Aisenberg tape battle adds layer

TAMPA -- Lawyers for Steve and Marlene Aisenberg say prosecutors improperly disclosed the contents of surveillance.

The fight over the bugged conversations at the center of the Baby Sabrina case flared again Wednesday as federal prosecutors asked a judge to approve disclosure of the secret recordings.

The U.S. Attorney's office told Hillsborough Circuit Chief Judge F. Dennis Alvarez, who approved the electronic surveillance of Steve and Marlene Aisenbergs, that it was asking his permission to introduce the recordings into evidence. {clipped article due to repetition of previous accounts of this case}

Much of the alleged contents of the recordings already have been made public by prosecutors, said Tampa lawyer Todd Foster. The federal grand jury that indicted the Aisenbergs must have heard the tapes because the indictment contains portions of the alleged recordings, he said.

Even Alvarez wondered aloud why he was being asked now to approve disclosure.

"They've already been disclosed," he told Assistant U.S. Attorney Rachelle DesVaux-Bedke. "And I can't understand why you're asking me to do something that's already been done."

The prosecutor said it hadn't been necessary to seek approval before.

The Aisenbergs are attacking the recordings on several fronts in hopes of having them suppressed in federal court. The couple allege that investigators misled Alvarez into approving the surveillance and that large portions of the tapes are unintelligible.

DesVaux-Bedke told Alvarez that the defense team's objections to disclosure were just another attempt to suppress the tapes.

Alvarez said he likely wouldn't make a ruling before next week.

TAMPA -- Steven and Marlene Aisenberg will face trial in early July in the unsolved 1997 disappearance of their infant daughter, Sabrina, court records show

The Aisenbergs were indicted in September by a federal grand jury in Tampa on conspiracy and false statement charges. They have pleaded not guilty and remain free on bail.

The trial is scheduled to begin JULY 5 at the federal courthouse in Tampa. The charges against the Aisenbergs carry maximum penalties totaling 25 to 30 years for each of them.

TAMPA -- Judge Won't Listen to Aisenberg Tape. A federal magistrate refused Monday to intervene in a dispute over a secretly recorded conversation that prosecutors say implicates Steve and Marlene Aisenberg in the disappearance of their baby.

U.S. Magistrate Mark Pizzo said the issue of the controversial tape is best left to a jury.

The Aisenbergs have been accused of conspiracy and lying to investigators about the Nov. 27, 1997, disappearance of their 5-month-old daughter, Sabrina. They said the baby was abducted, but authorities fear she is dead.

Federal prosecutors say they secretly taped a conversation in which Steve Aisenberg said, "I wish I hadn't harmed her...That was the cocaine."

But the Aisenbergs' lawyer, Barry Cohen insists the tape doesn't contain those words.

A pretrial hearing is scheduled for Feb. 4.

TAMPA -- Defense lawyers renewed their call Thursday for a federal magistrate to independently evaluate secret tape recordings made of conversation between Steve and Marlene Aisenberg.

Prosecutors say the tapes reveal that Steve Aisenberg implied he harmed his 5-month-old daughter, Sabrina, and blamed his actions on cocaine. They said Aisenberg's comments were picked up by a bug planted in the couple's Valrico home shortly after Sabrina was reported missing in November 1997.

The tapes have become pivotal in the Aisenberg's indictment on charges of conspiracy and making false statements in the case.

But the couple's lawyer said this week they can't find the disputed comments on the tapes, and they asked U.S. Magistrate Mark A. Pizzo to review them.

In court papers filed Thursday, the lawyers question prosecutors' intentions and point to at least three unrelated cases in which the conduct of Tampa-based federal prosecutors has been criticized. None involve the government lawyers prosecuting the Aisenbergs

Attorneys for Aisenberg and his wife, Marlene, filed the cassette as part of a motion Tuesday arguing that federal prosecutors have grossly misinterpreted conversations of the couple picked up by secret listening devices.

While transcripts of the tape have been made public, court clerks declined to provide reporters with a copy. On Wednesday, U.S. Magistrate Judge Mark Pizzo issued a directive saying the cassette would not be made public until he has had a chance to look into the matter. An attorney for the St. Petersburg Times said he plans to challenge that decision today.
