It has now been about 2 weeks since the membership of this Union unanimously rejected management’s latest contract offer.  As many of you will recall, our offer to get back to the bargaining table with management was met with a demand from the Company that the Union must show up with a last and final offer.  Last week your Union wrote a letter to Jay Churchill informing him officially that we could not meet his unreasonable demand to present the Company with our last and final offer since we still had many issues to discuss.  We also reminded him of his responsibility to supply the Union with information required to allow us to represent our membership properly at the bargaining table.

We are examining the possibility that both sides are not meeting due to possible misunderstandings surrounding the Management Rights and Exclusive Agreement (Zipper Clause) language.  To that end, delegates from our International Union have met with delegates from Conoco’s Human Resources department to try to find a way we can move forward to resolve the issues barricading efforts to reach agreement.  It may be a couple of days before we find out if their efforts will have a positive effect.  Hopefully, this week will see egos step aside so we can return to the bargaining table.

We are still examining the possibility that both sides are not meeting due to possible misunderstandings surrounding the Management Rights and Exclusive Agreement (Zipper Clause) language.  While exploring that possibility, representatives from PACEIU and management met in Tulsa last Friday to seek common ground that could lead to further discussions.

As a result of these efforts, another round of discussions is slated to take place in Denver this Thursday and Friday to further delve into the issues barricading full-scale talks that could lead to a contract settlement.  This round of discussions will include your Chairman and Vice-Chairman, along with your PACEIU representative, our counterparts from Denver and a delegation of management representatives.

Even though the Management Rights and Exclusive Agreement language appear to be the primary stumbling blocks to getting both sides back to the bargaining table, make no mistake that there are still many other very serious issues that have not been fully discussed.  The only way to get these issues hammered out is for both sides to get back to the bargaining table and attack the issues in earnest!

First things first.  Weather permitting, your Chairman, Vice-Chairman and PACEIU representative will be in Denver on Thursday working with management to try to get things back on track to securing a fair and equitable contract for all parties.
