Elbert Elberson and wife to Robert Harvey, 28 Dec 1767 and 24 May 1769
Note 1: An attempt was made to copy the deed verbatim. Three abbreviations
used in the deed book were Exers for Executors, Admrs for Administators, and
Inst , I believe means Instrument.
Note 2: The deed was executed twice, first on 28 Dec 1767, then again on
24 May 1769. Apparently this was because Jemima Elberson was not of
age at the date of the first deed.
Note 3: The “Hogg Swamp Brook” referred to in the deed is now known as
Harvey Brook. It flows Easterly from Cold Indian Springs toward Deal, New
Jersey. As it approaches Deal it turns to the South and flows into Deal Lake.

THIS INDENTURE made the twenty eighth day of December
in the year of our Lord God One thousand and seven hundred & sixty seven
Between Elbert Elberson & Jemima his wife of the City of New
York of the one part, and Robert Harvey of the Township of Shrewsbury
County of Monmouth and Province of New Jersey of the other part, Witnes
seth that the said Elbert Elberson and Jemima his wife for and in
consideration of the sum of Four hundred & twenty Pounds current

lawful money of the City of New York to them in hand paid by the said
Robert Harvey the receipt whereof which they do hereby acknowledge and
themselves to be therewith fully contented satisfied & paid and from every
part & parcel thereof doth hereby Acquit Exonerate & Discharge the said
Robert Harvey his heirs, Executors, Administrators and every of them forever by these
presents Hath granted aliened enfeoffed released conveyed & confirmed and by these
presents doth fully clearly & absolutely grant bargain & sell alien enfeoff
release convey and confirm unto the said Robert Harvey his heirs
Executors Administrators and Assigns forever, a certain tract of land situate ly
ing & being in the Township of Shrewsbury County of Monmouth and
Province of New Jersey aforesaid Beginning at a Stone laid down
for a Corner which Stone is upon the NorthWest corner of said granted
tract and at the SouthWest Corner of William Wardells where said
Wardell now dwells thence South twelve degrees & an half East to Hogg
Swamp Brook, thence Easterly along said brook as the brook Runs
untill it comes to an old Ditch thence along where the Ditch is cut
untill it come to said Brook again then as the Brook runs to
another Ditch then as that second Ditch runs and then to the Brook
again then down the Brook untill it comes opposite to a large Stone
Laid for a Corner upon Thomas Whites line Thence North two degrees
and an half West over said Stone and along said Thomas Whites
line to the South East Corner of the above named William Wardells
tract, thence along said Wardells line North Eighty three Degrees
West to the Beginning, to have and to hold the above granted
and bargained premises with all the appurtenances thereunto
belonging unto the said Robert Harvey his heirs Executors Administrators and
Assigns forever, to sell and convey which the said Elbert Elber
son & Jemima his now wife hath good rightful power & absolute
lawful authority by virtue of a deed of sale granted by Robert Drum-
mond Gentleman deceased to the said named Jemima the now wife
of the said Elbert Elberson in which Deed and above described Tract
was confirmed by a release granted of said Tract unto the said El-
bert Elberson and Jemima his wife to their heirs & assigns forever
by Mary Wardell & William Wardell and Jacob Brewer under hand and
Seal upon the 23d Day of this Inst December and the said Elbert Elberson
and Jemima his wife doth Covenant promise grant to and agree

with the said Robert Harvey his heirs Exrs Admrs and assigns that the
said granted and bargained premises and every part thereof are free
and clear from all other gifts grants & sales mortgages dowers jointures
wills or incumbrances whatsoever and the said Elbert Elberson
and Jemima his wife doth hereby promise for themselves & their heirs
to warrant & defend the above granted premises in the quiet and
peaceable possession of the said Robert Harvey his heirs Exrs, Admrs, and
assigns forever against all persons whatever lawfully laying claim
to the same or any part thereof by from or under them so as to disturb
the said Harvey his heirs or assigns in Enjoying said Tract as their
own right proper Estate forever. In Witness whereof the said

ledged his hand & seal to the within Instrument as his own voluntary
act & Deed, also at the same time appeared before me Jemima El
bertson another of the grantors within named & wife of said Elbert
Elberson & being examined separately & apart from her husband
acknowledged her hand & seal to the within instrument as her own

