8	Q	Would that appear to be a diagram of your 
9	neighborhood and the houses in the area and their various

14 	that. Did he do a pretty good job? 
15	A	I think he did very well. 
16	Q	Allen, tell me what you were up to, what your 
17	activities were the evening of June the 11th of 1990. 
18	A	Could you repeat that? 
19	Q	Yeah. What were you up to, what were you doing 
20 	during the evening hours of June the 11th, 1990? 
21	A	Well, our Scout troop was going to be going on a 
22 	canoe trip; and so we met at my church, discussed what to 
23 	bring, you know, just camping materials that we would need 
24 	while we were on that trip. 
25 	And when we got home, I was at home for a little

1	while; and about nine o'clock, I decided I'd better have 
2 	Daniel Eastman come over because he didn't make it to the 
3	 meeting. 
4 	He was going to be going on the trip, you know. 
5	I figured I'd show him what we needed to bring to this 
6 	camp out. 
7	Q	How did you get in touch with Allen -- I mean, excuse 
8	me -- Daniel? 
9	A	By phone. 
10	Q	And when did you call him? 
11	A	Oh, probably about nine o'clock. 
12	Q	Where were your brother and father at that time? 
13	A	I assume they were at the store. I'm thinking that's 
14	where they were at, but they could have been in the house 
15 	at that time. I just -- 
16 	Q 	Okay. 
17 	A 	I don't remember. 
18 	Q 	Did you see your brother, Jeff, after your dad and 
19 	Jeff had left earlier in the evening? 
20 	A 	Did I see them earlier that evening? 
21 	Q 	No. Did you see them -- did they leave earlier in 
22 	the evening? 
23 	A 	I didn't see them leave. I didn't see them leave. 
24 	just didn't -- I don't remember when they left or anything

3 	A	I can't remember. 
4	Q	Okay. But you called Daniel.

7	A	He came probably after about 10 or 15 minutes after I 
8	called. 
9	Q	So what time would you say that he got to your home? 
10	A	Around 9:10, 9:15, somewhere. 
11	Q	What did you all do then? 
12	A	I then discussed with him what he needed to bring, 
13	you know, to the camping trip. 
14	 Q	Where did the two of you discuss that?
15	A	In the kitchen. 
16	Q	How long was Daniel there at your home? 
17	A	About 15 minutes. 
18	Q	So when would you say that he left? 
19	A	About 9:30. 
20	Q	What did you do when he left? 
21	A	I followed him out onto the driveway, you know, 
22	because I remembered that I needed to get a mess kit. 
23	So I just followed him out there onto the 
24	driveway and watched him ride his bike off. 
25	And then I came back into the garage and got my

102 1 mess kit. 2 Q How long were you out in the garage area? 3 A Probably about 10 minutes, maybe 15 minutes. I don't 4 know. 5 Q So what time would you have been out there? 6 A Let's see. I guess that would have made it about 7 9:40 was probably when I came back in. 8 Q So from 9:30 to around 9:40, you were out in the 9 garage? 10 A Yeah. 11 Q Were either one of your garage doors open that 12 evening? 13 A The -- okay. If you're driving into my driveway, 14 it's the left one. 15 Q It would be the one furthest to the east? 16 A Yes. 17 Q And that was open that night? 18 A Yes. 19 Q And what were you doing in the garage? 20 A Looking for a mess kit. 21 Q Did you find it? 22 A Yes, I did. 23 Q Do you have any dogs? 24 A I have two dogs. 25 Q Where do you keep them? 103 1 A They're generally outdoors in the backyard. 2 Q Where were they that evening? Do you know? 3 A They were in the backyard. 4 Q Did you notice anything strange or unusual about 5 them? 6 A They, they barked; but that was about the time that 7 the emergency vehicles came to the scene, the Allens' 8 home. 9 Q Prior to that, did they appear to be upset by 10 anything? 11 A Not terribly upset. I guess our neighbor had gone 12 out to his yard, you know. It was nothing to worry about. 13 Q What neighbor 14 A Larsens. 15 Q And where do they live in relation to you? 16 A Just west of us. 17 Q And does something separate the two yards? 18 A Well, there's a garden and then his yard and then -- 19 I mean, it's his garden. 20 So, I mean, they hit right together, but it's a 21 garden from between his yard and my yard. 22 Q Is there anything to prevent your dogs from going 23 into his yard? 24 A Fences. 25 Q Now, during the time that you were in the garage DISTRICT COURT OF OKLAHOMA OFFICIAL TRANSCRIPT

104 1 area, did you notice your dogs upset about anything? 2 A They were not upset, no. 3 Q Other than your dogs, are there any other dogs in the 4 neighborhood? 5 A Several. 6 Q Where generally located are they? 7 A Let's see. There's two behind -- we got back -- our 8 backyard goes up against Cowmans' backyard; and they've 9 got -- they had two dogs at the time. 10 Then the Larsens have a dog, and then our 11 neighbors across the street have a dog. 12 Q Now, who is that, that lives across the street? 13 A Vigesaas. 14 Q During the time period that you were out in the 15 garage, did you notice any of these dogs being upset about 16 anything? 17 A No, I didn't. 18 Q And when did -- you say you did notice, though, your 19 dogs upset at some point. 20 A Yes. 21 Q And when was that? 22 MR. That's right here? 11 A Yeah. 12 Q Now, the Cowmans have some dogs, do they not? 13 A Yes, they do. 14 Q Did you ever hear their dogs bark that night? 15 A I don't recall that they were barking. 16 Q I'm sorry? 17 A I don't recall. I was just concerned about my dogs. 18 You're kind of soft-spoken is the reason 19 A Okay. 20 -- I'm having you repeat things.
