ASSIGNMENT

I, THORLEIF HEXUM, father of Jon-Erik Hexum, deceased, fully understand that the estate of Jon-Erik Hexum is to be distributed equally among his parents in accordance with California Probate Code Section 225.
I hereby waive all claims to my share of the estate of Jon-Erik Hexum and further assign this and any other claim I may have to any property, money or future income to Gunnar Hexum. This waiver and assignment constitutes the release of any and all of my rights under California Probate Code Section 225.

I further waive any right, title and interest in and to my cause of action against 20th Century Fox, or any others, for any wrongful death action arising out of the death of Jon-Erik Hexum.

Petitioner, GUNNAR HEXUM, respectfully represents:

1. Date of Death and Residency:
JON-ERIK HEXUM, a resident of Los Angeles County, State of California, died on October 19, 1984.

2. Will Admitted and Letters Issued:
a. Despite search and inquiry, no will of decedent has been found.
b. Letters of Administration were issued to Petitioner on February 27, 1985, have never been revoked or suspended, and are still in full force and effect.
c. Pursuant to the Order for Probate, Petitioner was granted authority to administer this estate under the Independent Administration of Estates Act. Petitioner’s authority to do so administer the estate has not been revoked.

3. Notice of Death and to Creditors:<> Notice of Death and of Petition to Administer Estate and to creditors has been published in the manner and for the period prescribed by law. The first publication was on December 28, 1984. The period within which to file claims has expired. The creditor’s claims described in Exhibit B hereto were presented, approved by Petitioner and paid:

4. Inventory:
An Inventory and Appraisement totaling $380,000.00 was filed on September 3, 1985.

5. Taxes:
a. No federal income taxes are due and payable by the estate.
b. No California Fiduciary or income taxes are due and payable by the estate.
c. No personal property taxes are due at this time.
6. Status and Character of Estate and Closing Expenses:

a. The entire estate is the separate property of the decedent.
b. All debts and expenses of administration except closing expenses and compensation to Petitioner’s Attorneys have been paid.
c. Attached hereto and incorporated herein is Exhibit A, covering the property on hand in this estate.
d. Notice under Section 700.1 of the California Probate Code is not required because the above-named decedent was not the recipient of Medi-Cal benefits.

7. Statutory Compensation
The statutory attorneys’ fees and administrator’s commission, payable for their ordinary services in the sum of $9,158.00 is computed as follows:

10. Summary of Account:
Attached hereto as Exhibit “A” and incorporated herein by reference is a complete, true and correct account of all property in the estate which has come into petitioner’s possession, including income, issues, profits and royalties, and all sums expended by petitioner on behalf of the estate, for the period from October 18, 1984 to November 30, 1985, inclusive. During the period covered by this accounting, the personal representative has kept all cash in his possession invested in interest-bearing accounts or investments as authorized by law, except such amounts of cash which were reasonably necessary for the orderly administration of the estate.

*Thorleif Hexum as assigned all of his interest in the estate to Gunnar Hexum, pursuant to a written assignment executed April 22, 1985, a copy of which is attached hereto and incorporated in this account petition as Exhibit “D”.

Petitioner has performed all duties required of him as Administrator with respect to the administration of the estate, and the estate is now ready for distribution.

WHEREFORE, Petitioner prays for judgment of this Court as follows:
1. That the administration of the estate be brought to a close;
2. That all acts and proceedings of Petitioner as Administrator be confirmed and approved;
3. The Court authorize the administrator to retain the sum of $500.00 for closing expenses of administration and to deliver the unused portion prorata to the distributees without further Court order after the closing expenses have been paid.
4. Petitioner be authorized to retain the sum of $9,158.00 as his statutory commission.
5. Petitioner be authorized and directed to pay to Bushkin, Gaims, Gaines and Jonas the sum of $9,158.00 as statutory fees to petitioner and to this estate.
6. Distribution of the estate in Petitioner’s hands and any other property of the decedent’s estate hereinafter discovered which is not now known, be made to the persons entitled as set forth in Paragraph 11 entitled “Distribution” of this Petition;
7. Such further order be made as the Court deems proper.

The foregoing account contains a full statement of all charges against me and all credits to which I am entitled on account of the estate for the period embraced in the account.
I declare under penalty of perjury that the foregoing is true and correct and that I signed this declaration in Dorchester, Massachusetts on April 8, 1986.