Elbert Elberson and Jemima his wife of the City of New York of the
one Part and Robert Harvey of the township of Shrewsbury in the County
of Monmouth & province of New Jersey of the other part. Witnesseth that
the said Elbert Elberson and Jemima his wife for & inconsideration
of the sum of Four hundred & twenty pounds current lawfull money
of the province of New York to them in hand paid by the said Robert
Harvey the receipt whereof they do hereby Acknowledge & to be there
with fully contented satisfied & paid and from every part & parcel
thereof do hereby acquit exonerate discharge the said Robert Harvey
his heirs Executors administrators and every of them forever by these
presents Have granted aliened enfeoffed released conveyed & confirmed
and by these presents do fully clearly absolutely grant bargain &
sell alien enfeoff release convey and confirm unto the said Robert

where the Ditch is cutt untill it comes to said brook again thence as
the brook runs to another Ditch thence as that second ditch runs and

Drummond Gentleman deceased unto the said Jemima the wife
of the said Elbert Elbertson which Deed and above described tract of land
was confirmed by a release granted of said tract unto the said
Elbert Elberson & Jemima his wife to their heirs & assigns forever by Mary
Wardell and William Wardell and Jacob Brewer under hand & Seal up
on the twenty third day of December in the year of our Lord one thousand
Seven hundred & sixty seven and the said Elbert Elberson & Jemima
his wife do covenant promise & grant to and agree with the said Robert
Harvey his heirs Exrs Admrs &assigns that the said granted & bargained
premises and every part thereof are free and clear from all other gifts

soever and the said Elbert Elberson and Jemima his wife do hereby

Apparently it contained only the Judge’s name.
2nd NOTE: Robert Harvey married his third wife, Hannah White on 1 January 1764.
He wrote his will 28 January 1775. The will was probated 12 April 1779.

Andrew Bell to David Harvey , 10 July 1816
Deed Poll ~ This Indenture made the tenth of July in the year of our Lord one thousand
eight hundred and sixteen between Andrew Bell of Perth Amboy in the State of New
Jersey of the one part and David Harvey of the Township of Howell in the County of
Monmouth and state aforesaid of the other part. Witnesseth that the said Andrew Bell for
and in consideration of the sum of one hundred and thirty dollars to him in hand paid by
the said David Harvey, the receipt whereof is hereby acknowledged, hath granted,
bargained, and sold, released, enfeoffed, conveyed and confirmed and by these presents
doth grant, bargain, sell, release, enfeoff, convey and confirm unto the said David Harvey,
his heirs and assigns forever all that tract of land situate on the North side of the
Manasquan River and on the South side of the Shark River in the Township of Howell in
the County of Monmouth and Eastern division of the State of New Jersey, beginning at a
stone, being the most Westerly corner of a tract of thirty six acres returned to John
Rattoon on the twenty sixth day of March 1794 and recorded in Book S11, page 16, and
now belonging to Stephen Harvey. Said beginning being also about ten chains
Southwesterly from the said Harvey’s dwelling house, thence (1) North fifty degrees
West thirty one chains and twenty five links, thence (2) North forty degrees East sixteen
chains, thence (3) South fifty degrees East thirty one chains and twenty five links, thence
(4) South forty degrees West sixteen chains to the place of beginning. Containing fifty
acres strict measure ~ in as full and ample manner as the land was surveyed to the said
Andrew Bell as by a return thereof dated the twentieth day of October 1813 and recorded
in the Surveyor General’s Office at Perth Amboy in Book S16, page 251 will appear.
Together with the privileges, hereditaments, and appurtenances to the above bargained
premises belonging or in any wise appertaining, and all the estate, right, title, interest,
claim, and demand whatsoever, either at law or equity, of him the said Andrew Bell, of,
in or to the same and of, in, or to any and every part and parcel thereof. To have and to
hold the above bargained premises with the appurtenances unto the said David Harvey,
his heirs and assigns, to the only proper use, benefit, and behoof of the said David
Harvey his heirs and assigns forever. And the said Andrew Bell, for himself and for his
heirs, executors, and administrators doth hereby covenant and agree to and with the said
David Harvey, his heirs and assigns, that he the said Andrew Bell lawfully seized of the
proprietary right of location on which the aforesaid tract of land was surveyed and
returned, that he hath not done, nor suffered to be done any act, matter, or thing whereby
the premises hereby granted may be in any way charged or encumbered in title, charged
or estate ~ and also that he the said Andrew Bell will warrant and forever defend to the
said David Harvey his heirs and assigns the proprietary rights of location whereon and
whereby the above described tract of land was surveyed and returned to him the said
Andrew Bell, against the lawful claim and demand of all persons whomsoever.
In witness whereof the parties to these presents have interchangeable set their hands and
seals the day and year first above written.

