Govt admits it can do little for Hicks

Labor called on the federal government to bring home two alleged Australians being held without charge as alleged terrorists in a US military base in Cuba. But the government said it could do little to help alleged terrorist fighter David Hicks who is facing indefinite detention by the US military. Prime Minister John Howard and Attorney-General Daryl Williams both said Hicks would remain in detention for some time before he faced a court. But Labor said their comments were inappropriate, and called on the government to have Hicks brought before an Australian court. Hicks and another Australian, Mamdouh Habib, are being held at the US military base in Guantanamo Bay, Cuba. Earlier this week, US District Court Judge Colleen Kollar-Kotelly ruled that the 600 men held at the base were not in the US and were not under the jurisdiction of federal courts, allowing the military to hold them indefinitely without charge. Mr Howard gave little hope to Australia taking any action to have Hicks or Habib brought home to face an Australian court. Asked if he believed that detaining Hicks indefinitely without bail at the US base on Cuba was fair, Mr Howard replied: "Given the circumstances of Afghanistan, I think it is, yes." Mr Williams said Australia and the US were both still conducting inquiries into Hicks and Habib. They were seeking to determine whether either man had committed any criminal offence under Australian law, he said. "The difficulty of conducting investigations in relation to actions in a war zone should not be underestimated. "And the position of a person detained in a conflict situation should not be treated as comparable to a person arrested on suspicion of having committed an offence in a civilian context," Mr Williams said. "The two situations are quite different and will be treated differently." But Labor foreign affairs spokesman Kevin Rudd said Mr Howard and Mr Williams were failing two Australian citizens. Labor believed any person suspected of terrorist activity should be prosecuted to the full extent, but no evidence had been presented on either Hicks or Habib, he said. "No Australian would believe that detention for seven months without action is fair," he said in a statement. "If the Government has evidence that Mr Hicks and Mr Habib were involved in terrorist activities they should say as much." Mr Rudd said both Hicks and Habib should be tried in accordance with Australian law. "While the actions of those who participate in terrorism must be condemned and punished, every Australian should have the right to a fair trial," he said. "As an Australian citizen, Mr Hicks and Mr Habib should be tried in accordance with Australian law." ©AAP 2002

Carlton coach in strife after thrashing

Carlton coach Wayne Brittain's future moved into a white-hot spotlight after the club suffered arguably its darkest hour in an appalling defeat by Collingwood in AFL round 18 at the MCG. The Magpies received a massive percentage boost by smashing an embarrassingly poor Carlton side by 108-points - Collingwood's biggest ever win over the Blues in 225 meetings. Only a goal after the final siren by Corey McKernan prevented this being Carlton's heaviest ever defeat, with the Kangaroos 111 point win in 1983 still standing - ironically courtesy of an old Roo in McKernan. The Magpies began to break away late in the opening quarter to win 21.15 (141) to 4.9 (33) over a Blues outfit that frankly deserved to go down as the worst to ever represent Carlton. Even though Carlton was missing players of the calibre of Anthony Koutoufides, Brett Ratten, Lance Whitnall and Matthew Allan, injuries alone could not explain away the team's ineptitude, indiscipline and abject lack of resolve. Brittain was crowing during the week about how he had the support of the club board to see out his contract next year, but that support would be sorely tested by utter humiliations like that suffered tonight. For the Magpies, tonight's thrashing boosted percentage and thus its ambitions to secure a double chance in the finals, and possibly a top two spot to gain critical home-ground advantage in the first week of the finals. More conservatively, the win at least ensured a finals berth - something the Magpies last enjoyed in 1994. It was a memorable win over the old enemy for captain Nathan Buckley, who was best on ground in his 200th AFL match. Josh Fraser kicked five goals to also star for the Magpies, while fellow forward Chris Tarrant provided a good marking target in a positive sign heading toward the finals after an inconsistent season. Carlton's younger players were painfully exposed, particularly as they were let down by senior players such as Scott Camporeale, Justin Murphy and Matthew Lappin who gave away indisciplined freekicks and 50-metre penalties. Only McKernan, who