EXT. ALPINE SHERIFF DEPT. BLDG
INT. SHERIFF MONROE'S OFFICE
Sheriff James Monroe receives a phone call from the
Alpine City Coroner Dr. Cindy Blades.
JAMES
Hello, this is Sheriff Monroe....
DR. BLADES (VO)
Yes Sheriff Monroe, this is Dr. Blades at the
Coroner's office, nice to have you back. Did
Maxine bring you up to date on current events?
JAMES
You mean the massacre?
DR. BLADES (VO)
Yes Sheriff. We need for you to
come down to the office and sign
some papers AND PICK UP
THE MACHINE PISTOL.
JAMES
Machine pistol?
DR. BLADES (VO)
Yes, I thought you knew .... the shooter
used a Mac 10 9MM-machine gun.
The gun is not registered as a machine
gun and the ATF is all over us to get
it to you for safekeeping.
JAMES
Why didn't you just give it to the
Feds?
DR. BLADES
They said you have to keep it until after
the hearing is over.
JAMES
Ok, I'll send over one of my deputies to
pick it up. Ok, talk to you later.
He calls to one of his deputies in the squad room and slams
the phone down Maxine walks in and gives him a cup of coffee
and a pecan roll.
MAXINE
You called ........
JAMES
(upset)
Maxine when I leave you in charge I expect you
to go by the book, but it looks like you screwed up!
MAXINE
(In shock)
Screwed up? I DON'T UNDERSTAND!
JAMES
Why the hell did you leave the murder weapon
with the Coroners office, you know damn
well this is evidence and should come to this
office?
MAXINE
Bullshit Jimmy, I personally checked the
Mac 10 into our property room last night.
JAMES
(surprised)
You did? Something is not right! How the hell
can we have two murder weapons for one
shooter?
MAXINE
Maybe he used two guns?
JAMES
Yeah right ....... have you ever shot a Mac 10
9MM in full auto, it keeps both hands busy .......
so I don't think so ..........
MAXINE
Your implying there was a second shooter?
JAMES
It's possible, .........
MAXINE
We found no evidence of a co-conspirator
or anything else, ........
JAMES
Who claimed the body of Mr. Mason?
MAXINE
His brother ........ hang on a minute let me get the
report.
Maxine rushes down the hallway and opens a file cabinet in one of the
storage rooms and pulls a report.
MAXINE (Cont.)
Here it is, ....... his brother Norm Mason made the
identification.
JAMES
(looking at report)
What about his wife, or ???
MAXINE
I briefly talked to Norm Mason and he said
he's the only living relative his brother
had.
JAMES
Was he aware that his brother was in possession
of an un-registered full automatic weapon?
MAXINE
He told me his brother was a gun nut and
toured the country buying guns at Gun
Shows, ......... Why?
JAMES
Did he say whom he purchased the Mac 10 from?
MAXINE
(looking in the folder)
We found a bill of sale on the Mac 10 we have
in the property room.
(handing a bill of sale to James)
JAMES
(showing a very surprised look
on his face)
This can't be right!
MAXINE
Why, what's wrong?
JAMES
Tyler Monroe of Lake Geneva Wisconsin
is the seller shown on this bill of sale,
this can't be right!
MAXINE
I noticed it was a Monroe, but I didn't
think it was any relation to you.
(submissive tone)
I guess I should have questioned it......
You know what Jimmy, .......don't
leave me in charge next time, it's
to much pressure being in charge.
JAMES
Don't worry about it, ok ..........
I have to make a phone call.
CUT TO:
INT. SHERIFF MONROE'S OFFICE
James Monroe is on the phone talking to Mary Jo Monroe in
Lake Geneva Wisconsin.
JAMES
Hello, hi Mary Jo, this is James
..... may I speak to Tyler ......
MARY JO (v.o.)
He's not here Jimmy, .......he's at a
gun show in Green Bay, he should
be back on Sunday night, why is there
a problem?
JAMES
How long has he had guns as a hobby?
MARY JO (v.o.)
Since he was ten years old, why what has
he done?
JAMES
We have had a mass murder here in Alpine
and one of the guns was last registered to
Tyler.
MARY JO (v.o.)
(very upset)
Oh my God ....... I just knew he was going
to get into trouble having guns as a hobby!
JAMES
Don't worry yourself over this, the only
thing illegal is the Mac 10 was converted
to full-automatic fire. Is he a gunsmith?
MARY JO (V.O.)
Why yes he is, I guess he can fix just about
anything.
JAMES
Call me when he gets back ok, and please
don't worry, I'll fix whatever needs fixing.
James hangs up the phone and stares at the wall. The phone
buzzes and he picks up the com-line.
JAMES (Cont.)
Yes ....... yes send him in.
A tall man in his mid forties walks into the sheriff's office
and reaches out to shake his hand.
