it is easier to defend your case than file a case and win. when you make an allegation against some one the onus of proof is on you and it is difficult in the normal course of things. it becomes all the more difficult when the covert operations are being carried out by a govt. agency and it becomes impossible when you are fighting the under cover agents or spies (to call a spade a spade) i have tried provoking my friends a bit but the spies did not take the bait and things were dragging on.

so ultimately i filed a petition with the national human rights commission of india. that was in 2001. here is a copy of it

the commission promptly ordered an enquiry and tragedy of all tragedies it was another police man who was entrusted with the enquiry. the result as far as i know was that within no time there was a complaint filed in the local police station against me by the locals - i think the allegation was that i am a public nuisance. the police men sent a local goonda to tell me that i have to be present in the medical collge police station on one saturday. i told him to mind his own business and this "gentle man police man's gentleman" used vulgar language and went off.

there were a number of attempts later as well to get me implicated in a criminal case. to get me involved in an altercation, one of the local goondas was sent to my place to abuse me. the immediate provocation was that i had started my motor bike at 10.15 pm in the night. it had some problem and i had set it right and was just trying it out to see that every thing was alright to make the journey to the college 10 kms away in the morning. i kept mum and recorded his utterances on my voice recorder and still have it with me. but there is no point nothing will happen. the whole show was being stage managed by a spy ( i mean a plain clothes police man ) who was standing behind my compound wall. i pocketed the insult as usual.

incidentally the previous tenant of this house where i was staying was manhandled outside the house before he vacated.

nhrc petition simply disappeared into thin air. quite possible that the insanity plank came in handy and was used here as well.

the basic problem is that i am under acute provocation and might loose my cool for once and some thing might go wrong very badly. i dont want that to happen.

so i tried again and some time in 2004 i filed a petition in the high court against the police harassment that i am facing . the harassment was a fact and there was no way the police men could have got away under normal circumstances. but there was a catch- it was a covert operation and i had no material proof. that way kon may ke lal will dare to give evidence in the court against the natan police man let alone the CBI "officer" police!

the police men had nothing to say. so their "lady" govt pleader presented all the documents produced by the dme in a completely unrelated case (which i had received a couple of days back only and had hardly any time to go through) in the court. in fact i feel that this document which was being kept away from me was delivered just prior to the hearing of the case so as to enable the govt. pleader to produce it in the court and bail out the police men. for the rest of the time the judge was busy reading the jucy details provided in the dme's false affidavit - i did not have to say anything at all! the decision in this case was not in my favour.

one interesting fact that i have noticed is that the judgement says "govt pleader assures the court there is no harassment": and so there is no harassment. was she supposed to tell the court that her clients are harassing me ? ! (another interesting fact was that this female desperately wanted my home address; what could be the idea!?)

from the way the police man carries on now, it looks he has got the all clear to go ahead with whatever he wants to. in one of these incidents two people knocked at my gate at 0230 hrs in may 05( i think it was 16 may) claiming to be police men from the medical college police station. they were not in uniform, they did not have an identity card on them. all he had to show was a radio set in his hand - that incidentally many of veerappan's gang also had. ultimately we exchanged "pleasentries" and they went their way after performing their "lawful duties".

infact one of the reason for my purchasing a digital camera recently was this incident. if i had it then i could have got a picture of the "eemans"!

govt. pleader by the way is a political appointment. some one who is a govt pleader during a k antoney's time is most unlikely to remain as govt. pleader when achutanandan comes into power and vice versa.

do you know of any country in the world with a former police man as member of the national human rights commission ?
well, in india we do have one right at the moment i am afraid!
