The total HP Loans outstanding (backed by the 3 guarantees) was M$155,318.03! - the Principal Loan Amount.
I have stated in my affidavit dated 14 November 1995 that I was not in Malaysia on the 20th July and 4th August 1991 and my travel document was submitted as evidence. The Judgment dated 6th July 1995, Statutory Demand dated 19 September 1995 was granted by the Court to be set aside on 1 December 1995. (See above link to Court's Order)
The Judgment dated 6th July 1995 for default in appearance was taken against me without my prior knowledge until I received the Statutory Demand dated 19 September 1995.
In December 1995, I discovered that Arab Malaysian Credit Berhad had obtained a Judgment against me in Malaysia for the same matter in May 1994, also for default in appearance.
On March 26 2001, I discovered that Arab Malaysian Credit Berhad had obtained another Judgment against me on 9th December 1995 without my knowledge, also for default in appearance. Wong Tan & Molly Lim replaced the Judgments and issue new statutory demand - Click Here.
They forged my signatures on two of the above guarantees and I have to prove my innocence in the Year 2001. They produced uncertified photocopies of the documents to the Court to get the Judgments against me while I was residing overseas.
They refused to show the Court and I the Original Documents - How am I to prove that the signatures were forged? I asked for it in the year 2001.
While opposing the Bankruptcy Order on 1 August 2001, I finally discovered that the dates tell the truth and can still prove my innocent. 4th August 1991 was a Sunday! A Bank Guarantee signed and offered on an Official Banking Holiday without my presence in the office of Arab Malaysian Credit Berhad. The witness was Mr. Desmond Lim Eng Kuei, a marketing officer of AMCB. He left AMCB in January 2001! The truth was they forged the documents.
20th July 1991 was a Saturday, and dated on both the Guarantee and the commencement date of the Hire Purchase Agreements. It is impossible, as the machineries were imported from Taiwan, given the time to process the loan, shipping and banking documents and transit time, how could a loan be given prior to the execution of the Guarantee? Base on what logic?
They were able, with the help of their lawyers, Wong Tan & Molly Lim (also a Financial Institution legal advocate) made me a brankrupt on 1 August 2001.
This is more than I can take as a normal human being, my health is deteriorating due to the gross injustice that I have suffered.
I was punished by this thing call "LAW" that is relatively unknown to me and being a small entrepreneur, I was bullied and TERRIFIED by these Goliaths for the Allegation that I did not commit. Moreover, I was convicted three times for the same allegation for the same reason!
