Martin Mason's Will

CAMPBELL COUNTY WILL BOOK #1, Pg.

In the name of God Amen, I Martin Mason of the County of Campbell and state of Virginia being of perfect mind and memory and calling to mind the mortality of the body and knowing it is appointed for all men once to die do make and ordain this my last will and testament in manner and form as followeth. In the first place my will is that all my moveable estate remaining after my decease be sold according to law and the proceeds thereof applied to the payments of my just debts and the expenses of executing this my will and if the movable estate be not sufficient to pay said expenses I order one hundred acres of land to be sold for the same purpose joining the lands of Walls (?) and Hams and Clark and after said expenses are paid the remainder to be equally divided among all my children giving one fifth to the children of my deceased daughter Asenah Snow. In the next place I give my land in form and manner here in after mentioned my interests in the mill I give to my son John and my grandson Martin Mason, to each an equal part and with the mill I give them the following land to with, beginning on a white oak corner tree between Stephen Callaham, John Mason and myself, thence to the creek just below the baptising place thence to the north west end of the mill dam thence up the north west side of the pond to its head thence crossing the creek to the north side of the hollow coming in from John Masons thence a straight line to a box oak in John Mason's line just above his plantation in the fork of the road, thence along ____ Mason's ____ him to the beginning provided that the said Martin Mason shall not sell his part but by permission of his father. I also give to my son John One hundred acres of land, beginning in a point on a box oak corner tree in his own line near the fork in the road above his plantation thence along his own line to Jones corner thence out as to include one hundred acres adjoining the same and beginning on the same tree in a point I give to my son John one fifth of all the remaing land I own not here to for mentioned that is a fifth of the number of acres adjoining the same I give to my daughter Elizabeth Arthur my house and land joining Stephen Callahan and William Fosdick and also what now belongs to me of my patent track of land joining the same of one hundred and fifty acres lying on both sides of the creek and then as many acres added as will make it a fifth of the acres, I now after taking off what I have alloted to the mill and John Mason's first hundred acres adjoining the same I give to my daughter Jemina Owen and her heirs as many as I have given to my daughter Elizabeth Arthur, adjoining the same I give to the children of my deceased daughter Asinah Snow, I give as many acres as I have given to my daughter Elizabeth Arthur out of which Catherine Snow is to have fifty acres with a spring of water on it and lastly to my daughter Lavinia Callahan and the heirs of her body I give an equal number of acres , include my old dwelling house and plantation near Flat Oak meeting house provided that the said plantation shall not be leased or rented to any person whatever but by permission of my Exector this tract of land is to include seventy five acres of land which I bought of John Kelly and thirty five acres joining the same patented to me and the remainder to be taken from my other lands on troublesome which remenant may be sold by the permission of my Executor. And I do hereby appoint my son John Mason Executor of this my last will and testament revoking all other and confirming this to be my last will , in writing whereof I have hereunto set my hand and seal this sixteenth day of May one thousand and eight hundred and twenty two.