AGENT
Sheriff Monroe I'm Agent Joe Wells with the ATF
and I need to talk to you about the multiple
murders.
JAMES (Cont.)
Yes, please sit down .......
(Agent Wells pulls up a chair)
So, what can I do for you?
WELLS
We examined the mac 10 in your property room
while you were out of town and I need for you
to be aware of the findings. The gun in question
was originally a semi-auto version and someone
converted it too full automatic. Also are you
aware it had a suppresser attached?
JAMES
It wasn't mentioned in the report .........
WELLS
That's because it was stuffed in the mail
slot where the killings happened. Again,
this device was made up of parts, and I
may say very skillfully we need to talk
to this Tyler Monroe, I understand he's
you nephew ......
JAMES
(visibly shaken)
Yes I'm afraid he is, but how do you
know he did the conversion?
WELLS
The agent responsible for Lake Geneva has
come up with a next door neighbor who
witnessed Tyler Monroe fabricating a
sub-machine gun and suppresser.
JAMES
What do you want me to do?
CUT TO:
EXT. LAKE GENEVA WISCONSIN - ESTABLISHING DAY
EXT. LAKE GENEVA SUMMER HOMES -
EXT. AUNT MARGO'S TWO STORY SUMMER HOUSE
James and Agent Wells get out of the truck and walk up to the front door of the summerhouse. He starts to insert the key
then stops and pulls it back from the lock. He push's the
doorbell.
MARY JO
Hi James, we have been expecting you.
James and Wells walk-in and sit down on the couch and James
makes make the proper introductions. Tyler is sitting in
an easy chair and Mary Jo sits down next to him.
JAMES
Mary Jo and Tyler this is Agent Wells of the
Bureau of Alcohol, Tobacco and Firearms
US Justice Department. He want's to ask Tyler
some questions. Agent Wells ......
WELLS
I will have to record this deposition so
my notes will match up. Ok. Tyler have
you ever converted a semi-automatic
weapon to full automatic? And if you have,
how many?
TYLER
Before I say anything, I want an attorney.
WELLS
I'm not arresting you for anything, I just
need some information.
TYLER
No comment.
WELLS
James, I will have to file complaints with the
Justice Department to have Tyler taken in and
a search warrant covering this house.
MARY JO
James, is this really necessary?
JAMES
Mary Jo they have a witness who has observed
Tyler converting weapons. I'm afraid we will
have to take him in ...........
TYLER
Ok, what do you want to know?
WELLS
How many semi-automatic weapons have you
converted to full-automatic fire?
TYLER
I don't remember how many, but I converted
at least fifty.
WELLS
To the best of your memory.
TYLER
Thirty AR-15's, ten AK47's, ten UZI's and
more Mac 10's than I can remember.
WELLS
How many silencers did you fabricate?
TYLER
Hundreds ............
WELLS
What did you sell the converted weapons for?
TYLER
Two thousand for the AR 15's, fifteen hundred
for the AK's and three thousand for the UZI's.
WELLS
How much for the silencers?
TYLER
Two thousand each.
WELLS
Did you know it was illegal to do conversions
without a class three manufacturers license?
TYLER
I needed the money ........ we just couldn't
make it on my mothers salary.
WELLS
What did you do with the money?
TYLER
I gave it to my mother, and told her it was
from fixing guns.
Mary Jo breaks down and starts to cry, James comes over to
her side. There is a knock at the door and James walks over
and opens the door. An ATF Agent hands a search warrant
to James and six men walk in.
WELLS
To prevent your house from getting
torn up, I suggest you show the
agents where Tyler's Workshop
is located.
TYLER
That isn't necessary, I'll show
you all that I have.
Tyler leads the agents down to his workshop in the
basement of the summer house.
MARY JO
James, will Tyler have to go to jail?
JAMES
It looks very bad for Tyler, ...........
CUT TO:
EXT. SKYLINE OF GREEN BAY WISCONSIN - ESTABLISHING DAY
CITY COURTHOUSE
INT. US MAGISTRATE COURTROOM
The judge walks into the courtroom and the bailiff shouts.
BAILIFF
All rise, the Honorable CHARLES BUSH
presiding in and for the State of
Wisconsin.
Judge Bush sits down and strikes his gavel.
JUDGE BUSH
In reviewing all of the facts on
both sides, I have come to the
point where I will need to
address Tyler Monroe. So I
call him to take the witness
stand.
Tyler Monroe is sitting with his mother and his attorney Douglas
Katz. He gets up and walks over and sits down next to Judge Bush.
JUDGE BUSH (Cont.)
Mr. Monroe are you aware of the serious
charges that have been leveled to you.
Eighty-two counts of manufacturing class
three weapons without a license and
selling them without a class three
sale license. Also two-hundred and
five counts of fabricating and selling
silencers. (Pause)How do you say, do
you plead guilty or not guilty.
