I must also thank the people who have generously shared information on family compositions. Benjamin Hudgens worked as a farm hand for Luther Fish. Luther Fish was so well loved by my mother, every Memorial Day she still has flowers placed by his headstone in the Richmond Cemetery. Luther Fish supported the Hudgens family with food and financial help during the depression. It has been told that he saved the family from starvation. During the period 1910-1930 the Hudgens and Wilcox families were devastated by tuberculuous.

A family story has it that both Benjamin and Sallie Wilcox Hudgens attended Berea College and left the school when it was integrated.

My Mom told me that when a boy came to the house courting and he didn't have a hat on my Grandfather would call him a "Nit Shitter." :-)

A Wallace Hudgins is found in Madison County during this time period.  He married a Mary L. Coffey and had issue Iva G. Hudgins, b. 20 July 1903 at Madison Co.   It is unknown if he is related to the Benjamin/Thomas Hudgens family.

Sallie Marchial Wilcox is the daughter of John William "Willie" Wilcox and Elizabeth D. "Lizzie" Bolton. The following is a letter she wrote to her sister Maggie Overley. Maggie Overley was living in Hamilton, Ohio.

Well Mag I will try and write you a short letter. I am not as well as I have been. I am back in the bed all the time cant set up eny. I was doing very well awhile but dont know how long I can live as sometime I cant tell. I live on eggs and milk and fruit. Can not live long [?]. Dr comes to see ever ten day. He call ever day about me. Mag Jim was up here to day. The Dr said keep me still I mite get well. Rena is working ever day - Edith is sowing this week making the baby some close. Bill is still at Mr Hisle yet He said Sunday he wanted Bill as long as he live but Mag there is Edith and Annie left but as long as Rena lives they never want for nothing. I cant get well you [?] I will go when Spring comes like mother did. Mag you said Me and fell out I love Sam as if he was my for he was so good to papa We never had a word. We look for you Dec 1.     From the Richmond Daily Register, 13 August 1919: Headline: Paint Lick Girl Burns Self To Death, "Miss Lou Hudgens, the 18-year-old daughter of Ben Hudgens, a well Known farmer near Paint Lick, committed suicide in a fearful and novel manner Wednesday morning.  According to reports from there, the girl went into her yard, saturated her clothing with coal oil and applied a match.  Her injuries were so fearful that she died soon afterward." Her death certificate shows her death as "Accidental."

    As a small child, my mother and I would take vacations to my Uncle's and Aunt's farm. With them, we traveled to Niagara Falls, Ontario, Canada, Stone Bridge, Kentucky, and Disney World in Florida. Uncle Johnson was a good Christian man, devoted husband and family man. He will be greatly missed.

4. Thomas Wythe Hudgens, b. 1 November 1838 at Buckingham County, Virginia, d. 1 November 1908 at Paint Lick, Madison County, Kentucky, buried at the City of Richmond Cemetery, Madison County, Kentucky

Thomas W. Hudgens is listed on the Roster for Black Eagle Rifles, Company E of the 18th Regiment (Garnett), Hunton's Brigade, Virginia Infantry, mustered April 25, 1861. He enlisted at Walton's Mill in Cumberland County, Virginia on 23 April 1861. He enlisted for one year but would remain in the Virginia army for the remainder of the war. On the 6th of May, 1861 Thomas appears on a return of Artisans in the 2nd Battalion, Virginia Volunteers at Hermitage Fair Gounds Instructional Camp, Richmond, Virginia. He was listed as sick at Manassas Junction. Many of the Confederate troops came down with malaria before and after the battle. His company also fought at the siege of Yorktown, Manassas, Williamsburg, Seven Pines, Gaines Mill, and Fraysers Farm, Gettysburg and Seige of Petersburg. Fraysers Farm is only a short distance from where Thomas W. Hudgens grew up in Cumberland County, Virginia. His middle name was identified in a Civil War letter written by Richard Byrant who notes in the letter that Wythe Hudgens sick. This information corresponds to Thomas Hudgens service record reporting him sick at Manassas.

The 18th Virginia Regiment participated in the famous "Pickett's Charge" at Gettysburg.   Three other Hudgens/gins names appear on the muster: Elijah G. (substituted, 1861, d.bef. 1909), Jesse Frank Hudgens ( Jesse Frank Hudgens was wounded at the Battle of Sharpsburg, Maryland) and Clay Hudgins, private.   Carter H. Harrison is listed as Captain for the Company.   Elijah G., Jesse Frank, and Thomas W. are listed as Sergeants on the roster. With only one member escaping injury, Company E had the highest casualty rate of any Confederate unit during the war.

