Less than a month later.......... The writer has been told that the carrier is denying everything that her judge ordered. Just who is in charge here?
Remember:
She is - by law - not able to take this problem to civil or criminal court. She has no further legal redress. The carrier has trumped the only judge she has in the only court she is allowed to take this problem to. She has to start her legal battle all over again. And her health continues to suffer.
This is American Justice -?- or is it greed on the part of the carriers and the lawmakers who allow this situation to continue?

It's impossible for me to write to you as often as I used todue to my lower back deteriorating so badly. The pain I am in is unbearable and I can usually tolerate some pain, but not this. It's probably because there isn't any thing left between a few of the discs in my lower spine and all I have is bone on bone.
I like to keep everyone updated about what is going on with my case, which my attorney won for me twice already, when I have a few decent minutes.
Well, I was very suspicious at my last hearing because it went so "well" and the carrier's attorney didn't argue anything. The judge ordered I am to get 36 sessions of physical therapy, pain management, an EMB/NCV, Neuro Sx consult, and radio frequency ablation of my lower spine or surgery, which ever is best.
Well, I was afraid it went too "well" at that hearing and I was right. Today I got a letter in the mail and it seems the adjuster is now denying me all of the above including the physical therapy. I immediately called my attorney's office because I am supposed to begin the physical therapy next week. Here I was thinking I finally won my medical attention and they just took it away from me again before I could even begin it. What is the sense of judges making decisions at workers comp when these carriers are going to refuse to pay for anything they approve?
After just about six years of deteriorating from the lack of medical attention and them forcing me to become totally, permanently disabled because of this, now I still cannot get the medical attention I desperately need to relieve me of this wretched pain I suffer 24/7.
On top of this, the adjuster wrote there is a pending IME. Now, I won my case twice, how many times do I have to see their doctors? Even the workers comp doctor (impartial medical expert) said I am totally, permanently disabled and it's impossible for me to ever work again.
What my main fear about seeing one of their IME's is that their doctors always hurt me very badly. I told this to my attorney's legal assistant and am waiting to hear from him. I am terrified because my spine is in such pathetic condition one of their doctors will paralyze me permanently. I don't want their doctors touching me! My lower spine requires surgery at this point and if their doctor injures it further, I am going to be paralyzed for life and they just don't get this. My spine is in a very fragile conditon right now and cannot take any abuse from one of their doctors.
Now I have to wait until my attorney calls me about this and I am very on edge and scared about the prospect of being examined by another Insurance Medical Examiner (IME). There isn't any winning anything when it comes to workers comp and at their hearings. This adjuster is probably po'ed that she had to give me the money she tried to do me out of by falsifying the figures on the required form and they are still wrong on the new one I got. This is probably her way of getting even with me because she screwed up big time and I don't know if the carrier got fined for it before I was called into my hearing.
These adjusters don't give a d--- what the judges order or approve. They do what they d--- feel like doing and ignore all the judges rulings. Now what do I do, call my physical therapist back and tell them again that the physical therapy is denied again after waiting over four years to begin it again? This is insane and this adjuster is really jerking me and the judge around. How can she have such a disrespect for what the judge orders for me? She knows darn well I require medical attention in the worse possible way and she makes the choice to be in contempt of a judge's orders?
There are adjusters out there whose main interest is to make life hell for seriously injured workers and I have one of them. She doesn't give a darn if I become permanently paralyzed or not. Who gave these people all this power that they can rule over judges?
I cannot sit here any longer, my legs are going numb and I cannot move my right one at all. Just wanted to let everyone know what is going on with my case now. There is no winning medical treatment when it comes to these adjusters.
