MILITARY MURDERS: a mother’s worst nightmare!

On the night of Aug. 1, 2007, a lot of people lost a lot of sleep because of nightmares about collapsing bridges. I, however, lost a lot of sleep because I couldn’t get the hauntingly arrogant face of Donald Rumsfeld out of my mind and his words, “I think the Pentagon owes the Tillman family an apology.”  kept ringing in my ears. That’s insulting and SCARY!!

It’s insulting that Mr. Rumsfeld thinks that an apology can be substituted for an accurate accounting of a violent death. But, how better to cover lies and keep a ‘Public Safety’ matter disguised as a small military problem than to muddle the issue?

On Tuesday, April 24, 2007, during a Congressional Hearing of the House Committee on Oversight and Government Reform , the brother of Pat Tillman, testified to “deliberate and calculated lies” that confront families seeking a full and accurate accounting of the death of a loved one, who was serving in the military....and that is the truth!

Unfortunately, the Tillman case is but the ‘tip of the iceberg’, when it comes to military families
(past, present and future), dealing with the military’s contention that the circumstances
surrounding the death of their loved one....”don’t matter!”

I am the mother of HM3 Scott Michael Beimdiek, USN/USMC, and I’ve been living every
parent’s “worst nightmare” since January of 1993, when he, whose life was on hold so he could serve his country and get aid for his college education, died. While his death is officially listed as an “accident” there is ample evidence that he was murdered and it’s been a whole other nightmare, for my entire family, trying to obtain a full and accurate accounting of his death.

The realization that our son was murdered and possibly tortured before he died was originally
formulated by circumstantial evidence that....
- Started with a letter he’d sent home that questioned the death of an Airman being ruled as a
‘Suicide’ and his notation that this was the third serviceman to violently die since his arrival in
Okinawa, three months earlier.
- Wound it’s way through hoards of unanswered questions centered on questionable facts like:   * A welt that circumvented his neck...on a hanging victim?
  * Blood found on the wall by his body that typed out as B+....when his blood is AB+?
  * Shipping orders for his body that denote him as a ‘Suicide’ in the ‘Line of Duty’?
  * The fact that there hadn’t been a complete uniform (Navy or Marine) in his transient      
barracks’ room?
- And ended when a frustrated tirade to Special Agent Larry Swails (DoD) concluded with me
blurting out, “I’m NOT CRAZY! My son was MURDERED!” and he simply replied, “I know.”

The conviction of our conclusion comes from the fact that the autopsy pictures are at odds with the autopsy report. Noted examples include, but are not limited to, pictures that:
1) show that the hyoid bone is broken and embedded in the back of his throat...yet, the report
states the hyoid bone is intact, indicative of ‘accidental’ strangulation.
2) show what appears to be a nasty bruise on his scrotum with a trickling of blood oozing from
it...yet, the report notes it as a “reddish brown patch of skin” and totally ignores the blood..
3) show a spittle pattern that indicates he died, laying on his left side...yet, the report notes a
hanging death.
4) show marks, indicative of bindings, on his wrists and his hands balled into fists with the
thumb tucked inside and clenched so tightly that they turned black when he died....yet, the report only notes a white substance along the side of his thumb and forefinger.
5) show red thumb shaped marks at the base of each armpit, a red palm sized mark and a
brownish mark near the small of his back...yet, the report says there on no marks on ‘Beimdiek’s back’.

There is a seriously systemic problem with questionable ‘manner’ of death rulings by the
military. The military is abusing it’s power in a system that allows it to police itself and families,
like mine, are suffering because of it.

We contend that the Department of Defense (DoD) and the hierarchy of the military are
obstructing justice and actively engaged in the practice of covering up murders.

We assert that under the guise that the circumstances are irrelevant to a ‘manner’ of death ruling, the military has become expert at manipulating facts and information which are, then, funneled through channels that will insure a “concurring conclusion” of their predetermined findings.

