If you are really interested in human rights, please follow the lecture and you will see that neither the Council of Europe, nor its Commission of Human Rights, nor its Parliamentary Assembly care a straw of them. | Señores: Sólo entiendo francés, inglés, italiano, portugués, y, desde luego, español y catalán. Espero que Vds. puedan entender "mi" inglés. Soy español, tengo 72 años, y fui encarcelado en 1971 por publicar mis libros prodemocráticos. Desde 1981 puedo, teóricamente, presentar demandas contra España ante la Comisión de Derechos Humanos del Consejo de Europa por las violaciones por España de mis derechos fundamentales y los de los niños españoles. Pero en la práctica esto es inútil porque las demandas contra España son admitidas -o, más exactamente, inadmitidas- no por miembros de la Comisión, como está establecido en el artículo 47.1 de las normas procesales de la Comisión, sino por los ayudantes juristas de cada país, en mi caso españoles, que, de acuerdo con la más respetada tradición de los juristas españoles, no leen los escritos (ni siquiera las Sentencias del Tribunal), y, por lo tanto, no admiten ninguna demanda contra España excepto unos pocos casos de personas populares de las que hablan los medios de difusión. Por consiguiente, las Decisiones de inadmisión son de tan bajo nivel técnico que ninguna Universidad seria habría otorgado a los redactores de tales Decisiones una licenciatura en Derecho. Los miembros de la Comisión, que, según el artículo 21.3 del Convenio de Roma, "deben poseer las calificaciones requeridas para ejercer un alto cargo judicial o ser personas de reconocida competencia en derecho nacional o internacional", quizá tienen el nivel técnico requerido, pero al poner su firma en dichas Decisiones, lo más probable sin leerlas, parecen no ser aptos ni siquiera para actuar como Jueces de Paz en el más pequeño pueblecito, y, en cualquier caso, no tienen la moralidad debida, porque delegan su jurisdicción en manos de no miembros de la Comisión, y además sospechosos de parcialidad y negligencia. |
Dear Sirs, I only understand English, French, Italian and Portuguese, and of course Spanish and Catalan. I hope you can understand "my" English. I am a Spaniard, 72 years old, imprisoned in 1971 for publishing my prodemocratic books. Since 1981 I theorically can lodge applications against Spain before the Commission of Human Rights of the Council of Europe for violations by Spain of my fundamental rights and those of the Spanish children. But in the practice this is useless because the applications against Spain are admitted -or, more exactly, inadmitted- not by members of the Commission, as it is ruled in the rule 47.1 of the Rules of Procedure of the Commission, but by the juridical clerks of each country, in my case Spaniards, who, according to the most respected tradition of the Spanish jurists, do not read the papers (even not the judgements of the Court), and so they do not admit any application against Spain except for some few cases of popular persons of whom the mass media talk. Therefore, the Decisions of inadmission are of such a low technical level that any serious University had not awarded the redactors of such Decisions a degree in Law. The members of the Commission, who, according to the article 21.3 of the Convention of Roma, "must either possess the qualifications required for appointment to high judicial office or be persons of recognised competence in national or international law", perhaps have the required technical level, but by putting their signature in the said Decisions, most probably without reading them, seem to be not apt even for acting as Justice of the Peace of the smallest village, and, in any case, have not the required morality, because they delegate their jurisdiction in the hands of non-members of the Commission, and besides suspect of partiallity and negligence. |

| Cuando dí las conferencias que cito luego, las Sentencias del Tribunal en casos contra España eran solo cinco, cuatro de ellas declarando violación. Compárese esto con los 52 casos contra Austria, 33 Bélgica, 56 Francia, 28 Alemania, 31 Holanda, 31 Suecia, 24 Suiza y 67 el Reino Unido. ¿Significa esto que España es más respetuosa con los derechos humanos que los países últimamente mencionados?. Claro que no. Sólo significa que los ayudantes juristas de dichos países que trabajan en la Comisión admiten más demandas contra sus respectivos países que los españoles. | When I gave the public lectures I speak of later, the judgements of the Court in cases against Spain were only five, four of them declaring violation. Compare this with the 52 cases against Austria, 33 Belgium, 56 France, 28 Germany, 31 Netherlands, 31 Sweden, 24 Switzerland and 67 the United Kingdom. Does it mean that Spain is more respectful with the human rights than the last named countries? Of course, not. | Cuando he tratado de reaccionar contra esta situación, he
recibido "contestaciones" que probaban que el contestante ¡ni sabía
en qué idioma estaba escrita mi carta! No había dado ni una

When I have reacted against this situation, I have received
"replies" probing that the answerer did not know in what language my letter
was written! He has not given a glance to the "replied" letter. This in italics was not said in the letter of 10/26/95 we were seeing. I have tried to make intervene the General Secretary of the Council of Europe, the Committee of Ministers, the Parlamientary Assembly, some Representatives of High Parties (member nations), etc., but all this has been useless. | Parece que mis protestas han contribuido a modificar el Convenio de Roma suprimiendo la Comisión, pero la modificación es defectuosa y por lo tanto es muy probable que el nuevo Tribunal sea una segunda edición de la actual Comisión, y que el nuevo Tribunal no tendrá el alto nivel del actual. Además, tengo 72 años, y no puedo esperar hasta que todos los países miembros del Consejo de Europa ratifiquen la modificaciuón, más otro año. | It seems that my protests have helped to modify the Convention of Roma suppresing the Commission, but the modification is defective and so it is very probable that the new Court will be a second edition of the actual Commission, and that the new Court will be not of such a high level as the actual is. In what respects to the Spanish children and myself, I have lodged 8
applications against Spain. Four of them were returned without even filing
them, someones with the stamp of "Not Registered". The other four have been
inadmitted without any valid reason. For example, the two last ones, exactly
like the Helmers case (212A), similar to the Moreira de Azevedo case (189)
and related to the Golder case (18) have been declared inadmissible ratione
materiæ (for the kind of case), and are exactly like the Helmers case: a

