The typical problem with such inheritance matters is that of multiple claims for the same property.

Thus, a probate proceeding begins (in courts of law) when the problem involves a personal estate. One of the rivals for the inheritance brings suit to win court approval for taking the inheritance by force (if necessary). The court remedies available to the winning rival include forced evictions, confiscations, attachments of income, seizing of assets, and other similar forced dispossessions.

With nation-sized groups of people (and nation-sized parcels of land), however, there has been a long history of "might makes right." In such cases, the "court" and "trial" are military matters decided upon battlefields.

Recently, by the way, the United Nations has attempted to freeze the deciding of such matters upon battlefields; but only in the matter of expanding the borders of one existing nation (at the expense of another). The United Nations largely ignores the identity of the ownership group within an existing nation.
