This Indenture made the 23^rd day of June AD 1837. Between Richard Fisher of the county of Lincoln in the state of North Carolina of the one part and Rufus Fisher of the county of Lincoln and state of North Carolina of the other part Witnesseth that the said Richard Fisher for and in consideration of the sum of Two Hundred and fifty dollars to him in hand paid by the said Rufus Fisher the receipt whereof is hereby acknowledged hath given granted bargained and sold aliened & Confirmed unto the said Rufus Fisher his heirs and assigns forever a tract or parcel of land situate lying and being in the county of Lincoln on the waters of the South Fork of Mountain creek and Joining lands of David Linebarger Moses Abernathy & others It being part of a tract of land conveyed by John Allen to Mason Harwell and from him to Thomas Fisher Dec^d and bounded as follows Begining at a post oak a new line made by the said Harwell running then North 76 E. 35 poles to a Black oak David Linebargers corner then with his line     100 poles to a Hickory another of Linebargers corners then North 20 E. 40 poles to a small Hickory on Moses Abernathys line then with the old line of the old survey North 86 West 144 poles to a small Gum on said old line a new corner thence a new line South Eighty poles to the Begining containing by Estimation 50 acres be the same more or less To Have and to hold the aforesaid tract or parcel of land together with all woods ways waters and water courses and all and every the appurtenances thereunto belonging to the said Rufus Fisher his heirs and assigns forever from said Richard Fisher his heirs and assigns and from all other claims whatsoever by Virtue of said Richard Fisher The said Richard Fisher Covenants and agrees for himself and his heirs or assigns that he or they will sign any Just claim or deed or other Instrument of writing for the better securing or conveying said land and of their right to the same to him the said Rufus Fisher his heirs and assigns forever In Witness whereof the said Richard Fisher hath hereunto set his hand & affixed his seal the day & year first above written
