Copyrights

Full copyrights to layout, design and all graphics will be assigned to Client for an additional 50% of invoice, if requested. If not specifically transferred in writing to the Client, Gibson Grafx retains all copyrights to any material, html or graphics, created by Gibson Grafx and price paid to Gibson Grafx by Client represents a licensing fee allowing Client to use the materials on the originally created website only. Graphics may not be used for other uses without permission.

Credits - Copyrights Transferred:

If copyrights have been transferred to the Client the following will be displayed at the bottom of every page we create:

Client agrees not to remove this line for a period of one year from site completion. Additionally, Client agrees that Gibson Grafx may retain a copy of the original site to be displayed in our portfolio. Our copy of the site will reflect the Clients ownership and will provide a link to the present Client site if so desired. All off site links will be disabled and the copy will be fixed so that it is not indexed by the search engines.

Privacy Policy

No information Gibson Grafx receives from Clients is ever divulged to anyone outside of the company. Complete confidentiality is assured. No information, graphics or photos received from a Client will ever be used by Gibson Grafx on another website or in any other fashion.

It is our policy that personal information, such as your name, postal and e-mail address or telephone number, is private and confidential, therefore Gibson Grafx does not release, sell, rent or otherwise make available any information received from the client.

Our computers are not set up to track, collect or distribute personal information about our visitors. Our server does track information about the visits to our website. We compile statistics that show the daily number of visitors to our site, the daily requests we receive for particular files on our website, what countries those requests come from, and what browsers were used. These statistics are used internally to better provide services to the public and may also be viewed by others but the statistics contain no personal information.

Warranties

The materials contained on this website may contain technical inaccuracies or typographical errors. Gibson Grafx has the right to make changes and updates to any information contained within this site without prior notice.

The materials are provided on an "as is" basis without warranties of any kind. No information given by Gibson Grafx, its affiliates, or their respective employees will create any warranty.

Reference to any products, services, processes, hypertext links to third parties or other information by trade name, trademark, manufacturer, supplier or otherwise does not imply its endorsement, sponsorship, or recommendation by Gibson Grafx.

Payment

If we do not receive payment for services by the due date, your account may be suspended. If your account is suspended, there will be an additional $50.00 fee for re-activation and any past due amounts must be paid before re-activation. If payment arrangements are not made the account is subject, at any time thereafter and without any prior notice to you of any kind, to being terminated and all data and information purged. Request for re-activation must be made before termination and purge. If your account is terminated, we reserve the right to refuse to re-activate the account. We are not responsible for any loses incurred or estimated by you due to lack of payment on your account. Termination of an account due to lack of payment does not relieve you of responsibility under this Agreement to pay all fees and charges you incurred up to the date of termination and any other amounts that, under the terms of this Agreement are owed to us or which we are entitled to recover.

Account suspension revokes the license entitling you to the use of the original materials created by Gibson Grafx.

There is a $25.00 charge for each returned checks.

You understand that the nature of the Internet allows any information sent on it to be viewed while it is in transit. YOU AGREE THAT WE WILL NOT BE LIABLE FOR ANY AMOUNTS BILLED TO YOUR CREDIT CARD BY A THIRD PARTY WHICH WERE NOT AUTHORIZED BY YOU.

Gibson Grafx will work very hard to deliver exactly the website you desire. Should you not be satisfied with the work that we produce we will refund, at your request, all monies previously paid. In this event you will relinquish all rights of usage to all of the graphics, scripts, html, or layouts created by Gibson Grafx. You agree not to use any of the materials created by us in any way. To do so could result in criminal prosecution for theft and/or copyright infringement. Request for refund must be made within thirty days from the date of project awarding. No refunds will be issued after thirty days have elapsed.

GIBSON GRAFX MAKES NO WARRANTY REGARDING THIS WEB SITE OR ANY CONTENT, SERVICES OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THIS WEB SITE.
