4	A	Right here.

15	all have driveways that kind of meet; is that correct?

17	Q	And it's separated by a road there?

19	Q	Can you tell me what your activities were the night 
20	of June the 11th, 1990? 
21	A	I was over visiting with my neighbor while my husband 
22	was spraying our yard. Then we left to go to the church 
23	to do some odds and ends over there. 
24	Q	Who were you visiting with? 
25	A	I was visiting with Kay Herring.

1	Q	And where does she live in relation to you? 
2	A	Right here, just right across the street. 
3	Q	What time would you have been visiting with Miss 
4	Herring? 
5	A	Well, it was before 8:30. 
6	Q	Why is 8:30 significant to you? 
7	A	Because my husband wanted me to go with him at the 
8	church to, you know, to do some things over there. 
9	And I remember looking at my clock and saying 
10	it's 8:30, it's too late. 
11	Q	Apparently, he didn't agree with that.
12	A	Right. 
13	Q	So did you go to the church? 
14	A	Yes. 
15	Q	How long did you stay there? 
16	A	We were there just -- I don't know -- almost an hour 
17	maybe because I do remember when we came home that I had 
18	left the car out of the garage and thinking someone could 
19	have got in my house easy because the garage door opener 
20	was in the car and the car was unlocked.
21		And I said to my husband what, you know, what a 
22	dingbat I was. 
23		He says no problem, and he moved it into the 
24	garage. And he noticed on the digital clock that it was 
25	8:38.

1	Q	It was 8:38 when you arrived back home?
2	A	When he pulled the car in the garage, so it had to be 
3	right around that. 
4	Q	Okay. I thought you told me that you went to the 
5	church at about 8:30. 
6	A	Oh, excuse me - 9:38. 
7	Q	Where did you go after -- or strike that. When you 
8	finished your business there at the church, did you go 
9	anywhere else? 
10	A	We stopped at the Phillips station at Limestone 
11	corner to gas up the truck. 
12	Q	And where did you go from there? 
13	A	Home. 
14	Q	And that's when you'd discovered what you'd done 
15	about your car. 
16	A	That's right. 
17	Q	Now, when you got home at that time, did you notice 
18 	anything about the Allen home? 
19	A	I noticed that there was no lights on.
20	Q	Anything else? 
21	A	Nothing. 
22	Q	Did you notice if there were any cars in or about the 
23	home? 
24	A	The cars were there. 
25	Q	How many cars?

1	A	I'm 99 percent sure both cars was there, but I'm 100 
2	percent sure that Sandy's car was there. 
3	Q	And what car would that be 
4	A	The little green one. 
5	Q	Notice anything other than those two things about the 
6	Allen home? 
7	A	No. 
8	Q	What did you -- did you have any thoughts about the 
9	lights not being on? 
10	A	Well, I thought it was kind of strange because they 
11	have three children. 
12		I didn't think that hour was unusual for - I 
13	thought it was unusual at that hour for all the lights to 
14	be out. 
15	Q	After you got home, what did you do? 
16	A	I went in the house, and the only other thing I 
17	remember is a telephone call from my sister-in-law. 
18	And my husband went out to work in the yard to 
19	prepare it for vacation. 
20	Q	Now, when you got into your home that night after 
21	your concern about having left the car out, why were you 
22	concerned about leaving the car out? 
23	A	Because the garage door opener is in our car, and 
24	that's the only way my house was locked.
25		I mean, you could open the door to the garage

1	and then get into my house if you wanted to. 
2	Q	I assume then that your car was not locked? 
3	A	It was not locked. 
4	Q	What kind of car was this? 
5	A	Honda. 
6	Q	Now, when you went in the house, did you notice 
7	anything amiss? 
8	A	No. 
9	Q	Appeared normal? 
10	A	Normal. 
11	Q	What time did you talk to your -- sister-in-law? 
12	A	Yes. 
13	Q	What time was that? 
14	A	I don't know exactly what time she called, but it was 
15	probably just after 10:00. The time I do
remember is 10 
16	after 10:00 when the doorbell rang. 
17	Q	What happened then? 
18	A	My husband when -- well, first of all, that's when I 
19	looked at the clock and wondered who was at our house at 
20	that time. 
21		My husband went to answer the door, and I 
22 	continued talking to her for a few minutes till my 
23	curiosity was kind of led away because I could hear soft 
24	voices. And I was wondering what is going on. 
25	Q	And did you determine what was going on?