would want to forget his own 200th match, and veteran defender Glenn Manton - who beat his direct opponent in Anthony Rocca, could have any respect in their own individual performance. Both teams had a player reported for striking - Collingwood's Rupert Betheras on Simon Fletcher and Lappin on Ben Johnson. A shattered Brittain was in no mood to discuss speculation about his future after the match. "Some of the young players are not quite ready and some of the senior players are struggling with the weight of the situation we're in and you finish up with a performance like that," Brittain said. "Everyone associated with this team and this group at the moment - myself included - are embarrassed by the performance we put up tonight. "We are a very undermanned footy team - the team we put out tonight we would have put out in a VFL game earlier this year." Collingwood copped a 11-point hiding by Carlton just two years ago and Brittain said "it's our turn to be on the end of it and we've got to regroup and try to do something about it." Magpies coach Mick Malthouse empathised with Brittain's plight. "I feel terribly sorry for Wayne Brittain," Malthouse said. "I don't get any satisfaction whatsoever out of seeing a side humbled like Carlton were and knowing full well part of the reason was there best players weren't playing. "People will judge Wayne Brittain on his win-loss ratio ... what they won't judge is how many senior players he had missing from the side." ©AAP 2002 Feb 2002 Child porn downloader walks free A senior Victorian justice department official walked free on a suspended jail sentence after pleading guilty to child porn charges, some involving images of children as young as six-months-old. Child welfare groups immediately attacked the leniency of the sentence, calling on the judiciary to take child abuse more seriously. Forty-five-year-old James Patrick Allan, a finance officer in the Department of Justice, was convicted in the Broadmeadows Magistrates Court on three charges of possessing child pornography and one charge of making child pornography. It was the first time under Victoria law a person who has downloaded and stored illegal material from the internet was convicted of making child pornography. Tipped off by three teenage female burglars, police raided Allan's Sunbury home in May last year where they found more than 1,600 images stored on computer and discs The majority of the images showed pre-pubescent children from Asia, South America and Eastern Europe - many of them between six months and four-years-old - in sexual acts. Sentencing Allan on Wednesday, Magistrate Alan Spillane said the usual sentence for "such loathsome, repugnant practices" should be imprisonment. However, there were mitigating circumstances for Allan, including the loss of his public service career, his public humiliation and his guilty plea, Mr Spillane said. Allan had not directly "damaged" any young children, Mr Spillane said, but noted that many of the images were of third-world children. "If it wasn't for people like you who wallow in such perversions as these, children in the third world would be less likely to be so grossly abused," Mr Spillane said. The six-month jail sentence suspended for 18 months handed down by Mr Spillane drew criticism from child welfare advocates who urged the courts to get tougher on child porn users. Bernadette McMenamin, national director of End Child Prostitution, Pornography and Trafficking, said child porn viewers were "fully implicated" in child abuse as demand for internet images increased. "What it is leading to are these industries in countries like Russia and Indonesia and in South America where children are being sexually abused to feed the (demand for) images in the first world," Ms McMenamin said. Meanwhile, in a separate case, Victorian Chief Magistrate Ian Gray will sentence another public servant who browsed child porn internet sites on his office computer. The Melbourne Magistrates Court was told 44-year-old Greville Charles Ryder, an administrative assistant in the Department of Education, Employment and Training, was caught in June last year during a random audit of employees' internet use. Ryder later told police he would log on to the child porn sites late in the afternoon when everyone had gone home and he would often masturbate while viewing the images. He told police he knew what he was doing was wrong, but he was experiencing personal problems with his wife and stress at work and his compulsion to view the child porn was "like a sickness", the court heard. Ryder, of Footscray, pleaded guilty to one charge of possessing child pornography. ©AAP 2002 10:48 AEDST Wed 30 Jan 2002 Downer says Hicks is a complete fool Australian alleged al-Qaeda fighter David Hicks deserved to suffer harsh American retribution for his involvement