Are we coerced into filing taxes? Of course, this question is only applicable to those who are still paying direct taxes on their incomes.
First, can you get a job without filling out a W-4? Probably not so you are forced to at least volunteer for employment tax. And, withholding taxes (actually employment taxes, not income taxes as that would be unconstitutional) will be taken out of your check.
Second. When you fill out and file taxes through a 1040 form, are you doing so with the knowledge you are volunteering your income or because you are afraid of the IRS and its
terrorists-like behaviors? I daresay the only reason any everyday, ordinary American, whether of average intelligence or of genius intelligence, fills out and files a 1040 is because of fear.
Check this all out for yourself. There are many sources you can use to get at the truth, the two most important being the Constitution and the Internal Revenue Code. I would
recommend staying away from CPA’s and the like since their livelihood depends in part of ignorance of clients (just as does the IRS’s) and because what they learn is taught by
people who have misinterpreted the code and Constitution (including the IRS and our elite in Congress).
If you go to the trouble, it can effectively make you many thousands of dollars during your working life. You will find you are not subject to direct taxation as the federal government
is misleading people into believing with its bully-boy organization, the IRS, intimidating people into complying with the falsehoods.
Okay. Now that you know the truth, when you fill out and sent in next year’s 1040, will you be doing it because of fear of the IRS and its big brother, the government, or because you honestly want to volunteer a portion of your personal income to the federal government?
For most people, (once again) the reason will be because of FEAR of the IRS, a band of people who knowingly force others to give up their earnings while operating against the Constitution of
the Republic of these united States of America.
And, I really don’t care how the government twists it around, doing so because of fear of retribution and being led to believe it is required in spite of the Constitution and the code, it is coercement.
Our tricky government, though, gets out of coercement by having the phrase “under penalities of perjury” on the forms, which is basically relying on an under-handed method of taking people’s money. They rely on the assumption that each person filling out a 1040 wouldn't lie about being a "taxpayer". Thus, they keep the money and can blame it on the person fraudulently declaring themselves a "taxpayer" should any ever question it.
Functionally speaking, it’s a con job. You are actually conning the government into taking your money by you having been coerced and conned into believing you are a 'taxpayer'. To put this in perspective, if you force anyone to do anything, it is coercement and illegal. If you mislead people through wording on a product or verbally lie about a product, it is fraud. Why should it be any different just because it is the government?
Fraud is fraud. Coercement is coercement> Isn’t it really that simple?

Also, in Article VI, Clause 3, it is stated: “The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicail Officers, both of the United States and the several States, ...” (my emphasis)
There are other examples but it should be clear that our forefathers intended on keeping the United States
separated from the united States and, thus, the District of Columbia, home of the federal government, is
NOT part of any of the 50 states now forming the union.
Thus, 'United States' in the Constitution refers only to the home of the federal government, the District of Columbia, and federal holdings, such as the territories listed in the IRC.
