92% of Denver’s membership showed up to vote and 93% of those who voted told the Company just exactly what their Committee had been trying to tell the boss all along… they won’t settle for a bad contract! The vote was 113 to 8 to tell the Company to get back to the bargaining table and get serious about working toward a fair contract. Now it’s our turn. Your Committee has scheduled a ratification vote for Friday the 15th at 4:30PM. Management believes that your Committee doesn’t speak for you and has been out in the plant lobbying very heavily for ratification. (Quick, when was the last time anyone can remember this Plant Manager actually coming out into the plant and acting like he really cares what any of us really think?) Friday night is the night! Plan to attend the informational meeting and ratification vote at 4:30PM!! For those of you on day shift in Operations, a ballot box will be brought to the plant. If you are starting nights on Friday, you will need to come to the meeting to vote. |
Denver Membership Overwhelmingly Turns Down Management’s Contract Offer |

The boss has been lobbying full time to get us to ratify a contract offer he describes as a Good contract. We just thought you might want to see how their “final” offer shakes out under honest scrutiny. We have included this short summary to help give you some idea: Who Really Benefits From The Large Rewrite of Our Current Contract? Where the Union Benefits 1. $600.00 signing bonus. (Before Tax!) 2. Pay rate adjustments to clean up contract.(A little more than a dime for a few people). 3. Modification of temporary vacancy language for employees expected to be out for more than 60 days (must return for one pay period). This is to keep the Company from bringing a person back into the workforce for one day every 59 days to avoid a letter change. page 20 4. Ten Banked Holidays in Operations. page 26 5. Funeral leave will not include employees’ days off. page 29 6. Funeral leave will now includes aunt, uncle, niece, and nephew not living in household. (Same as Corporate Policy for the Rest of Conoco) page 29 7. Six-year bid restriction starts with hire date. page 48 8. Supervisory Retention – Represented employees promoted into non-bargaining unit positions no longer retain seniority or any other benefits covered by the Collective Bargaining Agreement. page 50 9. National Oil Bargaining Pattern wage increases and benefits. (When Conoco’s offer is accepted by International.) 10. Rest periods in Mechanical will count as time worked. Where the Company Benefits 1. Threat to take contract expiration off date with National Pattern if not ratified by 2/18/02. 2. No retroactive pay if not ratified by 2/18/02. 3. Zipper Clause – Past practices and Letter of Agreements are no longer contractual. Union offered to put in to Collective Bargaining Agreement but Company declined. 4. Clarified call-out language but also took away Korsmo Letter. 5. Took away ½ hr. paid lunch for Mechanical when schedule changed to start early. page 7 6. Daily overtime no longer counts as time worked in any 5 days for Mechanical. page 8 7. Company eliminated “established scheduling procedures” language. This allows the company to change scheduling procedures any time they want. page 9 8. New Banked Holiday language reduces administrative burden. page 26 9. Took away shift differential for mechanical. page 12 10. Completely gutted Section 17 and Short Change language. page 14 11. Pay rate adjustments to clean up contract. Administrative clean-up. 12. Company added language to avoid scheduling 7th day. 13. Eliminated all progression groups – May change groups in future. 14. Added language that allows the company to leave the Utility position open in the Pump House. 15. Eliminated all reference to the number of positions in the units. 16. Added move-up-on-shift in Pump House. 17. Added language to allow leaving shifts open for up to 3 hours without backfilling. 18. Deleted language for on shift training of personnel. page 21 19. Eliminated ER agreement. Added language to force people to do ER work for base pay. 20. Company added definition and pay rate for TAC’s. (No longer considered special. Can force participation.) 21. Company defined Set-Up work. Pay will be determined by the Company. (Hopefully, you’re a good negotiator.) 22. Company increased the number of set ups from 3 to 6 people per week in operations. Union has no control over how many people can be pulled from each unit. (Get ready for more schedule disruptions as we try to backfill for all the people set up to do boss jobs) pages 21 & 22 23. Company added language defining the pay for holidays that occur on 6th and 7th days. Applies to 8-hour shift workers only?? 24. Removed Union’s right to negotiate benefit changes that occur midterm. page 28 25. Extend direct hire apprenticeships from 4 to 12 months. page 32 26. Employees must pass Journeyman (Craftsman) test to be awarded Pump Mechanic bid. page 34 27. Removed employee protection if he fails apprentice program. page 35 28. Removed language to allow Union to negotiate pay if a change in classification occurs midterm. page 39 29. New Hire probationary term is extended from 4 to 12 months. page 43 30. Added language to allow unrestricted specialty crafts in mechanical. 31. Eliminated protection for employees who are incapacitated and can no longer perform the duties of their regular classification. page 50 32. Periodic physicals. – Not negotiated. Company removed from contract. page 62 33. If you do not cross a sympathy strike picket you will be terminated. 34. Random drug testing policy – Not negotiated. Can’t grieve or arbitrate. 35. Management rights…No arbitration. page 71 36. 12-hour agreement – Pump house on 12’s --Not negotiated. Company never explained how staffing will be handled. 37. Rewards and recognition…Company won ability to single out individuals for “Special Thanks” awards. (Even if effort was shared by many) |
