This Indenture Made the first day of September in the year of our Lord one thousand seven hundred and Eighty Nine between Samuel Fisher of the County of Lincoln & State of North Carolina of the one part and Jackson Harwell of the County & State aforesaid of the other part Witnesseth that the said Samuel Fisher for and in Consideration of the sum of Eighty Pounds lawfull Money of said State to him in hand paid the Receipt whereof is hereby acknowledged have ^sold bargained Aliened Enfeoffed & Confirmed & by these presents do Sell and Confirm unto the said Jackson Harwell his heirs & assigns forever One certain Tract or parcel of Land lying & Situated in the county of Lincoln on the West side of the Cataba river being a Tract or parcel of Land granted by his Excellency the Governor to the said Samuel Fisher bounded as followeth Beginning On a Post Oak in Barkleys # and runs with said line N.o 44 o . Wt. 220 poles to a Post Oak thence So 46 o Wt 110 poles to a White Oak thence So 44 o Et. 220 poles to a Red oak in Lockonany line thence with said line to the Beginning containing One hundred and Fifty Acres To have and To hold the said Tract or parcel of Land unto him the said Jackson Harwell his Executors Admrs & assigns forever Together with all Plantation Orchards Buildings improvements woods waters conveniences & appurtenances thereunto belonging or in any wise appertaining to possess and enjoy the same Clear and Unencumbered of all Debts, Dues, Demands, Executions, Mortgages, Dowers, rights of Dowers or any Cost or Damage whatsoever The quitrents to become due hereafter only excepted as an Absolute & indefeatable Estate of inheritance unto him the said Jackson Harwell his Heirs or assigns in fee simple forever And moreover I the said Samuel Fisher the aforesd promises unto the said Jackson Harwell his heirs or assigns as well against myself or any claiming under me as against all manner of persons whatsoever will Warrant and forever defend by these presents In Witness whereof the sd Samuel Fisher have hereunto Set my hand & affixed my Seal the year #above written.
