Notes
- Under a new law signed by President Clinton in 1998, states that are not
ready to be certified by the end of the federal fiscal year can choose a penalty
of a percentage reduction in their federal child support funds. These states are
eligible for a waiver of the penalty if analysis by an on-site certification
review determines that the state is in compliance with the Family Support Act of
1988 system certification requirements.
- As in the note above, these states chose the penalty of a percentage
reduction in federal child support funds or could risk losing all federal child
support funds.
- As these states do not have systems that meet Family Support Act
certification requirements and have not opted for the alternative penalty, they
are now subject to losing all their federal child support funds. A hearing will
be conducted for each state before HHS would terminate funding.
