Healthcare Staffing - Information for Nurses

U.S. Employers face perennial, recurring or cyclical staffing shortage problems:

USHR provides its U.S.-based client employers creative and tested solutions.

Foreign nurses must have either an IMMIGRANT or WORKING visa to be admitted to the U.S.  In either case, the petitioning employer must be willing and able to sponsor the said foreign nurses to the U.S. in the appropriate visa category:

A nurse could be sponsored under the H-1B category only if the job being offered would be categorized as a specialty occupation, meaning the job requires a baccalaureate degree.  This could include Director of Nursing, Nurse/Shift Supervisor or Manager, Nurse Instructor.  The H-1B visa is valid for 6 years.

Hospitals or facilities located in areas with a shortage of Healthcare workers are eligible to sponsor nurses under the H-1C category.  The U.S. Department of Health and Human Services is responsible for identifying disadvantaged areas.  Five hundred (500) visas are available for this category yearly for the entire United States, regardless of the country of origin of these nurses.  The H-1C visa is valid for three (3) years.

Nurses may be petitioned under Section 203(b) of the Immigration and Nationality Act.  To petition a nurse for this employment-based immigrant visa (known as EB-3 visa), the sponsor must be able to offer immediate full-time permanent employment for the nurses. 

The processing time for EB-3 petitions is longer (between 12 and 20 months) than that of either an H-1B or H-1C petition (which takes 5-10 months).  However, nurses with EB-3 immigrant visas are immediately eligible to work.

Employers who wish to sponsor qualified and eligible healthcare workers (e.g., registered nurses, occupational and physical therapists) into the United States as immigrants may get in touch with us either in the Philippines or the U.S..  

We at USHR assist our client in filing the requisite documents with the U.S. Department of Health and Human Services, Department of Labor and Immigration and Naturalization Service (INS).  As direct representatives, USHR advertises for nurses, conduct initial interviews and validate documents submitted by the would be nurse-immigrant.  U.S.-based sponsors have the option of either interviewing the applicants personally – in which case USHR shall provide the venue and support services – or give USHR the authority to pre-qualify and/or accept the applications of healthcare workers for sponsorship.  In the former case, petitions are then filed after candidates are interviewed and selected by the sponsor's representative.
