Civil Lawsuits
Look Before You Leap
Beware
Beware

What your attorney won't tell you.The legal process of civil litigation is, at best, a very ugly example of how human beings can be at their worst. No Lawer will tell you of how bad and ugly things can get. If they were upfront about it, most intelligent people would not go ahead and pursue a lawsuit. Attorneys are use to the bitterness and betrayal. They see it every day, and will not be the one to loose sleep at night.

You should be prepared to be subjected to a possibly very nasty opposition attorney that will stop at nothing to wear you down, destroy your credibility, and go after all your friends, family, loved ones to drag them down as well. Opposition attorneys will find any weaknesses within you to bring you to your knees and drop a lawsuit. It is very common place for the defendants to hire detectives to delve into all aspects of your past to try to find any "dirt" they can possibly dig up regarding past relationships, doctors, personal life, past employers, and family. Remember once you have started legal proceedings against someone, it is not like you can simply change your mind without re-procussions. People, in their arrogance to protect their name, even when wrong will countersue So you must be convinced of your case enough to see it to the end, usually meaning trial.

Your attorney usually will not prepare you for the lying people will do when under oath.Often cases are built on building and tearing down of witnesses credibility, and not on fact or truth.

And most importantly, your attorney should inform you of how to handle yourself during a deposition. A deposition is where a witness is questioned under oath and recorded. These interrogations are highly stressful and meant to be so. The main purpose of a deposition is for the questioning attorney to see how a perspective witness will appear in court. Everything a witness says will be used in court at trial. While no cases have been won through depositions, many have been loss. It is extremely important to know and understand the discovery and deposition process and procedure.

If you loose .

While it shouldn't be the end of the world for loosing a court fight, for many the effects can be devastating and long lasting, depending on how much time, effort, money, and hope went into your desire to win the lawsuit.Possibly even leading to personal bankruptcy. You should know that should you loose, you will be responsible for attorney's fees from the other side, court fees, and any monies owed to your own attorneys and doctors.