Special Order Number 223, paragraph 19.
"XIX. Private T.W. Hudgins, of Company E, Eighteenth Regiment, Virginia Volunteers, being unfit for field service, is detailed for duty in the Quartermaster's Department, and will report to Captain W.S. Wood, assistant quartermaster, in this city, Sept. 24, 1862. Richmond."

He was detailed to the 2nd Mastin(?) department on October 1, 1862. He worked as a wheel wright. This would support other sources identifying Thomas as coming from Cumberland County, Virginia and that he was a skilled wood worker. In the 1880 Madison County, Kentucky census, Thomas is noted as "works in woodshop."

Thomas W. Hudgens moved to Paint Lick, Garrard County, Kentucky ca. 1870. My Uncle Bill Hudgens, son of Benjamin Joshua Hudgens, said that Thomas Hudgens was a furniture maker. It is a complete mystery on why Thomas Hudgens moved to the Paint Lick area.

Thomas' brother James Hudgens appears in the household in the 1880 Madison County census. This is the only connection between Thomas Hudgens and his family back in Cumberland County, Virginia that I can find. On the 1870 Madison County Census and marriage license, Thomas' occupation is listed as wagon maker.

On 26 November 1906, Thomas W. Hudgens purchased 12 cemetery lots, lot 22, for $25 at the City of Richmond Cemetery, Madison County, Kentucky. He is not buried in the this section but a few yards away in, what I believe, is the Maupin family section. Nancy Boon Davis Hudgens is buried next to him.

Nancy Boon Davis is the daughter of Joshua Davis and Isbinda Higginbotham. The Boon name appears in the Higginbotham line a number of times as a middle name.

Milton Hudgins, b. 26 February 1903 to Alexander Hudgins and Delia Land at Madison County, Kentucky.

James Hudgins, b. 16 February 1874 to T.W. Hudgins and Lucinda Todd at Madison County, Kentucky. I find this record very interesting. The birth date matches would make more since for the above James Hudgens. The births of Benjamin and James are just too close to each other. Did Thomas W. Hudgens father a son out-of-wedlock? Or could this be the son of James Hudgens, brother of Thomas W. Hudgens?

Thomas W. Hudgens does not appear in any indexes for the 1860 Virginia Censuses. There is a Thomas Hudgens who appears in the 1860 Census for the Henrico County, Western District.   This Thomas is 72 years old and is not the Thomas W. Hudgens listed above.

Several Snoddys moved to Tennessee and southern Kentucky. I have not checked the records for those areas to see if Thomas W. Hudgens moved there before the war.














5. Benjamin Hudgens, b.ca. 1808 at Cumberland County, Virginia, d. 29 May 1879 at Flat Rock Estate, Cumberland County, Virginia

The first time Benjamin shows up in the censuses is in the 1840 Buckingham County census. He is between 30 and 40, also listed with one son (Thomas W.) under 5, a daughter under 5 and two females, between 20 and 30. Two individuals were listed as working in manufacturing and trade. There was also a slave under 10 years old living in the household.

According to the 1860 Cumberland County, Virginia census, Benjamin Hudgins/Hudgens' occupation was as an overseer for William H. Mayo. Benjamin worked as an accountant for William H. Mayo in Cumberland County. Benjamin can found in both the 1850 and 1860 Cumberland County, Virginia censuses. By the 1870 Cumberland County, Virginia census Benjamin Hudgens is no longer found, as is his wife. In the 1870 Buckingham County, Virginia census there a Benjamin Hudgins and he is found in Marshall Township District. This is the only Benjamin Hudgens found in the 1870 Virginia census.

Benjamin died on 29 May 1879, age 71, in Cumberland County, Virginia, as reported by his son Philip D. Hudgens. At the time of his death Benjamin's occupation was listed as tanner.

The last property that Benjamin Hudgens purchased was located 6 miles south of Columbia, Fluvanna County, Virginia in Cumberland County, Virginia. I believe he and his wife are buried there.

There is a wide discrepancy in the birth dates for the children on the 1850 and 1860 censuses.