Samuel Harvey, Jr. & Wife to Joshua Gifford, Jr., 3 Nov 1790
Deed Indented. This Indenture made this third day of November in the year of our Lord
one thousand seven hundred and ninety, between Samuel Harvey, Jr., son of Robert,
deceased, of the Township of Shrewsbury in the County of Monmouth and State of New
Jersey, of the one part, and Joshua Gifford, Jr. of the same place aforesaid, of the other
part. Witnesseth that the said Samuel Harvey and his wife Lydia Harvey for and in
consideration of the sum of three hundred and twenty eight pounds Proclamation money
of said state to him in hand paid by the said Joshua Gifford, receipt whereof I hereby
acknowledge, and the said Joshua Gifford thereof discharged, hath granted, bargained,
sold, released, assured, conveyed and confirmed and by these presents doth grant,
bargain, sell, release, assure, convey and confirm unto the said Joshua Gifford, his heirs
and assigns, the following plantation whereon the said Samuel Harvey now lives, which
was conveyed to him by a deed of sale from Thomas Cook, bearing date the twentieth day
of March, 1787. Part of said plantation was conveyed to said Thomas Cook by the last
will of his deceased father, Ebeneser Cook , and by a deed from David Knott dated the
first day of December, one thousand seven hundred and sixty one, and also by another
deed of sale from his brother William Cook, a reference being had to the said deed from
Thomas Cook to the present grantor, Samuel Harvey, will show all the butts and
boundaries of this within granted plantation. It does boundeth South on Manasquan River
and Easterly on John Johnston and Westerly on a forty acre lot formerly sold out of the
old survey, the other two lots that were conveyed by David Knott to Thomas Cook and
William Cook is the boundaries and points of compass and number of chains particularly
described in the deeds from said David Knott to the above said Thomas and William
Cook, being all the lands sold by Thomas Cook to Samuel Harvey, bearing date
as above, the which deed and the two deeds from David Knott to Thomas And William
Cook and the deed from Joseph Lawrence to Ebenezer Cook is all four of the said deeds
delivered to said Joshua Gifford to show the said butts and boundaries of said plantation
now conveyed by these presents by the said Samuel Harvey to said Joshua Gifford.
Together with all the houses, barns, orchards, meadows, orchards, fields, fences, woods,
under woods, and all other of the privileges and appurtenances whatsoever to the same
belonging or in any manner of ways appertaining. To have and to hold the aforesaid tracts
of land and meadow with all and every of their privileges and appurtenances unto the said
Joshua Gifford, his heirs and assigns for to the only use, benefit, and behoof of him the
said Joshua Gifford his heirs and assigns forever. And the said Samuel Harvey for himself
and his heirs doth covenant and agree to and with the said Joshua Gifford his heirs and
assigns that he hath good right to grant, bargain, and sell, convey all and every of the
premises with the appurtenances in manner and form as aforesaid and the same in the
quiet and peaceable possession and seizen of him the said Joshua Gifford his heirs and
assigns against the just, right, lawful claim of all persons or demands whatsoever,
will forever hereafter warrant and defend the same as I the said Samuel Harvey, being
fully seized of the premises and having lawful authority to grant, bargain, and sell the
same. In witness whereof we the said Samuel Harvey and Lydia Harvey have hereunto set
our hands and seals the day and year first above written, 1790 ~

acknowledgment taken by a commissioner or judge. I think those items continued on the
next page and Monmouth Archives did not send me a photocopy of that page.
