In the name of God Amen - I Charles Avary Senr of the state of South
Carolina and District of Greenville being in a low state of health - But
perfectly sound in mind and judgment and of a Disposing mind. Remembering
it is appointed for all men to die and being desirious to set my house
in order before that period; I do make ordain and constitute this my last
will and testament in the manner and form following (viz) my body to be
committed to the earth my soul to the auther of all good and as for the
worldly goods the Lord has blest me with, It is my will to dispose of
as follows: First all of my lawfull debts to be paid secondly all the Rest
of my Estate both real and personal (viz) the tract of land I now
live on and all of the negros and their increase together with all of
the stock and house hold and kitchen furniture and so fourth I lend to
my beloved wife Ann Avary during her natural life or widowhood - Then
the whole of the estate to be equally divided between seven of my beloved
children (viz) Mary Head Betsey Bratcher William Avary Joseph Avary Thomas
Avary Robert Avary & Charles Avary with this exception, that the heirs
of my beloved son George Avary to have what I have already given him and
one dollar more at the general division, and that my beloved Daughter
Milly McDaniel or her children to have what she has received and one dollar
more at the general division. And if it should be the will of my wife
Ann Avary During her life to divide any portion of the estate to any of
the seven children it is my will that she should choose two disinterested
men and let them value the property to them as a part of their portion
of the Estate, Lastly I appoint my beloved sons William Avary and Thomas
Avary my Executors, to this my last will and testament as witness my hand
and seal this 20th of March 1824.