I have other four cases pending of lodging an application, for
which I have asked to the Council a warranty that they will be duly studied by
persons of bona fide, competent, diligent an with a democratic mentality.

In other letters from the Commission I am told that it is not
possible to recusate a member of the Commission, what is against the common
sense and the Convention of Vienna. In brief: For a person with rudiments of
Law the experience of reading the papers issued by the Council of Europe is

Therefore, I request to you, if you are really interested in
human rights, to inform the public opinion of your country and the persons
specially interested in the theme, of what is really happening in the Council
and particularly in its Commission of Human Rights, in order that your
country, by means of the Committee of Ministers, puts a minimum of order in
the said Commission and thus allow me and the many other persons whose human

Pregunto: ¿Es mi caso de carácter individual o de grupo, o de carácter general, referido al funcionamiento de un organismo tan importante para los derechos humanos como es el Consejo de Europa?. Para mayor inri, la carta sigue diciendo que: "La revista es una publicación de escritos científicos" (!?) "sobre derecho comparado, legislación unificada y derecho privado internacional (...). La revista nunca trata de cuestiones políticas. Por consiguiente, no puedo atender su demanda de informar a la opinión pública sobre su caso o de indicarle una persona a quien dirigirse.". Fascinante: las decisiones del Consejo de Europa no son suficientemente importantes como para que su revista se ocupe de ellas, mi petición parece de carácter político, y que los derechos humanos de los niños y de los ciudadanos españoles y -es de suponer- de muchos otros países europeos le importan un pito; 2. The Institut für Rechtsvergleichung of the University of Viena replied to my letter to the Zeitschrift für Rechtsvergleichung telling me that its publication did not "deal with special cases in favour of a single person or group" I ask: Is my case that of individual or group character, or of a general character, referred to the activity of an organism so important for the human rights like the Council of Europe? Still more, the letter follows telling me that "the journal is a publication of scientific" (!?) "papers on comparative law, unified law and private international law (...). The journal never deals with political problems. Therefore, I cannot meet your demand to inform the public about your case or to show a person to be addressed by you.". Fascinating: the decisions of the Council of Europe are not enough important for that its publication deals with them, my request seems to be of a political character, and the human rights of the Spanish children and citizens in general, and -it is supossed- those of many other European countries do not care the said Institut a straw; 2. The ORF suggested me to address myself to Amnesty International, with which I deal in the United Kingdom. About informing to the Austrian public opinion, etc., not a word. Back to the list |

También recibí respuesta de la Nederlandse Vereniging voor Rechtvergelijking explicándome que no están especializados en derechos humanos, sino en derecho comparado. Pienso que el asunto debería interesarles también desde este punto de vista: los derechos humanos vistos desde la Comisión de Derechos Humanos del Consejo de Europa comparados con los mismos derechos vistos desde los diferentes países. Y todavía más: los derechos humanos vistos por la citada Comisión según el país del que llegue la demanda, por ejemplo España o Suecia, es decir el caso Raich, inadmitido, contra el caso Helmers, admitido y presentado al Tribunal, siendo exactamente el mismo caso. La carta sigue informándome que mi carta la remitieron al Nederlands Juristen Comité voor de Mensenrechten, al que ya me había dirigido y que no contestó. Finalmente, recibí una carta de la Advies Commissie Mensenrechten, que parece ser una organización gubernamental, que me dijo muy atentamente que no podía hacer nada al respecto, pero informaba al Ministerio de Asuntos Exteriores y me sugería contactar el Nederlands Juristen Comité voor de Mensenrechten, al que, repito, ya me había dirigido y no me contestó. I also received a reply from the Nederlandse Vereniging voor Rechtsvergelijking explaining me that they are not specialised in human rights but in comparative law. I think that the matter should also interest them from this point of view: the human rights seen from the Commission of Human Rights of the Council of Europe compared with the same human rights seen from the different countries. And still nore: the human rights seen from the cited Commission according to the different countries from which the applications come, for example Spain vs. Sweden, i.e. the case Raich, inadmitted, vs. the case Helmers, admitted and brought to the Court, being exactly the same case. The letter follows informing me that they sent my letter to the Nederlands Juristen Comité voor de Mensenrechten, to which I already addressed myself and which did not reply me. specially to its Commission of Human Rights, to its Parliamentary Assembly,
but even to the mass media, to the protective associations of human rights or
those of the children -included Amnesty International-, and to the juridical
associations or publications don't care a straw (of the shortest and thinest)
the violation of the human rights, not even those of the children. Thus, if you are really interested, you are a "rara avis" ("strange bird") because if the journalist who work in the mass media are not interested in human rights, it means, almost certainly, that the public opinion is neither interested in them. |
