DEED

PHILLIP MINTONS CHILDREN TO DAVID MINK

This Indenture made this 17th day of January in the year of our lord one thousand eight hundred and thirty nine between Peter Little & Hannah his wife of the county of Morgan & state of Kentucky, Richard Minton, Phillip Minton and Mary his wife, Evan Minton and Hannah his wife & Jacob Minton & Sarah his wife of Lee County, & state of Virginia & Sarah Vance of Smyth county & state of Virginia heirs of Phillip Minton Deceased of the one part and David Mink of said county of Smyth and State of Virginia of the other part witnesith that the said heirs of Phillip Minton deceased for & in consideration of the sum one hundred & twenty dollars current money of the United States to them in hand pay the receipt whereof they do hereby, acknowledge have guaranteed, bargained & sold & by there presents ? bargain & sell unto the said David Mink a certain tract or parcel of land Excepting two shares lying in the said county of Smyth & state of Virginia on the dry branch of the South fork of Holston river joining the lands of ? and others containing one hundred & fourteen acres be the same more or less being a part of a four hundred acre tract granted to Edward McGinnis by patent bearing on the second day of June 1782 being the same tract convayed by Edward McGinnis to David Watkins & by said D. Watkins to Benjamine Watkins & by said Benj. Watkins to said Phillip Minton Deceased and bounded as followeth to wit, "Beginning at three white oaks on a ridge thence south 74 West 48 poles to a white oak North 50 West 70 poles to a mountain Burch south 15,West 90 poles to three white oaks South 39 East 50 poles to a white oak on the south side of a dry run South 66 poles to two white oaks up said dry run, north 84 East 136 poles to a Black oak & chestnut north 30 West 80 poles to a white oak & sowerwood north 41 West 80 poles to the beginning, with all and ? the appertances to have & to hold thereof said tract or parcel of land with all the appertances ? said David Mink and his heirs to the ? of him the said David Mink & his heirs forever and they, the said hries of Phillip Minton deceased for themselves & their heirs do convant with said David Mink and his heirs that they the said heirs and their heirs the said tract or parcel of land with all the appertances unto the said David Mink & his heirs against the claims of all persons whomever shall ? and will forever defend. In ? wherefor they the said Peter Little & Hannah his wife, Richard Minton, Phillip Minton & Mary his wife, Evan Minton & Hannah his wife, Jacob Minton & Sarah his wife & Sarah Vance heirs of Phillip Minton deceased have hereunto set their hands and affixed their seals the day & year first above written signed sealed and delivered in the presence of us.

Lee county to wit

We Isam Hubbard and John W. Fulkerson justices of the peace in and for the county of Lee aforesaid do hereby certify that Richard Minton, Phillip Minton, Evan Minton and Jacob Minton parly to a certain deed bearing date 17th day January 1839 and hereunto ? personally appear before us at Evan Mintons in the county aforesaid and acknowledge the sum to be their act and deed and desire us to certify their said acknowledgement to the clerk of Smyth county in order that the same may be recorder. Given under our hands and seals the day and date mentioned.

Lee county to wit

We Isam Hubbard and John W Fulkerson justices of the peace in and for the said county of Lee and state afore said do hereby cerify that Mary Minton wife of Phillip Minton , Hannah Minton wife of Evan Minton and Sarah Minton wife of Jacob Mintonparty to a certain deed bearing date the 17th of January 1839 and hereto ? personally appear in before us at the home of Evan Minton in the county and state afore said and being examined by us jointly and apart from their said husband they the said Mary Minton, Hannah Minton and Sarah Minton declare that they had willingly signed & sealed and delivered the same as their act and deed and that they wished not to retract it and desiren us to certify their said act acknowledgment to the clerk of Smyth county in order that the sais may be their reason giving unto our hands and seals the day and date above mentioned.

Re Morgan county to wit

We John Rage and Caleb Nash two of the commonwelth justices of the peace so bounty do cerify that Hannah Little the wife of the within named Peter Little this day personally appeared before us who being examined privatly and apart from her husband as the law directs voluntarly, with her own free will and concent relinquish her right of dowery to the premises conveyed by this deed and same is certified to the clerk of the county court of the county of Smyth and state of Virginia for record where the presence ? ? our hands and seals this 8th of February 1839.
