Tuesday April 10 Police nab reformasi 3, DPM denies under ISA Leong Kar Yen, Ng Boon Hooi and Susan Loone 7:49pm, Tue: breaking news Three reformasi leaders involved in organising a gathering to mark the sentencing of jailed former deputy prime minister Anwar Ibrahim this Saturday were arrested by police today. The arrests, believed to be under the Internal Security Act (ISA) began with reformasi activist and malaysiakini columnist Hishamuddin Rais who was detained at around 5pm at his office in Bangsar Utama, Kuala Lumpur. He was taken away by plainclothes police officers in two vehicles. Keadilan vice-president Tian Chua, also a key reformasi activist, was arrested at his office in Bangsar at 5.15pm. Chairman of the Committee for the People’s Memorandum of April 14, Saari Sungib, was arrested at his residence in Ampang. When contacted at around 5.30pm, Saari told malaysiakini that a few policemen were waiting for him downstairs while he was getting dressed in his room. According to sources close to Saari and Tian, both the reformasi leaders were detained under the ISA and were believed to have been taken to federal police headquarters in Bukit Aman. Under the Internal Security Act 1960, the Home Affairs Minister can order a person to be detained for a period not exceeding two years without trial as a preventive measure if the minister finds him to be a threat to national security. Not signed In an immediate reaction, Deputy Prime Minister Abdullah Ahmad Badawi told reporters in the Parliament lobby that he has not received any information about the arrests. Abdullah, who is also Home Affairs Minister, said that he has not signed any orders for arrests under the ISA. “Any recommendation for an ISA arrest must be approved by the Home Minister,” he said. When asked whether the police could arrest the reformasi activists first and later request an ISA detention, Abdullah said “no”. No warrant Meanwhile, a source close to Tian said the Keadilan leader was detained at his office by a group of eight police officers. “Tian asked for their warrant of arrest and was told by one DSP Lam that the police needed no warrant as the arrest was under the ISA,” said the source. He added that Tian was driven away in a white Proton Wira with the registration number WHP 862. Saari’s wife Arliza Jaafar told malaysiakini that a nine-member police team arrived at their house at about 5.20pm looking for her husband. “Saari was taking his bath upstairs and when he came down, an officer named Samsudin said they were arresting Saari under Section 8 of the ISA,” she said She said that the police also searched the contents of Saari’s computer and the cabinets in the living room before taking away Saari in a white Proton Wira with the registration number WH 5331. |

Last Tuesday on April 3, 2001, when introducing the Third Outline Perspective Plan (OPP3) (2001-2010), Mahathir had made a most menacing speech, threatening to "break from so-called international norms" to bring "the full force of Malaysian laws" against opposition parties he accused of inciting racial hatred and colluding with foreigners to topple his Government. I had immediately criticised and deplored his speech, asking whether the OPP3 and the National Vision Policy was a prelude to a new Dark Age of gross human rights violations in Malaysia. Now this has come to pass. The use of the ISA to detain Oppositionists marked the sidelining of Datuk Seri Abdullah Badawi as Deputy Prime Minister and Home Minister, as he had staked his reputation so far on not using the notorious ISA to silence the opposition. It is no coincidence that the greater assertion of power by Mahathir comes close on the heel of his statement in Gua Musang responding to Tengku Razaleigh’s call that he remain as Prime Minister and UMNO President until after the next general election that he is prepared to do a KSM - Kerja Sampai Mati - and would remain as Prime Minister, scuttling earlier announcements of retirement from the office during mid-term to hand over the reins of power to Abdullah. FAC News - 11 April 2001 Six Reformists arrested – 9 more being sought As at 11.30pm on Tuesday, 10 April 2001, six Reformasi and National Justice Party leaders have been arrested by the Malaysian police. They are Ezam Mohd Nor, Azmin Ali, Saari Sungib, Tian Chua, Hishamuddin Rais and Malek Hussin. Tian Chua and Hishamuddin were arrested at 4.30pm, Saari at 5.45pm, and Malek at 6.15pm. There is no confirmation on what time Ezam and Azmin were arrested but it is said to be around the same time. It was reported that Ezam was arrested at the Kuala Lumpur airport as he was about to board the plane for Penang. The family, however, has lost contact with Ezam who never arrived in Penang though he was seen entering the airport. It is not known what they were arrested for but early reports