JUECES PREVARICADORES EN LA COMISIÓN DE DERECHOS HUMANOS DEL CONSEJO DE EUROPA. ¿HA OÍDO USTED DECIR QUE SI NO LLEVA LA RECLAMACIÓN UN O ALGÚN/OS DETERMINADO/S ABOGADO/S O DESPACHO/S DE ABOGADOS DE ESTRASBURGO, LA RECLAMACIÓN, POR BIEN FUNDADA QUE ESTÉ, NO LLEGA AL TRIBUNAL?.

PREVARICATOR JUDGES IN THE COMMISSION OF HUMAN RIGHTS OF THE COUNCIL OF EUROPE. HAVE YOU HEARD THAT IF THE CLAIM IS NOT MANAGED BY A OR SOME SPECIFIED LAWYER/S OR LAWYERS' FIRM/S OF STRASBOURG, THE CLAIM, NO MATTER HOW WELL FOUNDED IS IT, DOES NOT REACH THE COURT?

En España -que se está volviendo un país respetable en estos temas-, desde hace unos años se ha empezado a perseguir a algunos jueces sospechosos de prevaricación. En este sitio se pueden ver casos de jueces y de fiscales españoles prevaricadores a los que nadie persigue. Pero hay casos mucho peores que España. Hay jueces prevaricadores a los que nadie persigue ni puede perseguir porque gozan de inmunidad, y cuando se les invita a renunciar a ella y enfrentarse a un Tribunal, no renuncian, al menos en mi caso. Esto sucede con los miembros prevaricadores de la Comisión de Derechos Humanos del Consejo de Europa, a quienes he emplazado a renunciar a su inmunidad, y ni siquiera me han contestado. Y además, los jueces españoles prevaricadores son generalmente de nivel normal, sin ninguna selección exigente, llevan los asuntos con un mínimo de respeto por las formas y no están específicamente dedicados a la protección de los derechos humanos -excepto los del Tribunal Constitucional-, mientras que los citados miembros de la Comisión están seleccionados entre los de "gran moralidad y deben poseer las calificaciones necesarias para desempeñar un alto cargo judicial o ser personas de reconocida competencia en derecho nacional o internacional", llevan los asuntos sin el menor respeto por las formas, y están específicamente dedicados a la protección de unos derechos humanos que, como veremos, les importan un rábano. In Spain -that is becoming a respectable country in these subjects-, one has begin, since some year ago, to prosecute judges suspect of prevarication. In this site one can see some cases of prevaricator judges to whom nobody prosecute. But there are cases much worse than Spain. There are prevaricator judges to whom nobody prosecute nor can prosecute because they have the benefit of the immunity, and when they are invited to renounce to it and make front to a Court, don't renounce, at least in my case. This happens with the prevaricator members of the Commission of Human Rights of the Council of Europe, to whom I summoned to renounce to their immunity, and even didn't reply me. And furthermore, the Spanish prevaricator judges are generally of a normal level, without any exigent selection, proceed with a minimum respect to the forms and are not specifically devoted to the protection of human rights -except those of the Constitutional Court-, whereas the cited members of the Commission "must either possess the qualifications required for appointment to high judicial office or be persons of recognised competence in national or international law", carry the cases without the lesser respect to the forms, and are specifically devoted to the protection of certain human rights that, as we will see, don't care them a straw.
