BENJAMIN PEYTON TO RICHARD HOLLAND 280 ACRES

 

KNOW ALL MEN by these present that  I Benjamin Peyton of the County of Beaufort in the province of North Carolina Public Treasurer for & in consideration of the sum of four hundred thirty five pounds and five shillings curr. Bill money of No Carolina to me in hand paid before the ensealing hereof the rec'd where of I do hereby acknowledge and myself fully satisfied contented & paid for the use of the public, hath granted bargained sold conveyed & confirmed in the behalf of the public by these presents do grant bargain sell convey & confirm unto Richard Holland of the county & province afs'd Taylor (sic), a tract or parcel of land lying and being situated in the said county, north side of Pamptico River & lying on the north side of Tranters Creek containing two hundred & eighty acres, be the same more or lefs, which said land was mortgaged to Simon Alderson then treasurer for the use of the public (pursuant to an act pafsed at a General Afsembly held at Edenton & begin November the sixth in the year of our Lord one thousand seven hundred and twenty seven) by James Shingleton of failure of payment afsd mortgage was sold at public vendue at the court house in Bath Town in said county of Beaufort pursuant to the afs'd act by me the s'd Benjamin Payton, Treasurer.

To have and to hold the said tract or parcel of land & all & singular the primises with appurtances unto the said Richard Holland his heirs & afsigns to the only use benefit & behoof to the said Richard Holland his heirs & afsigns forever. And I the said Benjamin Peyton, Treasurer do covenant promise & grant to & with said Richard Holland his heirs & afsigns that I have good right full power & lawful authority by virtue of the above said act to sell & convey the said tract or parcel of land in behalf & for the use of the public as afores'd & that the said Richard Holland his heirs & afsigns shall & may forever hereafter peacefully & quietly have hold occupy and enjoy the said premises furthermore the said Benjamin Payton Treasurer do in behalf of the public covenant & engage (sic) the above premises to him the said Richard Holland his heirs & afsigns against the lawful claims or demands of any person whatsoever for ever hereafter to warrant secure & defend. In Witnefs whereof I have hereunto set my hand and seal this ninth day of December in the year of our Lord one thousand seven hundred & forty one.

Beaufort County 1741 Benjamin Peyton, Esq as County Treasurer personally came into court & acknowledged his deed of sale for the two hundred & eight acres of land to Richard Holland. Ordered to be recorded