indicate it is under the Internal Security Act (ISA). However, Deputy Prime Minister Abdullah Ahmad Badawi, who is also the Home Minister, refuses to confirm this. It is believed another nine are being sought by the police though the full list is not yet known. Other reports say a total of 97 may be arrested and many of the activists have gone into hiding. Saari Sungib is the Chairman of the "Defend Human Rights Committee" that is scheduled to hand over a Memorandum to the Human Rights Commission (SUHAKAM) on Saturday, 14 April 2001. Tan Sri Musa Hitam, SUHAKAM’s Chairman, has confirmed that he would receive the Memorandum on behalf of the Commission. The other Committee Members of the "Defend Human Rights Committee" are Norazimah Mohd Nor, Nasir Md Isa, Azwandin Hamzah, Tan Soi Kow, and Fadil Hj. Abu Bakar. Selepas Mesyuarat Pemuda Barisan Alternatif sekitar jam 3.00 petang tadi, saya telah diekori oleh 2 orang anggota Cawangan Khas dengan menaiki kereta Toyota SEG 1.6 dengan nombor pendaftaran Johor. Bila saya mengejar kenderaan tersebut mereka melarikan diri. Sekitar jam 5.00 petang sewaktu di Ibu Pejabat KeADILan, mereka telah menghantar kumpulan yang lebih besar untuk mengepung saya, Alhamdulillah sekali lagi saya berjaya keluar daripada bangunan tersebut dan menuju ke Plaza tol Damansara. Mereka yang menyedari kehilangan saya telah mengejar saya dengan mengunakan motosikal RXZ dan Proton Wira. Peringkat awal agak ramai yang mengejar, tetapi bila sampai di plaza tol Damansara cuma tinggal 4 buah motosikal dan sebuah kereta proton wira berwarna hitam sahaja. Nasib saya baik, kereta saya yang sering meragam hari ini bisa memecut sekitar 160 – 175 km sejam hari ini. Bayang mereka hilang selepas saya melepasi Tanjung Malim. Ketika sedang berlumba dengan anggota cawangan khas tadi, barulah teman-teman daripada pihak keselamatan memaklumkan tentang operasi “Bangsar” yang mereka lancarkan dan siapa yang diburu. Bengang betul dibuatnya, dah kena hambat baru dia orang beritahu, nasib baik beg baju untuk ke program ceramah setiap hari masih banyak di dalam kereta. Teman tersebut memberitahu bahawa sasaran kali ini seramai 9 orang iaitu, Tian Chua, Hishammuddin Rais, Shaari Sungip dan Ezam yang sudah diangkut serta Malik Hussein, N. Gobalakrishnan, Khalid Jaafar , Ruslan Kasim dan saya yang masih diburu. Lewat petang tadi Gobala pula ditahan di Langkawi. Sekitar jam 7.15 petang, satu lagi panggilan diterima, kali ini daripada Cawangan Khas Bukit Aman. Saya mula pening, maklumat terkini yang diberikan agak berbeza dengan maklumat awal. Malaysia uses tough security law to hold activists, arrests continue KUALA LUMPUR, April 11 (AFP) - Malaysian police using a draconian security law have detained at least seven opposition supporters to derail planned protests in support of jailed politician Anwar Ibrahim, activists said Wednesday. They said arrests continued Wednesday with the detention of Raja Petra Kamarudin, director of the FreeAnwar campaign. National police chief Norian Mai late Tuesday confirmed three arrests under the feared Internal Security Act (ISA), which allows indefinite detention without trial. On Wednesday morning he declined further comment, saying full details would be given at a press conference at 2 pm (0600 GMT). "It's a draconian law which they are using to stifle dissent," said Chandra Muzaffar, deputy president of the National Justice Party (Keadilan) headed by Anwar's wife. "Keadilan has been singled out (in the arrests) in an attempt to crush the party." Norian said Tuesday night that those arrested under the ISA were Keadilan vice president Tian Chua, a member of its policymaking council Saari Sungip and activist Hishamuddin Rais. Saari headed the organising committee of a meeting planned for Saturday, April 14 or "Black 14" -- the second anniversary of the sentencing of ex-deputy premier Anwar to a six-year jail term for abuse of power. Also arrested under ISA, according to opposition sources and local media reports, were Keadilan youth wing leader Ezam Mohamad Noor, Ezam's deputy N. Gobalakrishnan, Anwar's former private secretary Azmin Ali, and Raja Petra. The Malaysian People's Party (PRM), part of an opposition alliance, said Malik Husin -- an activist in the Reformasi (reform) movement sparked by Anwar's arrest -- was also detained. There was no confirmation of this report. It was the first widespread use of the ISA against political figures since Anwar himself and numerous supporters were detained in September 1998. "It appears that the present crackdown has not ended yet," said PRM president Syed Husin Ali in a statement. "We are informed that the police are still looking for others to be arrested." Syed Husin said Deputy Premier and Home Minister Abdullah Ahmad Badawi appeared to have been unaware of the planned crackdown. Syed Husin called for