1	A	Well, I finally hung up the phone and went to see; 
2	and Mike Vaclaw and my husband was coming down the stairs. 
3		And I said what's the matter. He said it's not 
4	good. My husband motioned for me to be quiet and he'd 
5	talk to me later. 
6	Q	Did you determine why it was your husband and Mr. 
7	Vaclaw were going through. your house? 
8	A	Well, at the time, my first thought was maybe Mike 
9	saw smoke at my house because he, living next door, I 
10 	thought maybe he had seen something and just wanted to 
11	check the house. Later, I found out that was not it. 
12	Q	What were they doing? 
13	A	They were looking in the -- they were looking through 
14	my house because, as I said, we hadn't been home very 
15	long. 
16	And Mike come to the door and asked if we had 
17	searched our house, and my husband said for what. And he 
18	said there had been a murder in the neighborhood. 
19	Q	So you then searched? 
20	A	We then searched. 
21	Q	Anything amiss in your home? 
22	A	No. 
23	Q	Did you have occasion to look around outside? 
24	A	Yes. 
25	Q	And why did you do that?

1	A	Well, I'd made the comment to my husband that our 
2	potatoes were kind of high -- the foliage was high. 
3	I said, you know, someone could be laying out in 
4	there. And then for our own protection, we wanted to look 
5	it over. 
6	Q	Did you check that? 
7	A	Yes. 
8	Q	Any problem? 
9	A	No. 
10	Q	Anything appear to have been disturbed in your 
11	backyard? 
12	A	No. 
13	Q	Do you have a dog? 
14	A	Yes. 
15	Q	Where does that dog stay? 
16	A	He has a doghouse right next to the shed, which is 
17	next to the fence like about -- well, like about right 
18	here. 
19	Q	And that's in your backyard? 
20	A	Right. Next to my driveway next to the fence.

8	Sandy's car was there at 9:38 p.m. 
9	A	Yes. 
10	Q	And how did you address Mrs. Allen? Did you 
11	generally call her Sandy? 
12	A	Right. 
13	Q	And I take it there must have been other people that 
14	called her Sandy also. 
15	A	I assume. That's all I ever knew her by. 
16	Q	And how long had you known her? 
17	A	Since the time that they lived there.  I'm not even 
18	sure. Maybe -- I don't even know if it was two years. 
19	Q	By the same token, at 9:38 p.m., you can't be certain 
20	that Steve's car was there, can you, ma'am? 
21	A	Not 100 percent. 
22	Q	All right. 
23	A	But fairly sure. 
24	Q	Now, the -- have you ever been in the Allens' home -- 
25	Steve and Sandy?

1	A	Just in the entry and just in the garage. 
2	Q	The kitchen and the dining room, there's a couple of 
3	rooms between them and the garage -- one room between 
4	them. Do you recall that? 
5	A	Could you repeat that again? 
6	Q	That wasn't a very good question. There's a room 
7	between the kitchen and the outside, the outside wall. Do 
8	you know that from being in the Allen home? 
9	A	No. 
10	Q	My point is, ma'am, if there was a light on in the 
11	kitchen, your home sits directly south of the Allen home. 
12	A	Right. 
13	Q	And if there were a room here and then the kitchen 
14	and dining area, it might possibly be there could be a 
15	light on in the kitchen dining area and you not see it 
16	because there's not a window on that south side of the 
17	house of the Allen home, is there? 
18	A	There's a window right here; and on my house, there's 
19	a window right here. 
20	Q	There's a door right here, isn't there? 
21	A	Right. 
22	Q	And there's a window in the door? 
23	A	Right. And there's a window next to the door. 
24	Q	But that -- does that door go into the garage, 
25	doesn't it? Or do you know?

1	A	From the garage, it goes into the utility room. 
2		Their house is actually the same plan as my house, except 
3	for the family room -- 
4	My family room goes the length of my house. 
5		Their family room is turned and goes out to the back. 
6	Now, the door could have been -- Well, I don't 
7	know. I just did not see. any lights. 
8	Q	You said that.-- you started to say that what? 
9	A	I was going to say my house has a sliding door from 
10	the kitchen to the utility. I don't know what theirs has. 
11	But you can always see light because the backs 
12	are always open, you know, the -- like they have a huge 
13	kitchen window or dining room window actually is what it 
14	would be. 
15	Q	Let me make sure -- 
16	A	It was just dark. 
17	Q	Let me make sure I understand that. The only window 
18	on this south side of the Allen home, other than the 
19	garage doors -- and the garage doors have some glass in 
20	them, don't they? 
21	A	Right. 
22	Q	And they open directly to the garage. 
23	A	Right. 
24	Q	But there's a little door just off to the garage 
25	door.

9	Q	Okay. Is that window to the east of the door, I'm

12	Q	Were you at home from the period of time of 9:15 to,

14	A	No. I wasn't there at 9:15. 
15	Q	This is pretty obvious, but I'll ask it anyway. Of 
16	course, obviously, if you weren't there, you don't know 
17	what your dog was doing between 9:15 and 9:38. got home.
