Whereas it appears from satisfactory proof adduced to the Court, that the plaintiff on the
27th day of November 1807 recovered a Judgment before Benjamin McNutt Esquire a Justice of
the Peace for this County against William Bratcher Senr. the defendant in this cause for
the sum of Twenty dollars and sixty cents Debt and one dollars forty three and three
fourths cents costs, for which Debt and costs it also appears, a writ of Fieri Facias was
ifsued by the said Justice on the said 27th day of November 1807 and put into the hands of
James McPheran a constable in and for our said County of Greene to do execution thereon,
And whereas it appears from the return of the said Constable, that he delivered the said
execution on a horse, and neglected to make sale thereof, as to render the monies due on
said execution, Wherefore on motion of the said John Rufsell by George Duffield
esquire his Attorney, It is considered by the Court that he recover against the said
James McPheran, and James Lucky and John McCurry his securities, the said debt of Twenty
dollars and Sixty cents together with the sum of Twenty cents interest due and accrued
thereon since the rendition of said Judgment, and also his costs in that behalf expended
and the defendants in mercy. |