clarification on whether Prime Minister Mahathir Mohamad personally ordered the arrests. Last week Mahathir accused opposition parties and their "foreign sympathisers" of trying to topple his government through street violence. The government was ready to break from "so-called international norms" to preserve peace, he said. Mahathir's former protege Anwar is serving a 15-year jail term after being convicted in separate trials of abuse of power and sodomy. Anwar says he was framed on the orders of Mahathir because he was seen as posing a political threat to him. Mahathir says he sacked Anwar in September 1998 for immorality and denies interfering in the judicial process. Opposition supporters planned to gather outside the city centre office of the national human rights commission on "Black 14" to present a memorandum on Anwar's case. Menurutnya, Ghani ditahan sekitar jam 10.30 pagi oleh lima anggota polis berpakaian biasa. ISA arrests - families to protest to Suhakam 1:55pm, Wed: The family members of four reformasi activists who were detained under Internal Security Act yesterday are seeking to lodge a complaint with the Human Rights Commission (Suhakam) on the ‘severe’ violation of their rights. The family members of Saari Sungib, Mohamad Ezam Mohd Nor, Tian Chua and Raja Petra Kamaruddin said today they were shocked that the police did not even bother to inform them of the arrests. “We had to find out about what had happened through rumours and newspaper reports. We have been frantic with worry,” they said in a press statement. They said the police have refused to allow them to visit the four adding the police also dismissed questions as to where they were being detained. “We ask Suhakam to call for their immediate and unconditional release or ensure we have the right to visit our loved ones,” they said. The statement were signed by Ezam’s wife, Bahirah Tajul Arif, Raja Petra’s wife, Marina Abdullah, Saari’s wife, Aliza Jaffar and Tian’s fiancé Au Mei Po. However, they were unable to hand in their petition to Suhakam this morning as none of the commissioners were available. However, they were told that commissioner Mehrun Siraj will receive their complaint at 2pm. Keadilan vice-president Chua, Youth chief Ezam and chairman of the Committee for the People’s Memorandum of April 14, Saari, were arrested by police late yesterday’s afternoon. Wednesday April 11 Opposition, reform groups condemn arrests Tong Yee Siong 2:59pm, Wed: The police detention of five key reformasi leaders and activists under the Internal Security Act (ISA) yesterday has met with strong condemnation from the opposition and various reform groups in the country who have called for their immediate release. Parti Rakyat Malaysia (PRM) chairman Dr Syed Husin Ali said today the arrests were a “political move to silence the opposition and dissent,” adding that those arrested should be released or charged in court immediately and not be detained under the ISA which does not require a trial. He said in a press statement the order for the arrests could have come from an authority higher than Deputy Prime Minister and Home Affairs Minister Abdullah Ahmad Badawi as he (Abdullah) had no knowledge of arrests beforehand. “Abdullah said in a news report yesterday he did not know about the arrests and he is the only one authorised to issue an order to make such arrests. If he did not approve such arrests, who did? Was it the prime minister?” said Syed. The PRM chairman was referring to the arrests by police yesterday of Keadilan vice-president Tian Chua, Youth head Mohd Ezam Mohd Noor, Youth assistant-secretary N Gobalakrishnan, film maker and malaysiakini columnist Hishamuddin Rais, and reformasi activists Saari Sungip and Malek Hussin. Menacing speech DAP national chairman Lim Kit Siang, in his statement said the latest crackdown proved that Abdullah is being sidelined in the government. “The use of the ISA to detain reformists marks the sidelining of Abdullah, as he had staked his reputation so far on not using the notorious ISA to silence the opposition,” he said. Meanwhile, Malaysian Democratic Party (MDP) secretary-general Wee Choo Keong also condemned the police for the ISA arrests, although he added MDP does not support “violence or street demonstrations to topple the duly elected government”. “The home minister declared a few months ago that the government will not use the ISA to detain its critics or leaders of the opposition. If the police have evidence of reformasi activists having committed offences, then they should be charged in court,” he said in a media statement. |
