On August 16, 2003 U.S. Rep. Bill Janklow of South Dakota collided with Randy Scott of Hardwick, Minn.  Randy Scott was a motorcyclist who was ridin with a friend Terry Johnson through an intersection near Trent in Moody county.  It seems Janklow ran the stop sign at a high rate of speed (what speed is not proven yet).  This is not his only accident or speedin offense but more on that in a minute.

Janklow is being charged with manslaughter and the trial is going on at the time of this writing.  One document claims a witness said he was slowin down just before the collision.  The same document says Janklow claimed there was another vehicle comin toward him so he accelorated to get out of its way.  The document also said that he "gunned" his Cadillac around the vehicle.  It would seem that the other vehicle was never there.  This is not the first time he has had delusions of vehicles that weren't there, as his drivin record will show.  Janklow's Chief of Staff, Chris Braendlin, was a passenger in his vehicle and stated in an affidavit that Janklow was slowin down and he saw somethin go passed the car after the Terry Johnson's bike went through the intersection but, could not tell what it was if anythin.  How stupid do they think people are.  He would lie to keep his job and his boss out of trouble.

It would seem to me that a cover up or miscarriage of justice is about to happen.  Judge Rodney Steele upheld a ruling to keep Janklows drivin record out of it.  Prosecution can admit two incidents in which Janklow saw imaginary vehicles.  Janklow's drivin record is one of the worst I've ever seen. To rule against admittin his record is the worst call the judge could make.  The record shows a pattern of criminal intent as far as reckless drivin.

In Janklows campaigns he bragged about how he loved to drive fast.  His flagrant attitude toward speedin shows total disreguard to others on the road.  If any of us would do that, we would be in lock down for years.  Here is his drivin record not includin dozens of warnings for speedin.

January 4, 1990-     78mph in a 65 mph zone in Jackson County- $70 fine
January 13, 1990-   74mph in a 55 zone in Moody County- $70 fine
April 30, 1990-        45mph in a 35 zone in Hughes County- $25 fine
November 6, 1990-  79mph in a 65 zone in Jones County- $72.50 fine
date unknown - 75mph in a 65 zone in Hanson County- $10 fine (case disposed July 15, '91)
October 11, 1991-    69mph in a 55 zone in Aurora County- $85 fine
November 5, 1991-  47mph in a 30 zone in Davison County- $75 fine
December 16, 1991- 85mph in a 65 zone in McCook County- $85 fine
July 15, 1992-          no contest to following to close in Minnehaha County- $28.50 fine
March 15, 1993-      80mph in a 65 zone in Minnehaha County- $88.50 fine
April 30, 1994-         75mph in a 55 zone in Jerauld County- $78.50 fine
May 30, 1994-          90mph in a 65 zone in Brookings County- $88.50 fine
October 30, 1994-     80mph in a 65 zone in Moody County- $63.50 fine

There are no records since 1994.  Makes you wonder how many times were not caught and why there are no records after '94.  Janklow also had seven accidents in 9 years prior to this one. They are:

January 23, 1993- County Road 146-  Janklow collided with James Vander Karr when Janklow moved into the left lane to avoid an animal.  Vander Karr was taken to the hospital with cuts to his head.

In 1992- Janklow was followin Amy Ann Howell to closely and hit her at 10th Street and Blauvelt Avenue in Sioux Falls- Janklow was ticketed.

November 24, 1993- Janklow colided with Betty Stoner at First Avenue and 10th Street in Sioux Falls.  This is the first case of a what the cops said was a "phantom vehicle"

December 27, 1993- Janklow collided with Clark Fairchild in the 1000 block of South Minnesota Avenue in Sioux Falls.  Janklow stated he was tryin to avoid a blue Bronco.  This is the second case of an imaginary cage.

April 6, 1997-  Janklow was in Watertown checkin out flood damage.  He tried to stop at a State police command center but rear ended the command post due to wet brakes and slick road.

October 6, 2002-  Janklows car swerved to miss a herd of deer when he hit one with his Cadillac Deville on Highway 26 at the Spink/Hand County line.

My personal thought about the last accident is, he must have been goin a good clip or didn't know what brakes are for.  All the above accidents were avoidable if he would have used some common sense.  It was just a matter of time before this crazy cager used one of us for a speed bump.

What can we do about this injustice?
We have several options and suggestions from many bikers and groups.  One suggestion is to get petition drives goin all over the country and even the world.  Another is to contact the local Federal Representatives and have them censure Janklow in the House.  Another option is to hold protests at the state border of South Dakota along every major road into the state.  This requires lots of plannin and simultaneous protests (e-mail me if this interests you).  Finally is to write to the Sturgis Chamber of Commerce and state your intention to Boycott the rally.  Since this rally brings in a lot of money (OUR MONEY) to the state it would put a real hurtin on South Dakota.  I personally will not go to Sturgis Rally until they can guarentee me safe roadways to travel on (which will be when Hell freezes over).  The Sturgis Rally can be moved to another state and called another name and be just a good but I will not support a state that claims to support us and turns around to kick us in the ass when we aren't lookin. If you would like to contact the Sturgis Chamber of Commerce please follow the link below.  If we are to let them know we mean business when it comes to our lives then we need everyone to step up to the plate and let them know they can't fuck with the Brotherhood and Sisterhood of the bikers.  We stick our necks out everytime we get on our scoots, this we all know.  Knowin don't solve anythin but, doin is what gave us our rights and allowed us to keep them.  The world needs to know that we will fight back if we're provoked.  I dedicate this page to Randy Scott and all of our fallen Brothers and Sisters who can't fight anymore.  I fight for them cause I won't forget em.