Consent for her marriage to Benjamin was given by Mary's father David S. Snoddy. David S. Snoddy appears in the 1820 and 1830 Cumberland County census. Mary and family can be found in the 1880 Hamilton District, Cumberland County, Virginia, census pg. 15B. Her sister-in-law Fannie Hudgens (never married) is listed with the household.

Her son Philip Hudgens reported her death and Mary was 67 years old at the time.

    The 1850 census for Cumberland County lists a Walth in the household of Benjamin Hudgens. It is from this census that I have identified Thomas W. Hudgens. The 1850 Cumberland County census listing for the household of Benjamin Hudgens is full of errors on birthdates. It is most likely that Benjamin Hudgens employer identified the family to the census taker.

    Albert James Martin's occupation at the time of his marriage was a tanner. Albert is the son of David Martin and Elizabeth Hudgens. Sidney and Albert are first cousins. Elizabeth is the daughter of Thomas Hudgens below. Inscription on Sidney's tombstone: "Wife of A.J. Martin Our Mother." In 1880, Albert James Martin was living in Marshall District, Buckingham County, Virginia, census pg. 481D.

In the Chancery Court records of Cumberland County, Virginia, there are a number of records showing the family members and also the problems with the settlement of Thomas Hudgens estate. These Chancery records are priceless in researching Thomas Hudgens and his family. In the Chancery records for Cumberland County, Virginia show that Poindexter Smith was appointed the administrator of Thomas Hudgens estate. Poindexter Smith died soon after Thomas Hudgens and his wife Martha inherited the problem but soon remarried herself. It took years to settle Thomas Hudgens estate. The above links are a few of the documents found in numerous chancery records and convey the frustration of Thomas Hudgens heirs to the settlement of their father's estate, which was considerable. The biggest discovery in these records is the mention that Mary, Thomas Hudgens'wife, received a legacy from her father through the administrator of the estate, Ben Palmore. Further research reveals that her father was Fleming Palmore. In his will, Fleming Palmore mentions his daughter Polly Hudgens.

In the 1810 census for Powhatan County, Virginia Thomas Hudgens is listed as having 3 males to 10 years old, one male to 45 years old, one female to 10 years old, and one female to 26 years old

Her death may have prompted the children to file suit against Poindexter Smith for the settlement of Thomas Hudgens estate. The suit was filed on 9 January 1837. In settlement of Thomas Hudgens estate, Mary Hudgens is mentioned as receiving a legacy from her father's estate. It mentions that the administrator of her father's estate is Ben Palmore. Ben Palmore was the son of Fleming Palmore. Fleming Pamore mentions in his will his daughter Polly Hudgens.

Hudgins' homestead was located on Rt. 718 off of Hwy 15 near Arvonia, Buckingham County, Virginia. It was surveyed in 1836 for the transfer of this land to Thomas Boatwright from George Winfey. Before 1850 the land was in the possession of Thomas Henry Hudgins. It remained in the Hudgins family until the 1980s when the old homestead was torn down.

      This is a problematic record. The marriage bond is recorded, 1838, in Cumberland County, however, the 1870 Cumberland County, Virginia census lists her name as Hannah. Smith Hudgens is not listed. In a 1841 deed, Smith Hudgins wife is identified as "Samantha" Hudgins. Hannah and Samantha are the same individual. Hannah's parents are Cary Southall (b.1793) and Mary Ellisy Maddox (b.1798). In the 1860 Cumberland County, Virginia census a Lucy A. Hudgens, age 6, is listed in the household. Samantha is to have lived to 101 years of age. She was referred to as "Grandma Manthy."

      In most records his name appears as Smith Hudgens/Hudgins. Family composition from the 1850 Cumberland County, Virginia census. Smith Hudgins is not listed in the household on the 1870 Cumberland County, Virginia census.

        Robert's profession is indetified as "shoemaker" on the census. Robert served with the 21st Virginia Reg. "Cumberland Greys" and was wounded at Kernstown. Narcissa's is the daughter of John A. Austin and Frances Anne Anderson Meador. The children of Robert and Narcillus had no issue.

