"This indenture made and intered into this 19th day of
December 1848 between Martin Callahan and Elizabeth his wife of
the first part and Tyree Callahan of the other part, both of the
county of Campbell and the state of Virginia, witness that the
said Martin Callahan and Elizabeth his wife, for in consideration
of the sum of eighty dollars lawful money of Virginia, to them in
hand paid by the said Tyree Callahan, the reciept thereof they do
hereby acknowledge, hath granted, bargained and sold and by there
presents, doth grant, bargain, sell and convey unto the said
Tyree Callahan, his heirs and assigns all the interest they have
in and to a certain Tract or parcel of land, lying and being in
the County of Campbell, containing about one hundred and five
acres and is the same land willed by Martin Mason to Levinia
Callahan, the mother of the said Martin Callahan, and the heirs
of her body, To have and to hold the aforesaid interest in the
track or parcel of land aforesaid, together with all the
appearances thereto belonging to him the said Tyree Callahan his
heirs and assigns to the only proper use and behave of the said
Tyree Callahan his heirs and assigns forever, and the said Martin
Callahan and Elizabeth his wife, for themselves, their heirs,
________, and administrators doth hereby covenant and agree to
and with the said Tyree Callahan his heirs assigns, that they the
said Martin Callahan and Elizabeth his wife the interest
aforesaid in the land aforesaid with its appearrances unto him
the said Tyree Callahan his heirs and assigns against them the
said Martin Callahan and Elizabeth his wife and theirs heirs and
against all persons whomever shall and will by these presents
forever warrant and defend in witness thereof the said Martin
Callahan and Elizabeth his wife hath here unto set their bonds
and affixed their seals the day and year above written."