ISA allows indefinite detention, leaves victims 'helpless' Simon Martin 3:04pm, Wed: (AFP) - Malaysia's Internal Security Act (ISA), a relic of the battle against communist guerrillas half a century ago, was once described by a critic as the "Indefensible Suppression Apparatus". Rights groups and opposition politicians have campaigned vociferously for the repeal of the 1960 Act, which superseded pre-independence legislation, and of other laws which allow detention without trial. Prime Minister Mahathir Mohamad and his predecessors have used the act repeatedly to detain opposition supporters and others deemed to be a security threat, as well as suspected criminals. Late yesterday and today at least seven opposition supporters were detained under the ISA in advance of planned weekend protest meetings in support of Mahathir's jailed former deputy Anwar Ibrahim. Police can detain and interrogate suspects for 60 days. After this the home affairs minister must sign an order authorising the detention and stating reasons for it. The order is issued for a two-year period but can be renewed indefinitely. "Security authorities sometimes wait several days after detention before informing an ISA detainee's family," said the US State Department's human rights report issued February. The total number currently held under the ISA is not known. The State Department cited a local human rights group as saying that as of Nov 30, there had been 76 detentions under the ISA during last year. Operation Lallang Veteran opposition leader Lim Kit Siang, now chairman of the Democratic Action Party, was detained under ISA for 17 months in 1969 and for 18 months in 1987, when Mahathir launched "Ops Lalang" (Operation Lallang). About 107 people, including opposition supporters, were detained under Lalang. A period of racial tension was cited as justification. ISA was also used in 1990 during a period of strained relations between Kuala Lumpur and the-then Sabah state government. Later in the 1990s members of the Darul Arqam religious movement were held. On Sept 20, 1998, police broke down Anwar's front door and detained him for three weeks under ISA before filing criminal charges. Some 27 supporters were also held. Lim said this week's use of the ISA was "completely unwarranted," saying opposition supporters were planning a peaceful gathering this Saturday to mark the second anniversary of Anwar's sentencing to six years for abuse of power. He said that authorities "seem to be looking for an excuse for a crackdown ... there is a sense that he (Mahathir) is losing control and unable to regain support." Lim speculated that Mahathir's deputy Abdullah Ahmad Badawi, who is also home minister in charge of police, had opposed the use of the act. Physical abuse He said for the first 60 days detainees could be denied lawyers. "For the first two or three weeks they (police) see if they can break you," he said. "There was no physical abuse in my case but sometimes there have been serious cases of torture. "You are helpless, of course." SUHAKAM Akan Bermesyuarat- Laporan dari Harakahdaily Laporan Terbaru - 4.40 pm Suruhanjaya Hak Asasi Manusia (Suhakam) akan mengada mesyuarat (dalam waktu terdekat) berhubung siri penangkapan beberapa pemimpin pembangkang dibawah Akta Keselamatan Dalam negeri (ISA). Setiausaha Suhakam, Kamaruddin Muhamed Baria memberitahu Harakah mesyuarat itu " dijangka dipengerusikan oleh Tan Sri Musa Hitam sendiri". Bagaimanapun beliau enggan mengulas lanjut berhubung siri penangkapan ISA yang bermula sejak semalam. "Sebarang keputusan akan dibuat selepas mesyuarat ini yang akan diadakan dalam tempoh 24 jam dari sekarang," tegasnya. Beliau juga mengesahkan Suhakam telah menerima pengaduan yang dibuat oleh isteri-isteri tahanan termasuk isteri Ezam Mohd Noor, Puan Bahirah Tajul Aris mengenai isu tangkapan ini. Katanya aduan itu juga akan dibincangkan dalam mesyuarat yang sama. Beliau menambah antara isu yang dibangkit oleh isteri-isteri tahanan ialah mengenai kesihatan suami mereka. "Isteri Ezam sendiri mengadu bahawa Ezam kurang sihat manakala keluarga Tian Chua mengadu beliau mengidap lelah," jelas beliau. Selain itu jelasnya mereka meminta Suhakam membantu mereka untuk menemui suami masing-masing. "Sekiranya mereka tidak dapat bertemu mereka meminta Suhakamlah yang bertemu," kata Kamaruddin. Ditanya mengenai memorandum berhubung 'Hak Asasi Manusia' yang bakal dihantar kepada Suhakam 14 April ini, beliau berkata, Suhakam bersedia menerimanya. Menurut polis "ketujuh tujuh penyokong reformasi ditahan kerana ada maklumat mengenai pembabitan mereka dalam satu aktiviti yang boleh membahayakan keselamatan negara. Kenyataan polis juga menyebut mereka yang ditahan " bercadang mengadakan demonstrasi jalanan dengan cara militan sebelum pilihanraya umum 2004". Beberapa pertubuhan termasuk parti pembangkang, badan bukan kerajaan dan aktivis hak asasi bercadang mengadakan perhimpunan aman dan menyerahkan satu memorandum kepada Suhakam Sabtu ini. Sabtu ini ialah ulang tahun kedua hukuman penjara Datuk Seri anwar Ibrahim. Ia dikenali sebagai Black 14.
