This Indenture made the fourth day of January in the year of our Lord one thousand and eight hundred and thirty four between Moses Abernathy of the County of Lincoln and State of North Carolina of the one part and Rufus Fisher of the County and State aforesaid of the other part Witnesseth that for and in consideration of the sum of one hundred and twenty five dollars in hand paid by the said Rufus Fisher to Moses Abernathy the receipt whereof is hereby acknowledged the said Moses Abernathy hath granted bargained and sold aliened and confirmed and by these presents doth give grant bargain and sell alien and confirm unto the said Rufus Fisher his heirs and assigns forever a parcel or tract of land lying and being in the County of Lincoln and State of North Carolina on the waters of the South fork of Mountain Creek and joining the said Fishers other tract and Alexander Sherrill’s lands – it being part of a tract of land conveyed to Moses Abernathy by Maxwell Wilson and bounded as follows Viz Begining on a small Hickory on Abraham Sherrill’s line said Fisher’s own corner and running thence with Sherrill’s line North 45 West 128 poles to a small Black Gum said Sherrill’s corner – Thence South 45 West 127 poles to a Chesnut on Reuben Fisher's line Thence with his and Fisher’s own line South 86 East 179 poles to the beginning containing by estimation fifty acres be the same more or less – to have and to hold the aforesaid tract or parcel of land together with all woods waters mines minerals hereditaments appurtenances belonging to the said land or in any wise appertaining thereto to hold to the said Rufus Fisher his heirs and assigns forever from the said Moses Abernathy his heirs and assigns and from all and every person or persons claiming or to claim hereafter by virtue of said Moses Abernathy The said Moses Abernathy covenants and agrees for himself his heirs and assigns to and with the said Rufus Fisher that at any time hereafter he the said Moses Abernathy his heirs or assigns will sign any just claim or deed or other instrument of writing for the better or more just claiming the aforementioned land and premises conveyed his or their full right and authority that he the said Moses Abernathy hath by virtue of any deed or right whatsoever the said tract or parcel of land to him the said Rufus Fisher his heirs or assigns forever In Witness whereof the said Moses Abernathy hath here unto set his hand and affixed his seal the day and year first above written
