Towards a Perfect Democracy "Alternatives"


Chapter 11

The Executive

The Executives have equally important role to play in a Perfect Democracy. The Executivery must be an independent body, without any interference of any other branch of the Government except for the corrective and supervisory function. The Executive Body should be responsible only to the Parliament.

An independent Executive branch is very important as till the time there is effective and unbiased total implementation of the laws and the public welfare policies, the common man will not get the benefit of the law and the welfare schemes. Any interference in the effective and equal unbiased implementation will defeat the purpose of the governance.

All executives are to be selected from one common test, which is to Judge the various parameters required for the job, like the knowledge, intelligence, analytical frame of mind, etc. In no case should there be separate selection test for selection of executives for separate area of the State (asis the present practise), people with regional interest talk about equal representation from areas. These people should be made to understand that the best way of selection is that the best men are there for every area, even for their regional area instead of compromising and specially finding people belonging to the region. They must be told firmly that the State (i.e. Nation) supersedes a region.

Apart from one similar kind of test for selection of all executives of a State, there must not be any nominations surpassing talent or seniorities and certainly no reservations which promotes compromised standards of appointment or promotion at any level.

The structure of the various Executive Bodies should be such that the Executive is answerable only to his senior official and so on and the highest official of the Executive branch is answerable only to the selected Executive Body. There must be unity of command with fixed responsibility and accountability.

For the purpose of convenience of administration, the Nation/State must be divided in not more than four divisions or zones. Each Zone should have a Zonal Executive Body superintending the working of Executive structure of the area.

There should be an Executive Body of five members for each Zone which shall be responsible to the Chief Executive Body and forwarding all reports and findings to it. The Chief Executive Body is to have eleven members, selected only on the basis of talent and seniority from the executives, provided that no member who shall be retiring in one year at the time of eligibility for appointment shall be its member. The Chairman of the Executive Body shall be appointed by the President on the advise of the Prime Minister and his Cabinet from the existing members of the Executive Body.

The member of Zonal and Chief Executive Body must be selected on the basis of seniority from all the existing members who have put in a required tenure of service years and achieved a certain level. There should be no ignorance of seniority because if a person has reached a particular level in the service and put on the required tenure of service, he has done so only because he is supposed to be capable, relative capability of different people may vary to some level but that again would be subjective, different observers may rate different person as more capable and the capability may be adjudged differently on different parameters so the best course is to go by seniority.

The Executive Body shall be sitting permanently in one office under one roof and deciding all the matters in a day to day proceedings. The setting of the office should be such that apart from the retiring and guest rooms the office should be set in a conference room fashion. No member of the Executive Body shall be doing any field duty and shall be in the office for all working days and working hour. It must be primarily a supervisory body, overseeing the performance of all other executives.

The Chief Executive Body shall be answerable only to the Parliament through the President. A member of the Zonal Executive Body can be removed from the office by the President only on the recommendation of the Chief Executive Body. Either House can propose a motion for the removal of any member or the Chairman of the Chief Executive Body through a simple majority and recommend the President for the removal of the member.

The Cabinet shall have the right to summon any information or record from any Executive Office under intimation to the President through the Chief Executive Committee. The Executive office from which a record is sought can send the record or the information to the Cabinet through the Chief Executive Committee and under intimation to the President through the Chief Executive Committee.

Apart from the other Executive appointments, Police for maintenance of internal law and order requires special attention. It is very important that the Department of Police in a State is efficient and effective. The common man may not be interested in the routine affairs of the Government, but he is certainly interested in the day to day affairs of his town/city/village, any lawlessness can not escape his eyes, a common man always observes his position vis a vis others and take the cue from observations, as to how he is to react in similar situation. If the general observation of the majority of people is, that the only way of getting things is through wrong and illegal means and that any misdeed can be manuplated at the first level itself, then   this is an indication of corrupting system, and impotency of the Police.

If the Police do not function properly and there is interference by big shots in its day to day working and the Police is influenceable, then lawlessness shall be invariably the order of the day. Since Police is responsible for true and unbiased investigation and to present the material of investigation before the court of law. If this basic function is corrupted, it means that the system needs not revamping but has to be scraped totally and a new system is to be devised. The judiciary shall be handicapped without the active and intelligent support of the policing department, no true justice can be meted out.

Even the junior police officials need to be much more educated and intelligent than the junior Army officials, since Police is dealing not only with criminals but also with common people. They must be seen as friends of all law abiding citizens and not otherwise. The approach of the Police is to be more humane, that does not mean that it should be soft towards the law offenders, the policemen ought to be more analytical.

The selection of the senior police staff  should also take place along with the executives but the manner of supervision of Police should be different. Since I am advocating scrapping of the Sub-State system, presently called the states of the Country, so the Police will become centralised and shall be directly responsible to the Parliament. As mentioned earlier, only for convenience sake, the State is divided into four zones and each zone shall have a separate Executive Committee of five members. This Committee shall be taking all decisions on all administrative matters and the highest officer of a Zone shall be responsible to this Committee. This Zonal Committee shall be responsible to a eleven member National Committee who in turn shall be responsible only to the Parliament through the Chief Executive Committee. The Zonal Committee shall not be taking direct instructions on the policing details but shall be responsible for the general policies and procedures only. All the members of the Zonal or National Committee shall be selected only on the basis of their seniority.

Similarly the Armed forces or the Defence forces too should have a separate administrative and Executive Body to guide on the administrative policies, coordinate and supervise the day to day functioning so that they are within the State’s policies on foreign affairs and relations, recommend to the Parliament its suggestions and provide the feedback and the required information to the Government. The day to day functioning, the intricate defence matters like strategy formation and enforcing discipline of different division of the armed forces is best left to the senior most Defence officer and the divisional units of that division. The Defence Executive Body should be seprate and independent of the State Executive Body, even the selection of the members should be done separately. Here it must be stressed that the officers of the regular armed force must not be promoted to form the Executive Body, except for the outgoing Chief of each division of Defence forces who shall become the member of Executive Body for a period of one term, on the termination of his tenure in the regular Defence Services.

In a Perfect Democracy, it is important that the intelligent, talented and knowledgeable people be attracted towards the State Services. For this the remuneration must be very attractive apart from some other special benefits offered (as are given to the Defence Services). The desirable approach in a perfect Government demands that all the people otherwise eligible for appointment as Executives or Judicial Officers and after they join should be provided with a compulsory lumpsum amount of money equal to at least their one year’s salary as advance, so that a new officer is in a position to complete his family and social commitments/obligation at the time of joining the Service itself and is not tempted or compelled to choose the path of corruption to fullfil his obligations or desires.

Since most of the people joining the Services shall be from the general public and with limited resources (as is the present case), so there is every possibility that they may be having certain material requirements and desires, these requirements must be fulfilled at the time of joining itself. The advance can be adjusted over a period of time. Those who do not want to spend the amount immediately can opt to save it or invest it. It is possible that in some rare cases this facility is misutilised but that is a small price to pay for the results.

Once a perfect democratic government have an independent Executive structure which takes care that all the laws and provisions are implemented effectively and that the public good is taken care of, half the job is done. The second inportant part is that these executives are approachable by common people, who are not articulate enough, without any inconvenience and their grievance heard and action taken without unnecessary delay. This will add faith of people in the Government and make them proud of their State.
