Some passages from Eugene's letter of April 11th, 2001:
”I had plan to wait till I got back to level # 1 to type you, but yesterday the Administrative Segregation Committee decided to keep me on level # 2 for another 90 days. (1*) Why I have no idea, they did not take me before a board, they sent me a piece of paper telling me they decided to keep me on level # 2 till July 10th, 2001. I wanted to cry and scream at the same time, I haven't been in any more trouble. This level # 2 is nothing but torture, they are starving us, when it was cold, they froze us. Now it's hot and we are burning up and they are starving us. I have lost over 15 pounds. And today for whatever reason, the authorities put us on another lock down,
(2*)that mean we will only be allowed to shower every 3 days, they give us what they call johnnies, it's usually a couple of sandwiches in a brown paper bag, three times a day". (3*)
In another letter sent to an Italian friend on May 2001, Eugene wrote: “I'm again on the level # 2. They moved me in between two crazy men, one play in his feces and urine, he wipes it all over the walls and door so it stinks all the time, and another is an exhibitionist he's always masturbating in front of the female officers............. My hand is killing me, so I'll shut up here."
Another letter from Eugene, dated July 8th, 2001. Among other things he says:
”Some officer have come in the building with some hot barbecue, it smells delicious. And it cause me to realize just how hungry I am, this is pure torture. Yesterday during a shake down, a cell search, this officer that was in the cell took 2 of my magazines he just threw them out of the cell, when I protest, he said I couldn't prove they were mine. When I proved that they was mine, than they came up with this old rule about you can't have more that 3 magazines only 90 days old. It was nothing I can do. I can file a grievance it'll take 30 days to get a response in the bottom line, they will support the officer. I am here, no TV, no one to talk to etc. And they are suppose to ask us do we want to send this or that home or have it destroyed, not just throw our things out like that. It's hard being here, my friend”
(1*) See Rules in Texas prisons to have more information.
(2*) A lock-down is a high-security situation that occurs when there are serious problems within the prison.
(3*) Eugene sent me a complaint against the Texas Department of Criminal Justice in which he, after a lot of requests, hasn't received response from any prison superintendent about the reduction of food, from 2 breads three times a day to 3 crackers. No one answered.
(4*) See the document Why Eugene might have a new trial to have information about Walter Quijano's testimony.

Another letter I received from Eugene:
"I would had responded immediately to your last letter but the truth is I just have not been in a writing mood, still not. I've been stressed out and that's not helping my diabetes I need to get my medication. Being on this level # 2 the authorities are starving us and they are doing a lot of strip searches and cell searches every day and if they find us with a little stash of food they take it and in some cases write us up for contraband. As for as my appeal is concerned, the federal judge gave her final judgment saying that everything that happened in my trial was fair and just. This mean the court says again I am guilty of this robbery and murder. But said because of what the psychologist Walter Quijano testimony, who said I would be a danger to society because I am black. (4*) That's the only reason that I was given this new sentencing phase trial. And the only thing can happen out of this is to get a life sentence (I.e. a life imprisonment sentence) or sentence back to death. I will never be free again, not alive. I hate to tell you this but it's the truth. The only thing I can hope for now is a life sentence, if I am given death again they will kill me if that moratorium (5*) isn't approved …."
A letter from Eugene he wrote on January, 2002:
"One of my friends, Vincent Cooks, was executed on December 12th and when I learned that they had murdered him as plan, it was like all the energy I had went out of me and I tried to fight back tears. I wanted to go mad, but what could I do, it was nothing I could do. His execution depressed me to say the least. And already there have been two executions this year Michael Moore on January 9th and Jeman Arnold on the 16th and two more are scheduled for this month Windell Broussard for the 30th and Randall Hafdohl for the 31st.
(6*) I know Broussard pretty well too... There was not a Christmas spirit here at all. This was the first Christmas where we wasn't served a traditional Christmas dinner. They gave us some cold nasty sandwiches ... They just started selling us ink pens again, from September till mid December we couldn't get ink pens and you see all the stamps on my envelope, well the people here will not order any 80 cents stamps (overseas mail cost 80 cents) so we have to buy only 1 cent or 34 cents stamps"
(6*) Number of executions carried out in the Livingston prison: 1997: 37 - 1998: 20 - 1999: 35 - 2000: 4040 - 2001: 17 - 2002: 33 - 2003: 61 So far in 2002, 71 executions have been carried out in the United States, half of which have occurred in Texas. In this document you'll find further information.
