Notes on City Ordinance 241
An Ordinance on Rabies Control and Eradication
in Zamboanga City

1. Title and Purpose

This ordinance is otherwise known as “The Rabies Control and Eradication Ordinance of the City of Zamboanga”. This Ordinance wad promulgated for the effective control and eradication of Rabies in Zamboanga City.

2. Rabies Control and Eradication Coordinating Council

The Zamboanga City Rabies Control and Eradication Coordinating Council (ZCRCECC) are created to coordinate in the implementation of the ordinance and other rabies control-related activities.

The Barangay Rabies Committtee (BARC) is created to coordinate with the ZCRCECC in carrying out effectively the implementation of the Rabies Control and Eradication Program in the barangay level.

3. The Zamboanga City Rabies Control Program

Vaccination against rabies of every healthy dog, cat and monkey, reaching three (3) months of age and older shall be mandatory. All vaccinated dogs, cats and monkeys and all other susceptible animals shall receive a booster dose every year thereafter. It shall be the duty of each licensed veterinarian, when vaccinating any dog, cat, monkey and other susceptible animals to complete a certificate of rabies vaccination for each animal vaccinated. The owner will be provided with the copy of the vaccination certificate. The cost of rabies vaccination shall be borne by the owner of dog, cat, monkey and other susceptible animals, unless there are mass animal rabies vaccinations subsidized by the city government.

4. Annual Animal Registration or Licensing

Registration of dogs, cats and monkeys shall be mandatory and shall be made every year thereafter. A registration fee of One Hundred Pesos (Php100.00) shall be charged for each dog, cat, and monkey registered. Thereafter, the fee of seventy five pesos (Php75.00) shall be collected every year to be paid to the Office of the City Treasurer. Their owner shall register every vaccinated dog, cat and monkey with their respective Barangay Treasurer. Their owners shall keep all registered dog, cat and monkey with proper restraint when moving from one place to another or shall be confined within the premises of the animal owners. The owners shall surrender unregistered dog, cat and monkey over the age of three (3) months. Any dog, cat and monkey found roaming in public places, such as thoroughfares, plazas, schools, markets, churches, hospitals, and other government premises having no restraint and/or leash and unaccompanied by their rightful owners shall be seized and impounded.

5. Reporting of Biting Incidents

The owner of an animal that has bitten any person or the person who has been bitten shall immediately report to the veterinary health worker, public health care worker or to a police officer or to the Barangay Rabies Committee. A veterinary health worker, public health care worker, police officer of the Barangay Rabies Committee receiving such information shall immediately report the incident to the City Rabies Control and Eradication Coordinating Council.

6. Post Exposure Management in Animals

Any domestic animal that has bitten or scratched by a stray dog or cat which is not available for testing or observation shall be regarded as having been exposed to a rabid animal. When bitten by a rabid animal, unvaccinated dogs and cats shall be destroyed without delay provided the animals have not bitten any human.

7. Management of Animals that Bite Human

A dog, cat or monkey that has bitten a person shall be confined at the City Pound and observed for fourteen (14) days and evaluated by a licensed veterinarian for signs of rabies during the confinement and before the release. Any illnesses in the animal shall be reported immediately to the attending physician. If signs suggestive of rabies developed, the animal shall be humanely killed and the head carefully removed for laboratory examination and the body disposed of properly. Any dog, cat, or monkey that has bitten a person and is unavailable for observation and/or testing because it has escaped or died shall be regarded as a rabies suspect.

8. Liability of Owners of Biting Animals

Whenever a stray animal bites any person, the owner thereof shall be liable for all the treatment and dog examination related expenses incurred by the bite victim. Unless the bite was inflicted by a restrained animal, or had occurred within the owners enclosed premises with the animals duly registered, in which case, arrangements shall be made between the owner and the bite victim.

9. Penalties

Any animal owner who fails to abide by any provisions of this Ordinance shall be subjected to a fine of not less that five hundred pesos (Php500.00), nor more than two thousand five hundred pesos (Php2,500.00) or imprisonment of not less that one (1) month and not more than six (6) months, or both shall fine and imprisonment to be imposed at the discretion of the competent court.