This practice of manipulation is so effective that Charles J. Stahl, former Director of the Armed
Forces Institute of Pathology (AFIP), was confident enough to quip: “You’ll get your reports.
You’ll get your pictures. You can take them anywhere you want...to whom ever you want. It
won’t get you anywhere. This is the court of last resort and you have nowhere else to go.”

During a heated exchange between Mr. Rumsfeld and Rep. Dennis Kucinich, who alluded to the strategy that’s worked in the military cover-ups, Mr. Rumsfeld said, (using the quote of Erica Werner, AP) “Congressman, the implication that ‘you covered up’ ---that’s just false, you have nothing to base that on, you have not a scrap of evidence or a piece of paper or a witness that would attest to that. I have not been involved in any cover-up whatsoever.”

Simply put....(through omission) that’s an outright LIE and Mr. Rumsfeld knows it!

Mr. Rumsfeld knows that there are thousands of pieces of paper and hundreds of witness that would attest to military cover-ups. He knows that just the materials and family witnesses connected with the ‘Section 1185 of PL 103-160 for the Defense Authorization Act of 1994’ would fill a Hearing Chamber to overflowing.

Unfortunately, Mr. Rumsfeld also knows that any endeavor, undertaken to secure such evidence, could prove embarrassing to members of the House and Senate. Why?

Because disclosure would show that Congressional offices, both in the House and Senate, have routinely put families...begging for a full accounting and calling for reform for questionable death rulings by the military...on their ‘back burners’ and a little thing, called: ‘Congressional Courtesy’ keeps them there.

Congressional Courtesy prohibits congress from getting the ‘Big Picture’ and without a clear
overview of this problem...there can’t be reform and the body count will continue to rise.

Why? Because the DoD and the hierarchy of the military are fully attuned to the fact that it
wasn’t the ‘tip of the iceberg’ that sank the Titanic.

Mr. Rumsfeld is reminiscent of a belligerent parent who’s been called to the principal’s office
because his ‘ward’ (the military) has been identified as the ‘school yard bully’!

The military that has terrorized and abused it’s victims for years was finally caught in the act
because it picked on the wrong ‘kid’! But it’s scary to think that an apology may be all that
comes out of a Congressional Hearing on Oversight and Reform.

Pity the next family with ‘no name’ and ‘no money’ that finds itself in the military’s cross-hairs
because they dare to question the accounting of their child’s violent death. Plus the implications
and ramifications for society at large are monumental..

A murderer who has gotten away with murder is a dangerous person and a threat to the public’s safety. Yet, the military is ‘discharging’ such individuals into society on a regular bases. Is it any wonder that the FBI is reporting that the homicide rate is (dramatically) up in our cities?

I am asking for your help to expose this deplorable and unconscionable problem by calling for
formal public inquest hearings for ALL of the families of deceased military personnel seeking
accountability from the military for questionable death rulings.

Because Congress has the tendency of viewing the military as a self governing entity, it’s
important that you understand that there is some confusion about the terms: Inquest & Inquiry
and the possibility that the words are interchangeable. They are not!
1) We do NOT want an INQUIRY, which would trigger an investigation that would funnel (to use Kevin Tillman’s accurate wording) “deliberate and calculated lies” through channels that would insure a concurring conclusion of their predetermined finding. This prevalent practice is akin to having an Accounting firm audit it’s own books and it can not be allowed.
2) We REQUEST a formal public (Coroner’s) INQUEST Hearing, where the evidence can be presented in it’s entirety to a jury.

Pat TillmanYou, in your own best interest, need to contact your legislators (Democrats and Republicans) and demand true reform. Otherwise, Mary Tillman, who isn’t the first or only mother to go on a quest for the peace of mind that comes with a true and full accounting of her child’s death, won’t be the last and (trust me) you don’t want to be the next mother (military or otherwise) to grapple with this nightmare!