Historical Inventory: Subject: Austin Home; Location: 2.4 miles north of Cumberland Court House, Cumberland, Virginia on US Rte 60; thence left 6 miles on Rte. 45: thence right .8 mile from that route; Date: about 1792; Owner: in 1792 James Austin's will was recorded. It was his desire that his son, James, have the place on which he lived and that his son, William, have the Muddy Creek Tract. The Muddy Creek tract is the tract on which the Austin home is located. In 1794 William [Austin] married Judith Atkinson. He died young of pneumonia. In 1839 three of his children deeded their interest in the dower left their mother, to John A. Austin, another son. John A. Austin took care of his mother and lived on the home place. He married Frances Meador. After their deaths, Robert Hudgins and Narcissus, who was Narcissus Austin, and Henry C. Hudgins and his wife Mary, who was Mary Austin, deeded their interest in their mother's dower, to E.A. Hudgins [Edwin Archer Hudgins] in trust for his wife Emily [Austin], and her children.         "My grandfather was Edwin Archer Hudgins of CUmberland Co. (Va) his Post Office being Ashby, Virginia, but later dissolved and in later years his address was Cartersville, Virginia. He married my grandmother Emily Josephine Austin and they had the following children: Lillian Ada Hudgins (my mother); Marion Archer Hudgins; Mabel Clare Hudgins. My grandmother had a brother Robert Austin Hudgins; and another brother named Clay Hudgins. There was another brother, Marion Hudgins, who was wounded in the Civil War and died in a Baltimore hospital as a result.

        Robert Austin Hudgins married Narcillus Austin and had the following children: Calvin Hudgins,; Julian A. Hudgins; Blanche Hudgins (Tyler). There were no issue from any of these and have all been dead several years.

        Clay Hudgins Married Mary Austin, children: John Hudgins; Alton Hudgins; Mary Fannie Hudgins.

            Wilfred Elmo Bagby's military record for WWI shows he was Methodist, he had a grade school education and was a farmer, living in Cartersville, Cumberland County, Virginia after the war. He was originally assigned to the 30th Co., 8th Battalion 1[?] Depot Brigade. He was kept at Fort Lee, Richmond, Virginia in domestic service during his entire enlistment. He was discharged 16 December 1919. In his exit interview he was asked his attitude toward military service, he wrote: "Not anxious to go but considered it a scrifice necessary at that time."

    William Hudgens signed the Administration Bond for his father in 1827. There is another record that appear in the Cumberland County, Virginia Chancery Court, 1823-003 where William Hudgens sued his brothers Thomas Hudgens, as administrator and John Hudgens. The suit also includes John Hudgens children, William D. Hudgins, James Hudgens, Catherine M. Hudgins, Smith Hudgins, John Hudgins, Robert Hudgins, Jane D. Hudgins and Lucy M. Hudgins.

In the 1850 Jackson County, Missouri census there is a John A. Hudgens, b. VA, wife Catherine, b.KY and a Lucy J. and Mary.

Hudgens, Henry H., farmer and stock-raiser, section 20, post office Unionville; was born October 16, 1811, in Cumberland County, Virginia, and emigrated to Williamson County, Illinois, in 1835 where he lived till 1847, when he came to Davis County [Missouri], arriving in Bloomfield in June, where he lived until 1848, when he moved to his present farm. Mr. Hudgens was a member of the first board of supervisors in Davis County, elected by the democratic party. He has been a prosperous farmer and an honored citizen, a member of the Protestant Methodist Church for a good many years. His farm is located on North Soap Creek, and contains 120 acres of land, well improved, watered and fenced. He was married November 7, 1836, to Miss Susan Harrison, a native of Tennessee. They have eight children, William C., Thomas J., Lucian B., Mary J. (wife of Hiram Clark, of Appanoose County), James M., George W. and John M. (living at home), and Rebecca (wife of H.H. Wheeler, of Fremont County).

Death date from a Cumberland County, Virginia Chancery Court Record, 1764-004.

Some researchers show John as being the father of Holloway Hudgens. Holloway was born between 1750 and 1760 and would have been included in the guardian bonds for John Hudgens children. Only Drury, William, James and Mary appear on those guardian bonds. Holloway Hudgens is the son of Robert Hudgens, by proof of a Deed of Gift, Cumberland County, Virginia, Deed Book 5, pp. 142. In a lawsuit against the administrators of John Hudgens estate, Drury Hudgens sued his Uncle. The Chancery record of this lawsuit, states that Robert Hudgens is the brother of John Hudgens.