TYLER MONROE
Not guilty your honor.
There is a roar from the crowd and the judge slams the
gavel sown on his desk plate.
JUDGE BUSH
Order !!!!!!
Douglas Katz stands up and waves to the judge.
KATZ
(emotional)
Your honor may I address the court
on my clients plea.
JUDGE BUSH
Yes by all means .........
KATZ
Your honor and people of the jury, I
have instructed young Tyler Monroe
to plead not guilty, because of the
following reasons. Tyler's father
left the family when he was born.
He's had no father image since birth,
also he was blinded by his deep deep
need to help his mother. He knows
how serious the charges are but he's
sincerely sorry for everything that
has happened.
The courtroom is a scene of heavy dialog between the witnesses
the BATF has brought in. Witness after witness is hammering the
nails on Tyler's coffin, after the tenth day of deliberation the
judge calls the foreman of the jury.
JUDGE BUSH
Foreman of the Jury, have you come to a
decision..
JURY FOREMAN
Yes we have your honor, and we find the
defendant guilty on all counts.
Tyler breaks down and starts crying.
JUDGE BUSH
Tyler Monroe, do you have anything to
say in your defense, before I pass
sentence.
TYLER MONROE
No sir your Honor.
JUDGE BUSH
Due to the circumstances of the multiple
killings in Alpine Wisconsin, I will
tag a special circumstances because
full auto weapons were used in the
commission of a capital crime. Tyler
Monroe I sentence you to be remanded
to the Juvenile Court until you are
eighteen. Then you will spend ten years
in the federal penitentiary, each count
carries ten years or $10,000.00, or
both and if you add all the counts up,
it totals over 600 years. The court
makes every effort to keep this type
of weapon or weapons off the street.
Because of all the tension Mary Jo faints and falls on the
floor of the courtroom. Sheriff Monroe runs to her side
and picks her up in his arms. The judge looks down and
points to his chambers.
JUDGE BUSH
Council, you can take her to my chambers
until she comes around.
Sheriff Monroe carries the unconscious Mary Jo to the Judges
Chambers and lays her down on the leather couch. He breaks
open an ammonia stick and passes it by her nose. She wakes
up in a start.
JAMES
Sorry Mary Jo, I didn't mean to get
so close to you with smelling salts!
MARY JO
(very emotional)
Do something Jimmy, don't let them put your
son in jail!
JAMES
(in shock)
Wait just a minute Mary Jo, you said
my Uncle Tyler was the father! Now
what is the truth!!!!
MARY JO
Your Uncle Tyler was sterile all his
life, that's why they had no children.
I told you that fable because I thought
it would ruin your marriage and I didn't
want that to happen. Damn, he's your
flesh and blood, do something!
The Judge walks into the room and sits down at his large
leather chair.
JAMES
(Pleading)
Your Honor, under the circumstances the
time spent for Tyler in Juvenile Hall and
then in the Federal Penitentiary is going
to destroy this fine young man. He has
been given a Scholarship to BYU and he's
planning on becoming a surgeon. Please
give him probation, I will make sure he
never touches a gun again.
JUDGE BUSH
I understand he's your nephew, Sheriff
Monroe?
JAMES
Well, ....... first I was told he was my son
then ........ my nephew, now again I was
recently told he's my son.
JUDGE BUSH
(looking at Mary Jo)
Well what is it my dear, is he or is he
not your sons father.
MARY JO
(still crying)
Your honor, Tyler is James son.
JUDGE BUSH
How do you feel about Tyler going to
jail for the next ten years?
MARY JO
Why do you think I'm crying ........
JUDGE BUSH
As far as I'm concerned we have a young
man that is lacking any kind of supervision
so the state and federal government will
have to do that for you.
MARY JO
Your honor, there were many extenuating
circumstances your not aware of .....
JUDGE BUSH
Stop right there young lady, if someone
had been watching this kid, he would not
be going to jail for the next ten years.
JAMES
(VERY TENSE)
You remand him into my custody and
I will give you insurance that he will
be fully supervised ......
Guaranteed!
JUDGE BUSH
You know Sheriff if we didn't have guys
like you to do all the dirty work, we
wouldn't have a job, so I have nothing
but respect for you. Due to the age of
the young man, I will take a special
suspension of the sentence under
advisement with the agreement Sheriff
Monroe has custody of Tyler Monroe
until the age of twenty-one, then we will
revue the case again. But before
I make my final decision, this case
will go to advisement from federal
authorities. For now, Tyler is
in the custody of Sheriff Monroe
and he will stay that way until you
hear from me. I want Tyler to spend
the weekend in my jail to give him
a taste of what jail is really like.
You may pick him up on Monday morning,
unless you hear from me first. Now
good-day to both of you and have a
nice weekend.
