Know all men by these presents that I Willis
Bratcher of the County of Leon in the State of Florida being justly
indented to Abijah Hall by promissory note bearing date December first
eighteen hundred fifty seven for the sum of two hundred and fifty
dollars and signed Willis Bratcher and payable one day after date having
and with purpose of securing the payment of said promissory note grant,
bargain, sold, mortgaged and convey and by these presents do grant,
bargain, sell mortgage and convey unto the said Abijah Hall all my
right, title, claim and interest to one sorrel mare aged about ten years
and one sorrel mare colt aged about fourteen months and sixteen head of
stock cattle and fifty head of stock hogs marked with a split in one ear
and under sloap in the other ear, to have and to hold the same forever
provided always and the condition of these presents is such that if I
the said William Bratcher my agent or attorney or any other person for
me shall pay to the said Abijah Hall his heirs, administrators and
assigns the debt aforesaid on or befre the first day of January Eighteen
hundred and fifty eight then this instrument shall be void and of no
effect and the said Willis Bratcher agrees to pay the same accordingly
if default be made in such payment the said Abijah Hall his heirs, administrators
and assigns is hereby authorized to sell at public auction after like
notice as is by law required for sheriff sales the properly hereinbefore
mentioned or so much thereof as will be necessary to satisfy said
promissory notes and expences and to return the same out of the proceeds
out of such sale the overplus (if any) to be returned me and the said
Abijah Hall or his assigns is hereby authorized to take possession of
said property on or before the tenth day of January Eighteen hundred and
fifty eight unless the said debt shall be sooner paid.

Be it remembered that on the eighth day of
February A. D. 1858 the foregoing instrument of writing was presented to
the Clerk of the Circuit Court for record and the same being properly
proven by the acknowledgement of Robert H. Alexander on of the
subscribing witnesses who upon his oath says that Willis Bratcher did
sign, seal and acknowledge the execution of the foregoing instrument by
making his mark upon which I have recorded the same in Book A page 520.