Robert Hudgens and John Colquit were the executors of John Hudgens estate. Robert Hudgens was also appointed as guardian for John Hudgens' daughter Mary Hudgens who married Francis Flippen. Most people show John Hudgens, husband of Martha Holloway, death date as 23 October 1758, but he was at least dead by 13 June 1755 as based on court record: "Action of Debt. Robert Hudgens and c. executors of John Hudgens against James Martin. The defendant says he cannot deny he owes 10.4 pounds current money. It's considered by the Court the plaintiffs recover 10.4 pounds." Caroline County, Virginia Court Order Book. The Court Records of Caroline County were burned during the Civil War. It would appear that John Hudgens Will was recorded in Caroline County, Virginia, since Robert Hudgens is identified as an "executor" rather than administrator of John Hudgens estate. In a Chancery Court record filed in Cumberland County, a will is mentioned for John Hudgens. According to the complaint, the will was dated 5 November 1753, see partial transcript below.

To the worshipfull Court of Cumberland County, Sitting in Chancery Humbly Complaining ____ unto your worships your Orator Drury Hudgens and Mary Hudgens Infants under the age of twenty one years by George Carrington, Jun'r their next friend James Hudgens and Infant by William Hix his lawful Guardian and William Hudgens an Infant by William Allen his lawful Guardian.
That some time about the year of our Lord one thousand seven hundred and fifty three one John Hudgens the father of Being seised and possessing a considerable estate both real and personal did by his last will and Testament in writing bearing the date the fifth day of November in the year the aforsaid year 1753 devises to his four children your orators in Sundry tracts of the said will lands slaves stock ____ funiture etc etc and in particular did devisee to his three sons of ___ one thrid part of his negro slaves when they should arrive to the age of twenty one years and did also leave to his brother Robert Hudgens Def'd herein often named the care of all his Negroes to devised to his children for their sum of ten years and further the said John Hudgens did of his said last will appoint the said Rob't Hudgens ___ Drury Hudgens and John Colquit another Def'd hereto Executors....

From the Cumberland County, Virginia Chancery Court records, Index 1764-004. This record is available at the Library of Virginia, Archives, Richamond, Virginia. This record is also the first mention that Robert and John Hudgens are brothers. The chancery complaint deals with John Colquit and Robert Hudgens negelecting the slaves placed under their care and specifically that Robert Hudgens abused two of the slaves, who eventually died. The Chancery Court ordered the division of the estate as follows:

Drury Hudgens received slaves, Isaac and Sharper, William Allen provided $10.40 for hire of a slave and cash from his Uncle Robert of $14.00. James Hudgens received one slave, James, one Bible and Prayer book and the blance of a bond from William Clark of $69.00. William Hudgens received one woman slave, Pegg, a Tallifero bond of $24.10, one prayer book and slate, cash from William Hix of $3.12, cash from William Allen, $1.00 and cash in hand of $36.00.

John Hudgens' land bordered that of William Hendricks. William Hendricks died sometime in 1739 and his widow Martha [nee Parker] married Robert Hudgens. John Colquit, executor for John Hudgens estate, son, John Colquit, Jr. would marry Elizabeth Hendricks, dau. of Martha and William Hendricks.

The relationship of John Hudgens and Robert Hudgens is not clear as to whether they were brothers or father and son. Robert Hudgens is the older, by about 15 years.

      From the Virginia Historical Inventory (available from the Library of Virginia web site): Hudgins Tavern alternative name Locust Grove Location: 2.4 miles north of Cumberland Virgini, on route 60; thence left 11.9 miles on Route 45; thence left 5.3 miles on Route 16; thence left .7 mile on Route 610; thence left .2 mile. Date: about 1815 [In my estimation this land may have been in the Hudgens family before 1815. It may be the original homestead of William Hudgens] Owners: The date 1815 appears on the west chimney. In 1839, John Hudgins' will was recorded and in it provided for his place to be sold and the proceeds divided among his children. In that same year, Henry V. Hudgins, executor of John Hudgins' estate, sold the tavern to Richard I. Anderson. At his death in 1887, the place was left to his second wife and her children, Wister and Hildreth. The children sold their interest to their mother Sallie Anderson and in 1917 she sold the tavern, then known as Locust Grove, to A. [?] Piercy. It was necessary for the Federal Land Bank to take over the place. It was sold in 1931 to P.L. Duncan, who is the present owner.
