917 of 1995 ‑ Defendant Sim Ah Chai vs Arab Malaysian Credit Berhad
I
refer to the attendance in my office on 9 may 2001.
After
perusing through my file records, I have located a letter dated 4/12/95 where
M/s Wong Tan & Molly Lim made amendments to the Draft Order dated 1/12/95.
The
amendments were disputed by our Mr Eng Seow Peng,, the solicitor-in-charge as
can be seen in our letters dated 6 December, 1995.
On
22 December 1995, the Assistant Registrar reversed his decision after hearing
the parties and refused to set aside the judgment dated the 6 July 1995.
The
default judgment entered on the 9 December 1995 would not be a valid judgment if
the default judgment dated 6 July 1995 is still subsisting. The default judgment
dated 6 July 1995 is for a higher amount. There should not be 2 default
judgments subsisting. The Plaintiff should make an application to amend the
prior default judgment.
