Lacson on Kuratong Baleleng case: We won, they lost

"Any way they look at it, they lost"

This was how opposition Senator Panfilo Lacson described government side after the recent resolution passed by the Supreme Court on the question of whether or not to allow the re-opening of the Kuratong Baleleng rub-out case.

Lacson told DzMM radio station that his camp kept citing the lapse of the two-year prescriptive period on the provisional dismissal filed by the Quezon City regional trial court as against the 20-year limit advanced by the Department of Justice (DOJ) at the hearing of the Court of Appeals.

However, Lacson said his case "doesn't fit the circumstances" as the 20-year limit is attributed to cases that haven't been filed yet. Thus, he noted, the SC's decision is favorable to them as the highest court in the land had supported their contention.

The oppositionist pointed out that once the QC RTC tells them that every requirement was fulfilled, the decision becomes permanent and the case can't be re-filed again.

"It's all in the records," Lacson said in reaction to the SC's question of whether all the complainants had been notified of the dismissal. He noted the provisional dismissal had been presented to both the public and private counsels and thus, all the complainants had been duly notified of the dismissals as required by law.