On Dec. 2 the following information became available through the Associated Press.

Defense lawyer Ed Evans acknoledged that Janklow WAS speeding (earlier this was denied by Janklow) before the collision but said he didn't see the stop sign because he was havin a diabetic reaction and became disoriented.  Terry Johnson took the stand and cried as he described seeing Randy Scott's body layin in a soybean field.  Several photos from the crash were presented by the prosecution including one photo that showed alot of Scott's midsection missing.  Some other photos showed a "Stop" sign, a "stop Ahead" sign and a county road sign that were bent over from the impact of Janklows Cadillac.  Close-ups of the car and Scott's ride were showed as well.  The prosecution also presented a video of Janklow on his way to the hospital, in which he appeared to be coherant most of the time.  He could remember somethings but couldn't remember details of the crash.  As the tape was winding down, it sounded like Bill was slurring his speech.

According to Monica Collins, a witness who Janklow passed at a high speed, said Janklow passed her "as if she were sitting still".  She estimated her speed at 55 or 60 mph.  Prosecution said he was doin 71 mph in a 55 zone.  Chris Braendlin said he was slowing down but couldn't remember when he started to slow down.  He stated it happened so fast, "motorcycle, flash, spinning".  The flash part was described by another witness, Michael Jenkins, sayin it "was like an explosion of debris and dust".  Brad Isle said he saw a "body flying in the air."

Diabetics across the nation are mad as hell that Janklow would use his diabetes as an excuse.  they are sayin that before drivin and to test the blood sugar regularly.  Apparently the phantom vehicle crap wasn't workin so now their using some other scam.  Well, now that he is usin this defense, he just hung himself.  Janklow had a law passed in South Dakota statin that no diabetic can have a license if they had a seizure in a year.   That means he MUST hand in his license, even IF he gets off.  Let's see what happens next.

I did a little checking into the diabetic reation defense.  According to the American Medical Association Home Medical Encyclopedia, The priciple symptoms of this type of diabetes (hypoglycemia) are: sweating, weakness, hunger, dizziness, tremblin, headache, palpatations, confusion, and sometimes double vision.  Movements are uncoordinated, and behavior is aggressive and irrational.  The victim can lapse into a coma if the blood sugar is too low.  Now, my point is, it was reported that Janklow had nothing to eat for 20 hours.  After not eating for 20 hrs and taking his insulin, his blood sugar count should have been shot to hell.  The stories say he only allegedly suffered weakness (but appeared ok by Braendlin and an emt who arrived at the scene), and confusion (more like delutions).  What happened to the other symptoms.  The fact that Janklow went 20 hours without something to eat and taking insulin, he would have slipped into a diabetic coma or to say the least he definately would NOT have been fine as Braendlin said.  Also take into account his age, 64, not eatin for someone in his 30's can make ya feel like shit and that's a non-diabetic.  Now with someone 64 y.o. and a diabetic it could be dangerous.  His aggressive and irrational behavior doesn't mean anything either, he's like that normally with his speeding and reckless driving.  This is proven by his record.  As far as I'm concerned, this defense doesn't hold water.  If anyone reading this has this type of diabetes and has any info on the subject please feel free to e-mail me.  My e-mail is on the home page.  Please feel free to submit your comments in my guestbook, located on the home page also.

Update:  Janklow has been found.....

100 days in jail!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!  Three years probation and a lousy $5,000 fine!!!!!!!!!!!!!!!!  WHAT FUCKIN JUSTICE IS THIS!!!!

I knew this might happen.  This son of a bitch skated.  With a maximum of ten years the state could have put on this asshole, they give him 100 days.  I guess a bikers life , in good old South Dakota, is only worth only 100 days.
As far as it goes with me, I will never set foot or tire in South Dakota again.  Sturgis can rot in hell before I go back.  I would hope that every biker will consider this case the next time you decide to go there.  The next time it could be you or a Bro or a Sister who gets no justice.  Personally, no rally is worth my life or the life of any biker.  We can all take this one to heart, it's time for ALL OF US to stand up and let them and any state know that we will not take shit like this layin down.  I will start by puttin out a call to all my fellow Vets who ride, from WWII, Korea, the Nam, Panama, to Desert Storm and Iraqi Freedom to all peace timers. We know what it is to stand behind eachother when the shit hits.  We need to stand together again.  I can't stand by and see this shit happen, not on my watch.  We all need to stand our watch and protect our great country from all foriegn and domestic threats.  We served our country not our government, who time and time again turned their back on us everytime they could. We can begin by boycottin the state and turnin Sturgis into a ghost town.  Then we can start another rally in North Dakota or some other midwest state and make it just as big if not bigger and call it the Randy Scott Memorial Rally or the Fallen Brothers Rally, in memory of all our fallen.

Ride Safe, Be Free, and Watch those Crazy Cagers.

Respects