in the terrorist organisation, Foreign Minister Alexander Downer said. Hicks is one of almost 200 Taliban and al-Qaeda members being held by US forces in Guantanamo Bay in Cuba after being captured in Afghanistan. Mr Downer said the Australian public would have no sympathy for the 26-year-old from Adelaide. "We have no illusions about this - he was a very, very foolish person to have got involved with an organisation like al-Qaeda," Mr Downer said . "It was an extraordinarily foolish thing to do. Inevitably, the Americans are going to take a strong stand against anyone who has been involved with al-Qaeda because this is an organisation which is openly, not just by practice but by rhetoric, committed to killing Americans. "We are an ally of the United States and we agree with them. They're perfectly entitled to take very tough action against organisations that are committed to killing their citizens and David Hicks was a complete fool to get wound up in an organisation like al-Qaeda, a complete fool. "I don't think the majority of Australian citizens sympathise with someone who has done something as foolish as that." It was still uncertain what fate awaited Hicks and whether he would be tried under US or Australian law but Mr Downer, in London for a Commonwealth Ministerial Action Group meeting, was sure he would not face the death penalty. "We in Australia oppose the death penalty in any circumstances," Mr Downer said. "But there's no indication that he faces the death penalty. I don't think that is likely at all. "What happens to him is still depending on obtaining the precise details of what he has done and making judgements on whether to prosecute and under what jurisdiction to prosecute." Mr Downer said there were still some cloudy legal issues over whether Hicks should be treated as a prisoner of war under the Geneva convention. "It depends very much on the circumstances in which they were detained and what they were doing when they were detained," he said. "There is an argument that one of your own nationals who is detained fighting against your own country does not fall within the definition of a prisoner of war under the third Geneva Convention." ©AAP 2001 More World news... The comments came after former prime minister Gough Whitlam accused Opposition Leader Kim Beazley of not living up to the party's platform, committing Labor to promoting the rights of asylum seekers. The Sydney Morning Herald said Mr Whitlam wrote to Mr Beazley in early September congratulating him on opposing the first border protection bill, but said he had a long way to go. "You and your confidants have utterly failed to put on the agenda the admirable aspiration in the party's 2000 platform and constitution," he was quoted as writing. Mr Uren, a minister in the Whitlam and Hawke governments and an ALP member for 49 years, said he had not seen Mr Whitlam's letter but agreed with the sentiment behind it. "It was an utter disgrace," Mr Uren said of Labor's bipartisan support for a tougher stance towards asylum seekers. "Our position was me-tooism, it was controlled by pollsters, it really was disturbing from my point of view and I know that it was the same view as many other rank and file members of the Labor Party (had)," he told ABC radio. "I think there's going to be a real reconsideration of that whole thing and I hope to goodness that there are certain people that are selected in the new shadow ministry ... "They are infidels," said bin Laden, who is the chief suspect in the September 11 terror attacks on New York and Washington. "Those who claim they are the leaders of Arabs and are still in the United Nations have renounced the message of Muhammad. Those who resort to international legitimacy are renouncing the legitimacy of the holy book and the legacy of the Prophet Muhammad," he said. Al-Jazeera television, based in the Gulf emirate of Qatar, said the video was delivered to its office in Kabul, Afghanistan's capital. There was no indication of when the tape was made, according to Ali al-Kaabi, Al-Jazeera news coordinator in Qatar. He said the tape was delivered recently but he said not know exactly when. Bin Laden's statement appeared to be aimed at Arab leaders who have called for international efforts to end the Palestinian-Israeli conflict. Bin Laden made only brief references to Afghanistan in the short excerpts shown so far on Al-Jazeera. The station said it would show the entire video at 1800 GMT on Saturday. "The whole West is supporting this unjust, ferocious campaign" against Afghanistan, bin Laden said. "No evidence proves that what happened in America (is related to) the people of Afghanistan, and the people of Afghanistan have nothing to do with this, but the campaign is going on, exterminating civilians including children, women and innocents." The United States is