New twist in Jacobs-BCAP case
The Basketball Coaches Association of the Philippines
(BCAP) now believes that the PBA's other American coaches
Tim Cone of Alaska and Norman Black of Mobiline could also
be prohibited from coaching in the league.
Thus, said lawyer Luis Lokin Jr. who, representing the BCAP in
its bid to stop American Ron Jacobs from coaching San Miguel
Beer in the PBA, quickly added that the association does not
intend to file a similar protest against Cone and Black.
"It's just an offshoot of the Ron Jacobs case," he said. "We just
believe that if Mr. Jacobs would be prohibited (from coaching) it
just follows that Mr. Cone and Mr. Black would also be
affected."
The BCAP is currently protesting before the Department of
Labor the issuance of an Alien Employment Permit (AEP) to
Jacobs, citing a 1991 Supreme Court ruling that barred
non-resident aliens from coaching the pro league.
Cone and Black became resident aliens because the two married
Filipinas but the BCAP contends that even the two should not be
allowed under a provision in the Constitution "limiting all
regulated professions to Filipinos."
"In our research, we found out that an AEP is not enough to land
a coaching job," said the BCAP legal counsel. "Because like
accounting or lawyering which are regulated by the PRC
(Professional Regulation Commission), coaching is also a
regulated profession because the PBA is under the GAB (Games
