This Indenture made between John S. West high Sheriff of the County aforesaid of the one part and Thomas Auston of the County and Stae aforesaid of the other part Witnefseth whereas there ifsued forth from the County Court of Pleas and quarter Sefsions a Writ of fieri facias bearing test the Ninth day of December in the Year of our Lord One thousand Seven hundred & Ninety seven and returnable to the said Court on the second Monday in March next Bearing at the suit of Mary Auston against the Goods & Chattels Lands & Tenements of Daniel Bratcher for the Sum of Sixty one pounds fifteen Shillings 1 penny and further for the Sum of five pounds ? Shillings & 8 Cents directed to the Sheriff of said County & whereas the said Daniel Bratcher was pofsefsed of a certain Tract or parcel of Land in the County aforesaid containing Three hundred Acres lying and being on the South Side of Neuse And on the head of Coalmans Creek.  Joining James Davis's & Lydia Guards lines Beginning at a lightwood Stump Lydia Guards second Corner in James Davis's line, thence ruing along Said Davis's line No 26 W 220 poles to a pine thence So 85 W 200 poles to Lydia Guard's Corner in the Pocoson, then along her line No 85 E 220 poles to the first Station and whereas the said Sheriff in pursuance and Execution of his Office and by the said Writ of Fieri facias and also by virtue of and Act of the General Afsembly of the State aforesaid did take into his pofsefsion the tract of Land as before particularly described in order to raise the said Debt or Costs, and exposed the same to public Vendue, having first advertised the same agreeable to Law and at that Sale sold that said Land to the said Thomas Auston for the Sum of Thirty Pounds Current Money being the highest or greatest Sum bid or offered for the said Tract of Land at the Said Sale.
Now this Indenture Witnefseth that the said John I. West high Sheriff of Craven County in pursuance of his Office & by Virtue of the said Act of Afsembly of the said State and also for & in Consideration of the Sum of Thirty Pounds to him in hand paid by the said Thomas Auston at & before the sealing of these presents, the Receipt whereof he doth acknowledge, hath granted, bargained, sold conveyed & confirmed and by these presents doth grant, bargain, sell, convey & Confirm unto the said Thomas Ausont his Heirs & Afsigns all that Tract or parcel of Land here in particularly bounded as described, Containing Three hundred Acres with the appurtenances and all the Right, priviledges & improvements to the same belonging or in any wise belonging To have and to hold the said tract of Land & premifses hereby granted with the appurtenances to the said Tomas Auston his Heirs and Afsigns to the onl purpose benefits & behoof of the said Thomas Auston his Heirs & Afsigns forever in as full & ample manner as the said John I West high Sheriff of Said County of Craven by Virtue of his Office and the Writ of Fieri facias & Act of Afsembly is Enabled & impowered to Convey the same, and the said John S West doth hereby Covenant and promise to and with the said Thomas Auston his heirs & Afsigns shall & may from time to time and at all times hereafter peaceably And quietly, have, hold, enjoy pofsefs & enjoy the Land & premifses hereby granted with the appurtenances whatever had made done or Commited by him the said John S. West or by any other person or persons by his means  or procurement.  In Witnefs whereof the said John S. West hath hereunto set his hand & affixed his Seal this twelfth day of March in the Year of our Lord Eighteen Hundred