attacking Afghanistan in an attempt to dislodge the Taliban regime, which is providing bin Laden and his al-Qaida network a safe haven. Bin Laden wore a white turban and scarf with a black-and-green camouflage jacket. An automatic rifle stood at his left side as he gestured with his right hand in front of a plain brown backdrop. "Those who take our tragedies today and want to solve them in the United Nations are hypocrites, deceiving God and his prophet and deceiving the believers," he said. In reference to the United Nations, bin Laden asked: "Who was responsible for the partition of Palestine in 1947?" On Nov. 29, 1947, the U.N. General Assembly approved the partition of Palestine, which allowed the creation of the state of Israel. In a statement that would appeal to his supporters in Pakistan, bin Laden referred to Muslims fighting against India in the border province of Kashmir. 16:03 AEST Sun 28 Oct 2001 Anthrax probe looks at homegrown terrorists AFP - Stumped by a string of germ attacks that have killed three Americans so far, investigators are wondering if homegrown extremists, not international terrorists, are behind the deaths by mail. The puzzling bioterror scare has left nearly a dozen other Americans infected with anthrax, forced the shutdown of government offices and left the postal system in disarray, with no delivery in some Washington neighbourhoods. Investigators, certain that the anthrax used to taint letters to lawmakers and media organisations was produced in laboratories, are trying to determine who manufactured it, saying it could even have been made in the United States. The Washington Post today quoted unnamed intelligence officials saying they suspected domestic extremists were responsible for the bioterror attacks, but cited no hard evidence. FBI and other investigators are looking at US-based right-wing hate groups, as well as US residents sympathetic to Islamic extremists, the daily said. "Nothing seems to fit with an overseas terrorist type operation," an intelligence official told the Post. An FBI spokeswoman declined to comment on the report. The US Postal Service faced mounting fears about the safety of the country's mail, with more post offices closed for site testing and thousands of postal workers receiving preventive treatment for anthrax exposure. The post office in Princeton, New Jersey, was closed following a preliminary positive test for anthrax, state health officials announced. Another office in southwest Washington was closed yesterday. More than 12,000 postal workers in the metropolitan Washington and New York areas had been tested and/or were receiving treatment as a precaution, the postal service said on its website. Postal inspectors have arrested 14 individuals for anthrax-related hoaxes and were investigating 13 additional cases. Some 5,500 incidents had been reported, it said. Authorities dismissed a report that the anthrax used bore the trademarks of Iraqi manufacture, and a law enforcement official, who asked not to be named, said "state sponsorship is being considered more and more unlikely". Bioterrorism expert Barbara Hatch Rosenberg said only US scientists had the ability "to reduce anthrax to the sort of highly consistent, smaller particles" found in a letter mailed to Senate Majority Leader Tom Daschle. Daschle lashed out today at those behind the attacks, urging Americans not to be "paralysed by our anger or slowed by our sadness". He outlined three points for a national effort to counter bioterror threats: the increase of the nation's supply of antibiotics and vaccines; better coordination of the government's response; and accelerated scientific research. The anthrax scare began earlier this month when Robert Stevens, a photo editor at the Sun tabloid in Boca Raton, Florida, was diagnosed with inhalation anthrax. Hobart band, THE RESERVES , have had their profit of $16.24, over the life of the band, stolen from them by what was once The Commonwealth Bank Of Australia. A bank representative said that the account had been eaten up by fees. Apparently in this so called age of progress it is impossible for a sophisticated bank computer system to keep track of business accounts with modest amounts of money. Despite representations by the band's financial agent, no trace of the the missing account or funds has so far been found. AFP - Cluster bombs dropped by US warplanes on a village in western Afghanistan killed nine civilians and forced the survivors to abandon their homes, the United Nations said. UN spokeswoman Stephanie Bunker told a press conference in Islamabad that eight people were killed straight away in Monday night's attack on the village near the city of Herat and a ninth was killed after picking up one of the bombs. Another 14 people were injured, she said, and 20 of the 45 houses in the village were