 
	
		- You are entitled to be paid all wages, overtime, allowances, superannuation, holiday pay, long service leave, termination pay, redundancy payments and required notice period pay.
- If your employer is unable to make these payment by reason of bankruptcy, insolvency, liquidation or otherwise you still may qualify for payment from certain public schemes designed to help you.
- All workers must get notice of compensation in lieu of notice.
- Employees who are over 45 and who have at least two years service with their employer must receive an additional weeks notice.
- The rate of pay is the employee's ordinary time plus any allowances or penalties or other payments due.
- Notice is not payable where termination is on the grounds of serious misconduct.
- Employers must notify CentreLink if they plan to retrench 15 or more employees. The notice must state the reasons for termination, the number of workers affected and the timeframe for terminations.
Below is a reference that details the period of notice required for a leaving employee in relation to the period of continuous service.
- Under one year: at least 1 week.
- Between 1 and 3 years: at least 2 weeks.
- Between 3 and 5 years: at least 3 weeks.
- More than 5 years: at least 4 weeks.
