A Bit Of Good News... sort of

Less than a month later....

Good News Gone Bad

 Well, the adjuster wasn't making it up and I got the check she put into the mail the other day today. I was able to exhale and pay a few bills because I got it. This is a horrid way we are forced to live just because we were seriously injured on our jobs.

It's bad enough we have to suffer debilitating pain 24/7 because our injuries were not allowed to be medically treated when we were first injured but when you cannot even have the peace of mind that your payments are going to get to you, it's just putting more stress on us.

What this did to me was raise my blood pressure. When I saw my doctor it was high and it has been normal for a very long time. This is what the stress and anxiety they cause us does to our bodies. Our bodies can only take so much of this endless aggravation they purposefully cause us.

They've already destroyed our health and futures and it's as if they want to end our lives by doing things such as this to cause us to have either a stroke or heart attack caused by the stress and anxiety they add to every thing else. They would rather we die because they would save money and I swear, when you are my age, they know you can be a candidate for either a stroke or heart attack from the stress, pressure and anxiety they cause us.

It's very hard not to have your blood boil when they pull stunts like this on us for absolutely no reason. When you know what they are doing is illegal it gets you madder then hell that they are getting away with it. They sure pushed the wrong button in me this time and I refused to just sit here and take it from them. Meanwhile it caused my blood pressure to rise suddenly. At least I can calm down now a bit until the next stunt they pull on me.

What we are dealing with is a bunch of mercenaries who don't give a darn what harm they cause us or how they harm us. In any other form of court this would be considered harassment but not at workers comp. Here it is just considered part of their game plan and unfortunate for us, the norm.

When are these carriers going to begin to be held accountable for the unnecessary duress they cause us that affects our health? We aren't allowed to collect for pain and suffering meanwhile they make sure they cause as much as this as possible for us because they know they won't be held accountable for their actions.

There are so many things wrong with the workers comp system and so many ways our rights are being violated. The problem is we don't have any rights once we are caught up within this horrific system and there is something very wrong with this and I'm sure it's unconstitutional. It's also discrimination against us because we were injured at work and because of this we are not treated in the same manner other citizens of this nation are if they are injured in another way.

For those of us who end up totally disabled they are in violation of the American Disabilities Act and aren't even held accountable for this either. The system has made sure they are protected and held above the law and it's all illegal. They turned the workers comp system into one that is pitted against injured workers and which favors the carriers. This is not what the system was meant to become but these carriers made sure it is how it turned out.

Our law makers aren't any better because they frown upon us and put laws into motion that protect these carriers from being held accountable for anything. They also make sure we receive less in services while they grant these carriers continuous premium rate hikes without them proving the necessity for the same. Our law makers are the ones who are responsible for the way the system is today due to the fact they receive large campaign contributions from these carriers. I would call this a conflict of interest but there isn't any such thing in our government any more.

Our government encourages our reps to take bribes and sell their votes to these carriers. Bribery use to be a crime but not in government. The same goes for their vested interests into these carriers. Our lawmakers have allowed the system to become a money making racket for these carriers and don't bat an eye about it. They are not going to investigate what goes on with these carriers within the workers comp system as long as politics is allowed to remain as part of the workers comp system.

When governors are allowed to appoint people to the Board Panels who have direct ties to these carriers they are political favors. Who is going to get any kind of a "fair" decision when these people are there solely to protect the carriers from being held accountable to pay for anything? Their main purpose is to throw out decisions made by judges who favor injured workers in their decisions instead of the carriers. How else can you explain that a panel of lay people are given more power then a judge? This especially when these lay people have ties to the carriers?

What we have today is a farce of a system called workers comp. If anything there isn't any compensation whatsoever for someone seriously injured at work. Just look at how many years they purposefully delay cases and medical treatment for people. Where else does this happen other then in the workers comp system? People are denied every medical treatment their doctors put in approval for. Everything is rubber stamped denied automatically no matter how serious the injury or how dire the treatment for it may be. Does anyone at workers comp investigate just what the percentage of denials is in comparison to the amount of approvals doctors submit? Of course not because it would be made known that when it comes to seriously injured workers it is more then likely over the 90% mark in denials.

I've never had anything approved by the carrier in the way of treatment. Their doctors lie and say nothing is wrong with me and workers comp accepts this until there is so much credible evidence and testimony proving differently they don't have any choice but to agree. Even when their own impartial expert testified I am totally disabled they are trying to change her decision and report to their liking in order to protect the carrier.

Only recently have they begun to order carriers to pay for treatment when they don't comply and answer our doctors requests for approval in New York. There are so many complaints going into workers comp about this they didn't have any choice but come up with this new thing to get injured workers medical attention. For years no one cared if anyone was receiving medical attention within the system. There isn't any such thing as exclusive remedy when you don't get any remedy at all.

All I know is I am sick and tired of being a target for physical and psychological torture at the hands of the carrier and their adjuster and I cannot wait until this is out of my life. This is the worse experience anyone could possibly have in association to working. When we are forced to give up our rights to sue our employees for our injuries and promised prompt and adequate medical attention and job replacement wages and get nothing or very little in return everyone has broken the contract we had to make with them when we first applied for workers compensation.

When there isn't any such thing as workers compensation then our rights should be restored and our rights to sue as well. I would love to sue the system itself for destroying my health and future by aiding the carrier in their endeavors to keep all medical attention from me for so many years. Someone should be held accountable for this because I did not get what I was promised especially prompt and adequate medical attention. I would hardly call $14 a day job replacement wages as they state either. When you are making that an hour and then end up getting it for a day in the way of replacement wages, that's a crock of abiding by what was promised. These carriers are trying to say workers comp isn't job replacement wages but that's not what is stated within the workers comp rules and regulations. They are trying to force their own interpretation of this upon everyone and no one at workers comp stands up and cries foul for us.

All I know is I will continue to blast this system for the rest of my life because I am so very aware of the illegalities going on within the system and the fact that no one at workers comp bothers fining these carriers for anything they do illegal. They bend the rules and regulations so much for them they are practically doing away with them to favor the carriers and protect them. Why is it mandatory for employers to have workers comp coverage when they are very aware if one of their employees gets seriously injured at work they are not going to be returning to work because they are not going to be able to get the medical attention they require in order to recover and return to work. They are being forced to pay extremely high premiums for this coverage and no one is getting anything in return. The system has turned into nothing but a money making scam for carriers and nothing is being done about it.

Anyone who gets seriously injured at their jobs doesn't have any idea what they are going to be in store for. They are going to think as I did, you get prompt and adequate medical attention and enough to tide you over until you recover and can return to work. They are in for a very rude awakening as I was. It's incredible this system is still called workers compensation because there isn't any such thing associated with it.