partially or completely destroyed. Bunker said local staff from the UN demining program had visited the village -- which she identified as Shaker Qala -- after the attack. "They reported that eight civilians were killed directly in the attack and that one civilian was killed -- as happens in these cases -- when he went to look at the object, touched it and it blew up," she said. "They have determined there were 45 homes in that village, 20 of the homes were partially or completely destroyed in the attack. "The rest of the population decided to voluntarily evacuate and have gone into Herat." Bunker said the survivors were only able to leave the village after the de-miners made a path with sandbags for boundaries so the people fleeing did not touch any of the remaining bombs. A US defence official, speaking on condition of anonymity, later told AFP that cluster bombs had been used in the area around Shaker Qala but did not say if any of the weapons went astray. Air Force General Richard Myers, chairman of the Joint Chiefs of Staff, then addressed a press conference in Washington to confirm the United States was using cluster bombs but did not say if they hit Shaker Qala. "We only use the cluster munitions when they are the most effective weapon for the intended target," Myers said. "There have not been a great number of them used, but they have been used." Earlier UN reports of the apparently misdirected airstrike sparked a call from some aid groups for the United States to stop using cluster bombs. The Diana, Princess of Wales Memorial Fund said as well as the immediate deadly impact of the bombs, many of them did not explode on impact and could kill innocent civilians years later. The bottle-sized weapons are dropped up to 200 at a time, spraying out hundreds of pieces of shrapnel on impact and setting fire to any combustible material nearby. Following the attack on Shaker Qala, the United Nations Commission on Human Rights special rapporteur for Afghanistan, Kamal Hossain, said the US-led forces had to comply with international humanitarian law. "There's already a framework of international humanitarian law that is very clearly defined," Hossain told reporters in Islamabad. "Whoever is conducting those operations are under a legal obligation to comply." Hossain said international law stated maximum care must be taken to avoid civilian casualties and damage to non-combatants. He said the UN would monitor the US-led forces to ensure their actions complied with international law. But he would not be drawn on whether the dropping of cluster bombs on Shaker Qala or other US air strike blunders that have killed civilians during the 19-day military campaign had breached international law. According to earlier UN reports, a hospital and mosque in a military compound within one kilometre of Shaker Qala were also hit in the same series of raids. Bunker said today the UN still stood by its reports, despite the United States refusing to acknowledge that the village, hospital or mosque had been hit. She said there were "casualties" from the attacks on the hospital and mosque, but was unable to give any more details. In an article in the Australian Financial Review, Dr Hewson attacked Prime Minister John Howard's stand on asylum seekers and said the prime minister had manipulated latent racism in the community to his own advantage. "If John Howard wins the election ... it will be a victory of prejudice over policy," he said. Dr Hewson said the lack of policy detail in the campaign and the superficiality of the one debate between Mr Howard and Opposition Leader Kim Beazley was disappointing and demeaned the political process. He accused Mr Howard, whom he defeated in a leadership challenge after the 1993 election, of dozens of flip-flops since winning power and said the prime minister had never had a passion for policy. "He has, however, successfully manipulated prejudice to his personal political advantage," Dr Hewson said. "I guess, to many, that is what makes him a good politician." He said Mr Howard may well have played the race card, as he had been accused of doing, but at the least had tapped a stream of racial prejudice in the community. Dr Hewson, now an adviser to bankers ABN AMRO, described the coalition's Pacific solution for asylum-seekers as ludicrous, ridiculous and a short-term fix and came down firmly behind the Labor alternative. "Beazley is right," he said. "The only effective solution to our particular asylum-seeker problem is to reach an agreement with the Indonesian government that will either stop the passage of these people or at least give us the capacity to send them back, via Indonesia." But he said Labor's strategy of leaving all its policy detail until the campaign may have been a fatal mistake, given the distraction of the military reprisals against Afghanistan.
